when my husband went to his interview, they just asked to see an original marriage certificate. they didnt ask for the translated version. However, when i filed my i-130, i did send in a translated marriage certificate. good luck!

Hi, my husband received his greencard about 2 1/2 months after he arrived in the US, eventhough i paid it about three weeks before he came. They sent it to the US address we had on file. Hope this helps.

the time frames with the fbi fingerprints can vary, at least thats what i have heard. however, i have always seen that a FOIA is filed to see if anything would be on his record immigration wise. you may want to ask your attorney about those. the form is free however, the wait can sometimes be a little long. sometimes your local congressman is able to help with getting it a little quicker.

Hi, no one can really tell you your chances of approval. you should go over to the immigrate2us.net site where they have a lot of information on provisional waivers and others in your same spot. have you gotten a foia to see if your throwback was just a throwback or a deportation? go over to the other site where more people can give you more insight.

I think someone (your attorney) is confused about the waiver process and hopefully it is not your attorney because if so, you need to get another one or do it on your own. the i601a would be done prior to interview but that does not apply to you because that is for those that are in the united states. the i601 is filed after your interview, so thats why i see no point in postponing your interview as it makes no sense. at the interview they will tell you if you are eligible to file a waiver and if one is needed. they will give you a blue piece of paper at the end that says denied but eligible to file waiver or denied and not eligible to file waiver due to ..... reason. you need to get things straightened out with your attorney asap.

no idea about the arrest issue. go over to the other website immigrate2us.net , there are tons of people in the same boat as you and ones that already did their interviews and provide insight to what can still be brought up there. But, if I were you, i would call NVC today myself and ask what they are still waiting for in order to close the case because to me it seems like a long time.

wow certainly usually not that long even with NVC being much slower. you may want to call NVC yourself and see what the hold up is because Mexico usually schedules interviews within about 3-4 weeks of NVC case completion. the other website immigrate2us.net has alot of i601a timeline forums. I have seen people over there with waivers approved from september already back here in US after interview.

if he has a 10 yr ban due to overstay, they dont overlook those at the interview due to him being out of the country for some period of time. i have never heard of anyone getting by without having to file a waiver when one is needed unless they have been out of the country for the full span of 10 years.

hi, getting the interview moved is not so much an issue. did you ever let nvc know you are planning on filing an i601a waiver? either way let them know so you can move the date. as far as the multiple voluntary departures, i have never heard of that. you may also find some good advice and forums on immigrate2us.net it has a lot of waiver info on it and tons of people at the same stage where you are at. there are also a lot of good attorneys they can recommend to you. i would get a second opinion from another lawyer before you file the waiver.

totally agree with all answers of Ryan H, i will just add from my experience at CDJ, i added all translations with my documents just in case so not to cause any unforseen delays and as far as the passport pictures go, the rule there is if they are more than 6 months old then get new ones. it can be a hassle but delays are such a pain too, so i would just get new ones if i were you. Also, I would also wait to send the package until you have paid all of the fees first. good luck!

Hello everyone. I need help please. The interview is on dec 11 and we scheduled the medical at Medicos de Visas for monday dec 8. I just got a call from the clinic and they said we MUST have the original letter stating that the interview date. The problem is that we never received the letter in the mail. I only received an email copy of the letter. The clinic said we cannot use the email printed copy and to go to the consulate to get an original letter. Can someone please tell me if they experienced the same thing? Now we are thinking we might loose the medical appt. :-( .
Please let me know.
Honestly i think you will be fine if you just print out the actual attachment with the appointment letter you receive from NVC. My husband was there a few months back and took the letter we received via email and it was fine. i think they say the actual original letter because some people dont print the attachment just bring screen shots of a letter or just the email from nvc without the attachment so thats why they say to bring the actual letter. we did electronic process with NVC so we received everything via email. just print out the letter and take it though and it should be fine. my husband said although it is a stressful process because you want to make sure you have everything ready before getting there, everyone there is really helpful the whole time from the hotels, to the medical to fingerprint appt, they answer any questions and give you estimates of when to be at which place, etc. good luck!

i think the wait time varies a little. my husband went in April to CDJ and then went back to Morelos, and received his DHL with passport within four days. but lately on another website people have been saying about ten business days average in CDJ or any other city to receive DHL. a few weeks ago, one person said they received their DHL in CDJ four days after the interview however two other people waited almost three weeks so it is kind of all over the place and apparently all three were there at the same time.

i think you should be fine, i tried to visit my husband my husband every 6 months for a week or two for the years we were apart during the process and i never had problems. all they ever asked was what brought me to visit each time? i said "my husband" and what state did he live in mexico and i told them, that was it, they were always nice.

Absolutely! this was disclosed in the I-130 as well as the I-601A. I guess we're just worried about some guy having a bad day and seeing things differently. Do we know how often it happens? I just wish I had SOME sort of statistics to help base a decision.
how often statistic wise? no idea, just have heard of it happening occasionaly. if it was already disclosed on the waiver then you should be fine, just be honest because it may or may not come up at the interview.

was this ever disclosed in the waiver? There is always a risk of being denied at the interview even after waiver approval, not common, but not unheard of either.

well after the i-130 is approved, it will go to NVC and after that process you will go to your medical appt, finger print appt then interview in CDJ where you will be approved, denied with or without an option to file a waiver (i601 and i212) if needed. However, without knowing your criminal history, or why you were even arrested to begin with, not sure about specifics. your wife may want to try to obtain a criminal file for you so can see what charges are on your record.

ok, yes my waiver was accepted and approved. I am not sure why by the information you gave they would think you would need to submit a waiver more than once, they must not be that good of a waiver attorney if they cannot stand 100% beside their work. on the other site there are a lot of good waiver attorneys if you want to use an attorney. and from what I have always heard the main reason for a denial of a waiver is lack of evidence of hardships, so just make sure to back up every argument you have, not necessarily a lack of hardship is an automatic denial, however, lack of argument of same is worse. As far as NVC, yes they asked me for any court documents relating to his traffic ticket and any court orders from immigration when I disclosed it on the immigrant visa application it asked for any document back ups.

Hi, ok assuming that you are not in the states right?, it sounds like you will have to file an I-601 waiver (however, one cannot be sure without knowing how you entered the states, and how many times you crossed or attempted to cross). the form the attorney is talking about probably is a g-28 form, which gives attorney permission to "enter the case and or find out case specifics from uscis and receive notices on your behalf" pretty much. My husband had to do a waiver also, not for dwi but for driving without a license and was also given voluntary departure. with NVC just make sure you have the voluntary departure order from the judge and the sentencing documents for your dwi because they will ask for those at nvc and the interview also. if you want more info on the waive process, you should check out the site immigrate2us.net however for NVC info, this is the best site, it helped me through step by step just read the guides and read them again.

you may want to try to go to the site immigrate2us.net and get some information on waivers and whether you qualify. one of the waiver attorneys that is very well known and very popular with waivers does a free weekly chat on there and some of the other attorneys recommended on the site do free phone/Skype/internet consultations also.

Hi, just call the DMV in California and ask them to confirm. In GA, they do not accept Mexican Drivers License, so I would not risk it if I were you because driving without a valid license can be costly and a headache.

you may want to consult with an attorney just in case. you lied under oath if i am reading correctly. just because you entered with an approved waiver for illegal presence doesnt mean it never happened, it is still on your record which is why it was brought up. my husband entered the us with an approved waiver for unlawful presence and at the airport when he came for the first time, the immigration officer asked him how long he was in the us before, he answered her truthfully and she laughed and said she was glad he told the truth because if he would have lied even after the waiver approval, he would be in problems. they may take it with a grain of salt that you lied, and they may not, but you may want to consult with an attorney.
