  1. Hallo zusammen,

    mich würde interessieren wie lange es bei Euch in etwa nach dem Interview gedauert hat bis Ihr Eure GC erhalten habt? Wir würden gerne den Flug nach dem Interview direkt buchen, deshalb frage ich :)

    Die GC bekommst du erst nach der Einreise in die USA (innerhalb von ca 8 Wochen). Du meinst sicherlich, wann du das Visum bekommst, richtig?

    Hab grad deine Timeline angeklickt und gesehen, dass heute dein Interview war! Gratulation!!! Freut mich sehr für euch, dass es geklappt hat :)

    Dein Visum wird in den nächsten Tagen eintrudeln (Ich war zwar K1, aber approved ist approved - da wird kein großer Unterschied gemacht. Mein Visum war zwei Tage nach dem Interview schon im Briefkasten). Um ehrlich zu sein hatte ich mein Abflugdatum sogar schon vor dem Interview gebucht. Wir waren uns einfach ganz sicher, dass es klappen wird und sind das Risiko eingegangen. Hatte Ende August letzten Jahres mein Interview und bin am 13.September dann geflogen, haben also zwei Wochen Puffer eingebaut gehabt ;)

  2. It says that we have to send our original documents a second time (the first time would be to NVC) They don't mention certified copies.

    For some documents I have only one original and no duplicate is available.

    Does someone have the same experience?

    How did you do?

    Have you done Certified copies?

    and where should I go for certified copies in Germany (less costly as possible and the easiest)?

    Hi quimolum,

    yes, you do have to submit the original documents a second time. The copies DO NOT have to be certified! Just make a copy and put it behind the original. After your interview you will get your originals back (they usually send it in the envelope with your passport & VISA).

    Also, you should make a copy of the complete package for your own records. Just in case something gets lost (which doesn't really happen very often, but you never know).

    Im getting a bit frustrated trying to find out what ro do to obtain certain documents... any of you know how to change/get a u.s. drivers license? Ive read I can only get a drivers license with a ssn. That means I would have to wait until I get yhe gc (worse case another 6 month). Plus the dmv would destroy my foreign license?

    Also I have not applied for ead and ap and been in the u.s. already 6 month..

    It completely depends on the state you're living in.

    But one thing is certain: they will NOT destroy your foreign license - they don't have the right to do that.

    I live in Massachusetts, which is one of the few states that grants Germans (and Swiss) the exception of simply converting your foreign license to a US one.

    Nonetheless I believe you need the SSN everywhere, no matter what state you live in.

    You say you have not applied for EAD or AP. Any specific reasons for that?? But you filed your AOS? When? If you haven't gotten your SSN before applying for AOS you'll have to wait for your Greencard to prove your legal status. Or send the application for EAD in now (with a copy of your AOS NOA1). It's free and you can apply for your SSN as soon as you get your EAD.

    What state do you live in? I found some information about my driver's license on the homepage of the German Embassy.

  4. If you have an interview it's with your field office (probably in the same one you had biometrics taken). No interview means NBC.

    I was wondering the same thing. I know that my file is at Lee's Summit, MO since Dec 6,2013 - I have received neither the Interview Waiver nor an invitation for an interview so far. What does that mean? Is my file in a huge pile rotting away?

    I hate waiting... Although I have my EAD and AP and can basically do whatever I want I just want to have my GC in my hands and be free from USCIS for a little while ;)

  5. I called USCIS customer service a week ago. I've read a few stories about RFEs that weren't received by the applicants and since they couldn't respond to the RFE they never got, their AOS was denied. So I figured I'd call and ask if my status is anything else than what I can see online.

    It's still on Acceptance - since December 6th :(

    The guy said it depends on the local office how long it takes. Boston (my local office) works on cases from July 13 right now. But my case is still in Lee's Summit, MO....

    I have my EAD/AP already since the middle of January, so I can travel and I work. But I'd really like to have my GC soon ;)

  6. Also, ich geb zu, ich weiß da nicht wirklich was darüber. Allerdings erscheint mir das Einreichen zweier Petitionen doch etwas komisch. Ist das nicht so ähnlich als würde ich im Mathe-Test zwei Lösungswege hinschreiben und der Lehrer soll mal entscheiden, welche der beiden richtig ist und mir die bessere Note geben?

    Kann mich da auch täuschen, aber auf die Idee gleichzeitig zwei Petitionen zu stellen wäre ich persönlich jetzt nicht gekommen ;)

    Wünsch euch natürlich dennoch viel Erfolg und hoffe, dass du bald mit deinem Liebsten in USA vereint sein kannst :)

  7. Hallo zusammen,

    ich bin neu hier. Hab mich dazu entschlossen mich mal hier anzumelden um zu schauen, wie lange der ganze nervige Prozess bei anderen Leuten so dauert wink.png. Wir haben I-130 im August eingereicht und I-129 dann im September. Ich hab das Gefühl, dass die Unterlagen die letzten 5-6 Monate beim NBC rumlagen, bis sie dann mal genau am Tag des Ablaufs der Bearbeitungsfrist (vor 2 Tagen) an ein anderes Servie Center weitergeschickt wurden. Ich hab noch keine Ahnung wo genau sie sind, da mein Mann noch keine Hard Copy erhalten hat. Ich hoffe, dass jetzt mal Schwung in die Sache kommt und ich schnell meine NOA2 erhalte. Da sowohl I-130 als auch I-129 weitergeleitet wurden, ist es mir relativ egal, was jetzt zuerst "approved" wird. Ich nehm was kriegen kann lol! So langsam hab ich keine Lust mehr hier nur rumzusitzen, zu warten und nicht zu wissen wie lange es noch dauert. Aber ich denke mal, dass ich damit nicht alleine bin und dass es euch allen hier so, oder so ähnlich, geht.

    Mal kurz zum Klarstellen:

    ihr habt geheiratet und I-130 eingereicht. Einen Monat später hast du dann I-129 (Petition for Nonimmigrant Worker) eingereicht?

    Auf welcher Basis denn? Ich kenn mich jetzt nicht so aus mit dem I-129 ;) Wäre lieb, wenn du des mal eben erklärst :)

    die Frage kam bestimmt schon öfters.

    Mein Mann hat I-130 abgeschickt, wir sind jetzt auf der NVC Stage. Hab mein polizeiliches Führungszeugnis schon beantragt, benötige ich hier für das IV-Package auch ne Übersetzung?

    Nein brauchst du nicht. Das Konsulat in Frankfurt akzeptiert die deutsche Fassung ohne Probleme.

    I did that too!

    File your AOS with EAD and AP right after the marriage and as soon as you have your receipt number call customer service.

    Your reason is "severe financial loss" because you can't possibly accept this job without an EAD which means you lose money.

    Your potential employer has to write you a letter that says that they want to employ you once you have your EAD. Have them put in a date on which they offer you to start.

    After you filed for your expedite you'll get an email with the request to bring proof of the job offer. You fax the letter from your future employer and within 1-.2 weeks your EAD (including AP) will be in the mail.

    Important: you have to have your biometrics done. Usually you can go there on a walk-in basis before your actual appointment but you will need the invitation letter.

    Congrats on the job offer and the upcoming wedding :)

  10. USCIS made some changes (at least when it comes to the embassy in Germany - don't know if they did that for every country so better ask at her country's embassy):

    The medical is only valid for 6 months! The Visa will only be valid as long as your medical is valid. Lets say she had her medical 4 weeks before the interview /approval, then her visa will only be good for 5 more months.

    You have to marry her within 90 days of her arrival. File AOS as soon as you can after that, so that she can start to work soon (I',m telling you, it's tough to just sit around and do nothing). But you don't necessarily have to file within those 90 days.

  11. I have never heard of a case when someone was traveling with AP and wasn't allowed back into the US!

    They're just being precautious with saying that.

    Just think of this: every restaurant may refuse to serve you without any reason. Are you worried about that when you go there? No because usually you get served. But of course there is ALWAYS the 0.0000001 % chance that they say "I don't like your nose. I won't serve you today." It's somewhat likely with the US Border Protection.

    Does that make sense?

    Traveling on the K1 visa to the US is the same thing. It doesn't guarantee entry but have you heard of anyone with a valid K1 visa who wasn't allowed to enter the US?

    Don't worry. He should really go to his grandmother's funeral and don't worry about not getting back into the country. But again, he has to bring his Combo Card (that says "serves as Advance Parole" on the bottom, right?), his marriage certificate and his NOA1 for AOS.

    Stop worrying and start booking the flight.

  12. MrsMayer is correct! You can enter the US on a K1 only once!

    You can file for Advance Parole to be able to reenter the US (You have to file and receive the AP BEFORE you leave the country!). But usually it takes up to 90 days to get the AP. You can only expedite it if you had an emergency and having to attend a wedding isn't considered an emergency at all.

    Your options:

    - travel to the US on your visa AFTER your friend's wedding

    - travel to the US as planned and don't go to your friend's wedding

    - travel to the US, get married, leave the country to attend your friend's wedding and have your spouse file I-130 and wait another 8-12 months for the new visa before you will be able to return to the US (I don't think you wanna do that)

  13. As Hank says it's no problem at all!

    Make sure he brings his Combo Card with him. When he checks in for his flight back he should tell the check-in personnel that he flies with AP (they usually ask on what visa you travel, but he doesn't travel on a visa at all, he travels on AP)

    In addition It wouldn't hurt to carry along the marriage certificate and the receipt that he filed for AOS.

  14. Hi Kisturia. I am also a Dec filer. Sent my AOS Dec 19 and recieved 3 envelopes with I130, I765 and I485 Jan 9,2014 notice of reciept through the National Benefits Center in Missouri. We sent from Phoenix, AZ. I have been out of work since November 2013 and loss of income is a big financial problem right now with 3 young boys and my husband just working its a big burden.

    My biometrics is scheduled for Feb 02. I want to start working soon as I have a job pending. I am from Canada married to US citizen with 3 US born children. I noticed you got your EAD fairly quickly! What steps did you take to get it that fast! Any advice would be so appreciated.

    as someone mentioned before you need to have your biometrics done in order to get your EAD. You can try a walk-in and IF you already have a pending job offer you can mention that to them. Maybe if they're busy and wouldn't take you as a walk-in they would still consider it once they know that you filed (or are about to file) the expedite.

    To file the expedite:

    - Like I said you NEED to have a pending job offer ALREADY! If you apply for a job, you may tell them that it's a matter of 1-2 weeks for you to get the EAD if you could get a letter from them stating that they would employ you. (They could even put a dead line on the letter until when you have to have your EAD in order for them to employ you so that they don't have to commit to their offer for an unknown amount of time)

    - Once you have a job offer call the service hotline and tell them you need to file a service request for an expedite

    - Your reason for the expedite is "severe financial loss" since you would lose money/income if you can't accept the pending job offer that you already have. Make that clear because they're not the smartest people around ;) (After I told the "hotline-guy" for the fourth time that I have a job offer he said "Oh you DO actually have a job offer already?".... No, I was kidding earlier... ugh...)

    - The guy told me I would get a notice (in mail!) within 5 business days and they will request further proof. A day later I got an email (which is WAY better than waiting for mail ;))

    - I had to fax in a copy of their email and the letter from my potential employer.

    - One day later my status changed to Card Production but it still took another week for the card to arrive in mail.

    I hope you can find a job very quickly and good luck in your further process ;)
