  1. Have you sent your paperwork for the expedite request yet? If not, do that quickly!

    I actually don't think they approved of your petition yet, basically because of this:

    "Since the date we received your request, we have approved your case and an approval notice was sent on (insert date notice sent) to the address we have on file."

    They haven't inserted a date!

    When they write a letter they probably just click different buttons, for example "expedite request, but petition already approved" and the program puts the right sentences into the document. Now they only have to fill in the date (since this is different from case to case) and send it out.

    I guess that they clicked that button by accident after clicking the button "Note about putting in paperwork within 20 days". And they haven't realized that and just sent out the letter.

    Sorry, I can't explain it any better right now. Do you know what I mean?

    And since USCIS doesn't know anything about the "approval" and the infopass didn't help I would just assume it hasn't been approved yet. So you should put in the paperwork for the expedite.

    jetzt habe ich doch tatsächlich eben erst von dem regionalen Forum hier gehört :no:

    Ich wollt jetzt mal was fragen. Wie lange dauert es denn so in etwa zwischen dem NOA2 approval und dem Interview in Frankfurt? Wenn man jetzt nicht sonderlich mit dem Versenden der Dokumente rumtrödelt natürlich (ich will die zu dem Zeitpunkt schon alle beisammen haben) :lol:

    Mein Hintergrund ist dieser: leider ist VSC ja momentan recht langsam (ich weiß, CSC ist grad noch schlimmer) und man muss mit ca. 197 Tagen Wartezeit rechnen. Meine Timeline-Berechnung sagt mir, dass es erst so ca. Ende Juni soweit sein wird für NOA2 :(

    Ich hab eine kleine Schwester, die noch schulpflichtig ist und die ich aber sooo gerne bei unserer Hochzeit dabei hätte. Und nur für ein Wochenende nach USA fliegen kann sich meine Familie nicht leisten - sie würden gleich drei Wochen bleiben wollen und bei der Gelegenheit meine (amerikanische) Grandma besuchen. Deswegen wäre es gut, wenn die Hochzeit noch in den (bayerischen) Sommerferien stattfinden könnte. Unser Lieblingsdatum wäre der 24. August. Natürlich planen wir noch nichts Konkretes und sagen auch Verwandten und Freunden, dass NICHTS sicher ist bis ich das Visum in den Händen halte.

    Aber sollte die NOA2 tatsächlich erst Ende Juni rausgehen, wird das mit Ende August doch meeeeehr als nur knapp... Naja, ändern könnte ich es eh nicht, aber ich bin dennoch neugierig: wie lange dauert es denn so im Schnitt von NOA2 bis Interview?

  3. we actually met 10 years ago via mutual friends, but we were just friends back then, then in 06, when i went to haiti on vaca, thats when we fell in love n we've been together since..

    I mean - 6 years of relationship! That's an awful lot of time! I can't believe that their reason was to assume this relationship isn't real. You put pictures in there from the last 6 years, right? Or did he just bring them with him to the interview? Because if you put them in the petition already, how could they even doubt that this is not true love?!

    I assume that it's maybe something else that's not quite right. Maybe the sponsoring wasn't enough for them. I just don't know how you can find that out. But before you go and fight you should find out what the reason for the denial was. Have your fiance scan the letter he got from the CO for you and look at it closely. Is there a number you can call? Google the matter and maybe send us the exact words again.

    I like that you didn't give up and fought for it. And even better: you WON! :dance:

    I have to admit I'm a bit anxious because my fiance is 15 years older than me. We both were never married and neither of us has kids. I just hope that the CO believes that love knows no age boundaries!

    You said you visited your fiance once after the earthquake and he visited you once. How often did you see each other in total during those 6 years? [edit: you already answered that ;)] How did you two get to know each other?

    Try to fight the decision - it's not lost yet! Look at sammdt's story. You can do it, too! It's not fair that they deny two people who love each other to be together for the rest of their lives. And if you lose the fight then marry him in Haiti and file CR-1. It's still better than not having him with you at all.

    In Germany you can go to the medical examination even WITHOUT the case number.

    Try to find out about the regulations for your country. Maybe you should call at the doctor's office and ask them. They should know.

  6. Sorry everyone I am trying to learn how to navigate this site. It's a wee confusing!! It was a I-129F Petition we filed along with all the other stuff..G325 etc. We can't even get out of the gate!! There was nothing missing in our documents!! doesn't say "missing information" ...just "Classification sought" hmmmm

    Alright, since you said you're still learning how to navigate this site I figured I'm gonna send you the link to the K1 Visa Guidelines (in case you haven't found this one yet):

    As others advised: Go through EVERY step ON YOUR OWN once again! Ditch the immigration lawyer - I don't think he knows enough about this whole process (otherwise this shouldn't have happened!) You can totally do it on your own - just be patient and accurate and follow the guidelines. Redo it and if you're not sure about anything ask us. Everybody here is happy to help you! :thumbs:

    In addition to that - it might be totally unnecessary - I'll explain the petition process in detail (since there obviously was some confusion about the petition / visa on your end):

    - First of all your US citizen fiancee has to file the petition "I-129F". Check the link I just posted for whatever has to be in there ("Assembling the I-129F Package: Checklist")

    - After she sent it in (to the Dallas Lockbox), they resend it to the Service Center that is responsible for you from now on. They're cashing your check as well.

    - You'll be sent a Notice of Action (NOA1 - Form I-797C) - They're basically just telling you that they received your package and that they're going to review it. You get a receipt number and you can start tracking the progress on their webpage

    - You either receive a RFE (Request of further evidence) or NOA2 in the next step (approx. 6 months later - or even more at the moment). NOA2 means that they approved of your fiancee's petition and USCIS sends your whole package to NVC who sends it to your consulate who tells you to apply for the K1 visa and send in further documents (That's the start of the VISA PROCESS - Everything that was BEFORE this step is just the petition.)

    - I don't know about the following steps for Canada since it's slightly different from each consulate but you're not there yet - so no need to worry about that right now.

    I hope this helped to clarify this whole process. If you already knew all this then just forget what I wrote ;)

    I wouldn't be too sure about that. The G-325A is used for many applications and petitions. Its purpose is "To provide biographic information on an alien. You file this form only as instructed on another Immigration application or petition." (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=d7c84154d7b3d010VgnVCM10000048f3d6a1RCRD)

    Since you haven't applied for the K1 visa yet you couldn't have submitted it in connection with the application for the K1 visa. Does that make sense? (Please note: I'm NOT sure that "I-129F" is correct either! It's what we put in but this doesn't mean that we're right :P )

    Besides, I can hardly believe that THIS might be the reason for them to send your papers back... They SEE that your fiancee sent it in with the I-129F petition - and they KNOW that this can't be for the visa itself. I doubt that this is the reason. It would be different if you checked "Naturalization" or "Permanent resident"...

    "This form is submitted in connection with an application for:"

    That's what I was thinking of too when I've read all this!

    You should have checked "Other (Specify)" and specify it as "I-129F"

    I really hope you find out why it's been sent back. :idea: It's really weird that they didn't cash the money though...

    Well, or hope for some explanation on February 22nd when your fiancee has the appointment...
