  1. I hope I have this in the correct forum...

    My husbands I-130 petition was sent to the Local office in March, so I set-up an Info-Pass appointment to try and obtain a time-frame for the processing of the applications there. The officer stated that they are currently processing petitions from the end of the year (December). He looked at a file that he had on his desk that was from December and he stated that it appears that those people are starting to send in their evidence requested. He stated that they are sending out NOID's to applicants if there was no evidence submitted, and he asked if I had sent in evidence. I stated that I had and listed a few of the things that I had sent. He asked where we had gotten married and where my husband was from (before he asked for paperwork associated with the case). Anyway, he said that it would probably be another 60-90 days before they get to the January petitions, and that they have been hit by the budget cuts, so that is slowing the processing. I'm hoping for less, but I am prepared for the worst.

    I did the same thing but got some news that was a little better than yours (my file was just placed into the work flow).. that being said if i were you, i would go back in 45 days if you can

  2. Ahh ok. I thought there was some special way to read these graphs and I could not grasp how. :lol: Yes my appointment is about 2 weeks out. So do you think the Dallas office is loaded down?

    i think it is really hard to tell about your local office ... how many people are assigned to adjudicate and how fast they are etc.. i like to see the approvals outpacing the receipts which looks like it is starting to happen at yours.. good luck at your infopass

  3. Stevie, Thank you. Just made an appointment for the end of April. Can you or any member read the chart in this link and explain to me what it says? :lol: Because for some reason I cannot make sense of it. One is a National and one is the Dallas local field office. http://dashboard.uscis.gov/index.cfm?formtype=4&office=60&charttype=2 I am trying to see what month they are working on. :help:

    nope there is no way to find the current month on that dashboard, but it will give you a feeling of how much volume is being processed.

    i was friendly, polite and as funny as possible with my appointment, and the guy there was very forward in offering information.. so like i said, go to the appointment, and if you are like me, i am only waiting two weeks till i schedule another one, knowing the availability is about two weeks out to see them

  4. Stevie, thanks for the info. How and where did you find info on local offices. The tier 2 rep I talked to said she could not find it either. I am in dallas local field office. Maybe you could find it for me or point me in the right direction? Again thanks

  5. we received NOA1 via mail.

    And we noticed an error on the petitioner's name ( addressee name)

    And we plan to call toll free Uscis number tomorrow, any more suggestions?

    i had the same issue, here is what i did to take care of it:

    called and spoke with an IO at the 800 number, you get them live by not pressing anything and tell the cr that answers the phone you need to start a service request to fix an error on your case... you will be transferred to an IO. they will give you a confirmation number

    after 4-6 weeks call back to uscis and find out where your file is located, chances are it went to a local office.

    get an infopass and check on your file

    when you go, bring a letter referencing your case number all errors and your receipt number from the original service request and turn it in to the officer when you are talking to them. i also reccomend the infopass as they can tell you what is going on with your file much more accurately than any those guys at the main office answering the phone... they dont even call the local offices to do a reality check

    good luck, and like the officer told me when i went in, he said dont worry, totally easy to fix

  6. Stevie, What did they tell you at field office? I was not going to make info pass visit but now I will. You are a week in front of me but you are at a different field office right?? How long did it take to get your appointment once you made appointment?? And thank you for putting a positive light on this immigration nightmare.

    basically whoever you call at the 800 number doesnt really know anything that is not listed on the computer. at the local office, they can tell you what is actually going on with your file. i have been unable to view my case online so i went. found out that the case is there and that it was touched on march 28. when i asked him does touch mean it was moved from shelf a to shelf b or does touch mean that it went into the work flow.. he responded it went into the workflow and that i should hear something in less than sixty days. i also have to fix something which he told me i can do by sending a letter attention 130 unit. so i looked around the office and said that sounds like a pretty small unit considering how big your offices are her, so if i send something it is more like "hey phil you got a letter".. he replied yeah something like that. the guy was really nice and encouraged me to come back.

    what i did learn there was: there were 5 people in front of me.. 2 i could not hear, 3 were complaining because they did not receive something in the mail and never saw it updated on their case status online.

    basically my take was: if it is at a local office you have to go there and keep in touch with them. several vj'rs have had bad experiences at local offices, but i think it is more of which individual you are talking to and what side of the bed they woke up on.

    have you looked at the workload of the local office you have ??

    i can clearly see that mine is approving more than they are receiving lately, so it is looking really good for me.. my guess is mid to late may it will get through this stage and off to nvc

  7. Any clue which month application is being processed by USCIS. I am loosing my hope that I would be approved in the next 6 month.

    I filled for my mom 130 during first week of dec 2012. I

    call uscis

    find out where your file is (local office) and when it was transferred there

    make an infopass appointment

    go find out

    i did this and had a very easy experience

    CR-1's are catching up

Well today talked with USCIS and found out that MSC transferred our petition to local Dallas office on March 19th and was told that they are working on September 2012 petitions. :( The tier 2 agent put in an expedite for us but she told us it is up to the local field office and she also thought that it is unlikely that we will get an expedite. Our reason to expedite was because we want a baby. Also talked with a immigration lawyer and he said good luck with trying to jump the line. :hehe:

    go to the local office with an infopass and find out.

    i got the same nonsense on the phone and found something totally different at the local office.. filed feb 5, transferred march 13, put into workflow march 28.. come back in 45 days if you dont hear anything, which of course i will

  9. Aside from legal action, I'm wondering how to contact the director of the USCIS, or someone in the chain in command in charge of the CSC. That person has got to be put under pressure. That repeated non sense of "July 18" is offensive and insulting. Someone has got to be held accountable. It seems that Congress has little power based on many petitioners (including myself) who have contacted Senators and Congressman. DHS (Dept of homeland Security) is part of the executive branch, meaning someone at the White House can do something. From reading these threads on this forum, it's clear to me that law abiding, tax paying Americans are being grossly mistreated and disrespected. Additionally perhaps media attention would get something done. Once the general public becomes aware of the cruel joke also known as the USCIS, maybe the lying bastards there would be compelled to clean up this mess. 60 Minutes anyone??

  10. i put this question to an "Immigration Lawyer" on justanswer and this is his reply.

    do you guys agree or disagree with him. what does it mean "one chance"? wouldn't an RFE be a second chance or couldn't i refile the k1 process all over again with the same person but with more support evidence? the incident happen over 10 years ago and since that time i have been clean.

    you are best off getting a range of responses from immigration attourneys and taking it from there... like i said do you really think anyone here had the same situation as you in the past?

  11. Well, I don't mean to bring any negative memories back to those who were denied at the interview level, but I would like to ask your advice.

    It is my biggest fear that, for whatever reason, my fiancee is denied at the interview. I'm sure I share that fear with many people. If my fiancee is denied, it means I'll need to quit my job in the U.S. and move back to Mongolia, because, among other reasons, I am unable to sit here and wait while her kids, who I love very much, grow up without me around.

    What I would like to do with this thread is compound, as much as possible, reasons people think they might have been denied. What would they have done differently at the interview, what they think the reason they were denied was, etc. Hopefully, people can learn from it and avoid denials.

    Thanks for anything you can teach me.

    EDIT: I should mention before people correct me on the semantics, I mean by denied, not issued a visa at the K-1 interview.

    i totally understand where you are coming from and being that i am on a different path (cr1) feel free to dismiss my comments, but.....

    the main thing you will need to be on the look out for is the fraudulent marriage piece.. and no i am not saying that is you. the way to combat this is by ensuring you are OVERLY documented and your fiancee is able to answer each and every question accurately that they mite ask. read up on all the consular reviews to get an idea of the stupid questions they mite ask in this interview and from what i have seen they are crazy stupid sometimes. you will get much more information going through the consular reviews on vj than anywhere else on the web.

    last problem is the individual doing the interview. each consulate is different as is the individual conducting the interview. a great portion of the success depends on what side of the bed your interviewing officer woke up on.

    last suggestion would be to sort through the vj site for the country specific she will be interviewed at and try to find anyone who has been denied and see about contacting them directly.. even if it was from year or years ago.

  12. Okay, so we're one of the people that got transferred to the National Benefits Center. It's been over a month since we filed, my husband and I are moving soon and the mail in our current area is pretty bad. We can't view our case online as we receive this message: "Your case can not be found at this time in My Case Status. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1.800.375.5283."

    ....I was on the phone for over an hour trying to contact someone to get our case status.

    My question is, how do I contact them? The basic tier 1 representatives can't view the case. I was transferred twice to an "immigration officer", however, they weren't actually "immigration officers???" and transferred me back to the main line. Maybe I'm not pressing the right keys... There's no option in the USCIS menu for customer service reps. I have to press 4 in the main menu to talk to a real person, if I press any other number or ## to skip the menu it just hangs up on me.

    So, this is what I've done so far:

    Call 1.800.375.5283

    Press 1 for English

    Press 1 for case status- it doesn't work and hangs up after I enter my case number

    ==

    Press 1 for English

    Press 4 for support

    >>They can't view it = transfers me

    >>They ask my application(I-130) and just promptly send me back to the Main menu as "They can't help me".

    What now?

    i got through with no problem.. dont press anything and someone will answer speaking spanish.. reply english please :) when you tell them you would like to check up on your case, the cr will not be able to see it either and you will be transferred to an IO. my conversation was very pleasant, nice guy who informed me my file was transferred march 13 to a local office for processing.. now i am off to the infopass appointment tomorrow.

    i would highly reccomend you keep in touch with them monthly since there are plenty of follow ups that are not recieved snail mail and since you can not see your case online.. well you get the rest i am sure.. good luck

  13. I'm an early August filer

    Called today to hear that they processing JUL 18 cases

    The same answer I've been getting from them for more then 4 months, since December 2012

    And they cannot open "service request" because its "within normal processing time"

    Imagine the situation:

    3 years from now,.. they still processing.. JUL 18, which is quite the possibility, considering number of Dream_Act/IllegalChildren applications they giving the priority in the comming months/years

    would it be possible to start a legal action against them? When? After 1 year of waiting? 3 years? 5 years?

    Any lawyers out there? Just curious

    when the term five month "goal" is used, i don't think you have a leg to stand on, it is not a guarentee

  14. My check for the I129f was cashed today. Does that mean I should receive the NOA1 soon? Are there cases where they cash the check and then don't accept the application? I know no one can't guarantee it will be approved, I just don't want them to send my packet back. Sorry, I'm so nervous. My little girl and I really need daddy here to help deal with these medical issues!

    yes NOA1 hard copy should come within two weeks, if you aren't able to check case status don't fret that seems to be a regular thing these days
