I know he was a USC, that was my point if you read my original post
I was simply trying to clarify. You just misspoke when you called him "a man from Canada".
-
actually I have seen many posts and comments here towards the recipients themselves. one just a few days ago by a man from Canada whining that his fiance had to wait because of the "illegals" as he put it from the Dream Act..
here is the link...read about 5 or 6 lines down...this is one of many people I have seen make similar remarks http://www.visajourney.com/forums/topic/420950-is-it-really-worth-it/
Actually that ranter you speak of was a USC (with a Canadian fiancee).

Yeah, it's not legal because you would be lying to CBP upon entry.
He's the deal, my wife did AOS inside the country and it took about six months to get married, get papers together, money, file and get approved. It wasn't very fun for her after 2 months. I don't make an amazing income so she didn't have too much to do, she got really bored waiting. It was nice to have each other, but it is a long time to wait without a lot of income to spend on things/do things.
You will need to look into this, but in Canada, depending on which you file CR-1 or K-1, will depend or which consolate you go to. I think all K-1's are done in Montreal. So basically if you live in Smithers, BC you will need to fly to Montreal for the interview. Which can be a problem for some people and is a pretty big expense considering cost of flights in Canada.
I don't know too much about these processes but you should look into it to figure out if CR-1 or K-1 is easier for you.
I think the easiest would probably be to get married in the USA or Canada, then file CR-1. While you are waiting, you can both work, and since you are not too far away you could likely visit throughout the process as usual.
Just read in to all the things you need before you get started. Is your medical okay? Criminal history? Does USC spouse make enough money or will a co-sponsor be needed? Do you have your birth certificate with both parents listed on it?
Research and find the best option for both of you. Good Luck.
K1s are done at Vancouver Consulate, as well.

You're moving quickly since NOA2, good for you! I think Packet 4 contains instructions for booking interview and how to pay fee, doesn't it? (I think I read this somewhere, but can't remember where--I'm curious, myself)

Yes, NikiR, definitely a larger burden for the beneficiary. My USC fiance's life goes on pretty much as before (except he misses me). For me, on the other hand, the upheaval is complete, and the unexpected delay in obtaining the visa is a large part of the reason I find myself in my present situation--living in rural BC where I know exactly no one; unable to work; and about to become homeless in a few weeks. I plan to move to Vancouver and sponge off friends until I get my visa or they grow to hate me, whichever comes first. I have trepidations about the future in the U.S. but at this point, I'd just like to get at it. Life in limbo is no fun.

I read somewhere in the forum here that K3 visa is discontinued and why so?
you should start a new topic to get this answered.

Well, OP. I see your fiancee is Canadian, so maybe that's an option. (Great healthcare, but those winter temps will be a shocker after Miami!)

k, think I got it figured out.I'm in Canada, so it must be the exchange rate! (US5.5 = CAN6.6)

Hmmmm, on Chrome, selecting K3/K4, I get this:
On IE, selecting K3/K4, I get this:
On both selecting K1/K2, I get this:
Looks like a poor website/browser issue to me.
So which is the real one?
Crazy! On Chrome, I STILL get the same numbers as before: 5 months, 10.2 months, and 6.6 for CSC as of Dec 31st 2012. Whatevs! Guess the important point is that the freakin' NOA2 is still nowhere to be seen.
Your fee dollars at work!
-
I think i found the problem...
While signed in to my account it says 6,6 months for CSC and then i tried it after i signed out and it says 5,5 months...Why cant they update it the right way, so that everyone can see the same thing?
I get 6.6 months for CSC whether signed in or not.
-
Hmmmm, what browser are you using?
firefox
-
Thanks for replying, guys, but no, what I see is for K1/K2 and is saying 6.6 months for CSC.
-
When I go to my My Case Status page on USCIS, there is a place to look at processing times from there. The numbers are different from the processing times accessed from USCIS home page. July 18th is not mentioned. Instead it says (for 129F) 6.6 months for CSC, 10.2 months for USCIS National Average, and 5 months for USCIS National Goal, all of these as of Dec 31st 2012. Thoughts?
-
They were processing cases from July 18th as of January 31st 2013 (it says so at the top of the chart on USCIS site). Since then, they've processed later ones, but that won't be reflected on the USCIS site until later updates.
-
Yes, do your taxes.
-
Although, to be fair to the OP, I don't think he misunderstood...I do think the phone agent told him that, because I just called and was informed "since they are on July 18th, in 26 days you can call back and we will file a service request". I just said " OK, thanks"
They are just lying to get you off the phone.
This is one of the things that peeves me the most...the blatant misinformation they spew. Our fee dollars at work.
diabolical.
-
Yes, I'm afraid you misunderstood, OP. If (a HUGE if) and when the processing date moves up 16 days, THEN you will be outside the normal processing times and can, theoretically, file a service request at that time, NOT 16 days from NOW.
-
so roughly what's the waiting time between NOA2 and interview?
it varies greatly from embassy to embassy. You could look at timelines of people who went through your embassy recently to get an idea, maybe.
-
'k so you know all about the RI and the possibility of having to make your car US compliant, and all that, then, I guess.
-
Before you do, make sure you know the cost of importing your car. It's pretty expensive, I think.

-
Excellent!

He won't have to wait a year to work. After you're married, he will apply for the EAD (employment authorization doc) along with his AOS (adjustment of status--towards green card), and the EAD will take about 3 months--maybe a little less. He'll have to stay in the US while waiting for the EAD, though.

This isn’t true. You don’t need a SSN to open a US account.
OP: You can open a US TD Bank Account and/or an RBC USA account from Canada. TD you can do over the phone and RBC at your local Canadian Branch.
Both banks give you the ability to just transfer the money across the border either way.
You’ll want to leave at least one Canadian account open for your government refunds and/or EI payments.
Good to know. I was not aware RBC had this option. thanks!

'k, I regret that I don't have any kind of answer for your question here--just wanted to take this opportunity to say, "and don't call me 'Shirley'".
