Hello. Just thought I would let you know that I found out the supervisor reviewed my case today regarding the foreign income and AOS package. Unfortunately they decided it was still not complete. After some major reviewing of my files and my taxes, I figured out that I did not include the FormFEC - Foreign Employer Compensation and Pensions. The website I used to do my taxes was taxact.com and this form was not included in the print outs, but was hidden within the other questions. Just thought I would let you know, since doing taxes with foreign income is kind of confusing and I'm not sure if you included this sheet with your AOS package. If not that may be the problem!
So you earned a foreign income and submitted that with your AOS packet?
My husband has been at uni for 4 years and only just got back to the states and has a job there now but no IRS or tax documents for the last 3 years obviously. He earned a little in the UK during that time but we didn't submit any US tax returns a)we didn't know he needed too and b) it really wasn't a lot of money, maybe $10,000 per year.
My question is should we just write a letter saying he was out of the country and include something from the tax website saying he didn't need to submit tax forms as he wasn't earning, or should we try to submit the UK tax forms and have that hasstle? Seems like its more trouble than its worth? His dad is a co sponsor and earns well above the poverty line anyway.

Also, for the I-864: my husband was at university the last 4 years and only got back to the states January of this year, so has no tax transcripts or IRS things. What should we do? He worked for a while in the UK, but we are not sure if we should submit that information because he did not file US taxes at that time as he wasn't earning much and we didn't think he needed to
Anyone else been in this situation? What should we submit? Thanks

Is it the general consensus to use the old I-864 forms until June 23rd, because the NVC doesn't know how to process the new ones?
Is this just the I-864form or also the I-864a form?
Please could someone give me a link to the old I-864 and I-864a forms, I want my husband to send those in. We don't have an NVc number yet but hopefully we will be able to send in our AOS packet before June 23rd

My husband sent the old version of I-864EZ. I hadn't even realised that there is a new form available until I checked the NVC website just now - luckily they state that old forms are still accepted.
You are even luckier, because they have not even started processing the new I-864 forms at all! People have been waiting a month, the NVc has no idea how to process the new forms

They sent me an mail that i had to bring my co sponsor affidavit of support to the interview Because mines was not sufficient, the problem is since i knew it was not going to be sufficient i was proactive and sent my Co Sponsor one, now until they dont review that no interview, poor me
So when you sent in your AOS packet, you knew you would be below the poverty guidelines so you sent I. The I-864a co sponsor form at the same time?
Or did you send them in at different times, is this why you are delayed?
Also did you send in the old I-864 form and the old I-864a form?

My husband phoned this morning and the woman told him that they were processing the new forms, and no longer processing the old ones. I smell a rat! He is going to ring again tonight to speak to someone else. I really wish they would stop lying to us, why are we all being told different stories?
Anyone else heard anything new?
I'm still waiting on an NVC number, but I want to get all my ducks in a row with all the forms etc.
If we send in our AOS packet before June 23rd, would it be better to send the OLD I-864 form?
Is there an old I-864a form, or does this just affect the I-864 forms?

Yeah I got a hold of the Congressman office yesterday and asked who was in charge of immigration issues, got hie email and sent him everything. Right Now I am also Submitting a request to my Senator got the privacy form from her website and sending a complete package via fax an mail.
That's fantastic!! The more the merrier and the way I see it, these offices are there to help us get these immigration issues sorted, and also the more pressure put on the RUBBISH systems currently in place at the USCIS and the NVC that are causing these backlogs and delays, the better! Perhaps if we put enough pressure on them they will finally start to get things right!
Paying $420 EACH for an I-130 and waiting 3/6/9/12 months for it is just insane!!

I emailed the congressman office yesterday, they sent me a privacy letter to sign, sent it along with a brief but detailed letter. I'll let you guys know what happens.
Yes, they made my husband sign the privacy release too, that's good now they can inquire on your behalf, I really hope it helps you
The woman in our senators office helping our case is wonderful, very happy to help and also makes notes in her diary for a few weeks ahead to contact the USCUS/field office/ NVC on our behalf to follow up, which is great that we don't need to keep chasing it

Hi .. How exactly do I find out who/ how to get in touch with my senators office, Houston is husbands local office. We got NOA1 on 11th Feb and NOA2 on Apr 8th but NVC still hasn't received the case and USCIS has really not been very helpful. I really want to try and get things moving because its just ridiculousness for them to be keeping files for weeks/months after they've been approved !
I agree, it is totally just ridiculous!! I'm so sorry but I'm not sure how to find out who is your local senator, I think it would depend on where your husband actually lives, not where his local office is. My husbands father found the info for us. I would advise that you get your husband to phone an immigration lawyer in his area and ask for that information from them? That seems to be something they should know and would be happy to pass on that information to you! That may have even been where my husbands dad got the info from in the first place!
If that doesn't work perhaps find the local mayor where your husband lives and ask him?

Hi All I filled on february for Wife and 2 daughters, priority date is 02/01/2013, Got NOA2 approving on 04/17/2013 , been calling the NVC for the last 2 weeks, and sent the email to nvcresearch on day 15th as advised by the NVC rep 4 days ago.
Today I called USCIS and they transferred to an Immigration officer, after 1 Hour and 36 Minutes on HOLD a super rude agent picked up, he asked for my address, name and DOB and said my files were still with the officer in charge of the case, haven't even left USCIS. I told him what was the delay that the note I received almost a month ago clearly said "Petition approved and forwarded to the NVC" all he said was that it can take up to 4 months to leave USCIS even if i receive that letter and that all i could do was wait and almost hung up on me.
It's ridiculous that a petition approved a month ago is still sitting on a desk and all they have to say is wait and that there is nothing they can do.
How can I proceed anything I can do?

I would very strongly advise that you get in contact with your senators office. Ask them to enquire on your behalf and explain the issues you have been having so far, they will be happy to help you. We asked at our senators office when our I-130 was taking much longer than those with the exact same time lines(sent in feb, moved to Philadelphia etc) and I asked my husband to contact them because I was concerned that they're may have been an issue with our application.
There was no issue, but it was just approved on Tuesday. The woman in the senators office said that if we haven't received our NVC case number within 3 weeks we should contact her to follow it up.
I hope that doing this will help you to achieve some clarity and possibly some swiftness in your case!

We have been so blessed! Our senators office has been tracking the application for us, and even though they can't 'help' in any way, I'm sure it did help!!
We were transferred after about 1.5 months to the Philadelphia field office, and got our approval today off to the NVC, and it's about to get a whole lot more complicated!!!!

I'm currently waiting for my I-130 to be approved and I was hoping I could ask you some questions please? Your case is quite similar to mine because of your location in the US
My local field office is Philadelphia like yours, so I was wondering if your I-130 was sent to the Philadelphia field office? Or did it remain at the NBC? Also, did you receive an MSC code for your NOA1?
If I can confirm what you say on your profile, your husband lives in Philadelphia and you live in Romania, and you were married in January in Romania?
We're the any special circumstances for your case that allowed you to ask for an expedite?
I am living in the UK, my husband is in York, PA and our local field office is Philly. I've been waiting over 3 months now for my NOA2 and I'm just trying to find some rhyme of reason for this whole process, it's so frustrating!

We contacted our senator to find out where the visa is and we're told that it was sent to Philadelphia. No note on my online account, it still says it was last touched 8 feb, same day it got to the nbc. I've seen the stats for Philly, I think they have over 3000, but can't find a group for Philly filers, so I figured I'd ask here. Does anyone know what month Philly I currently processing?

Should I be concerned that every number next to mine has been approved, and yet when I check online mine STILL hasn't been touched since Febuary 8th? I'm MSCXXXXXXX55 and 53,54,56,57,58 have ALL been approved?!?! Aren't we all in the same queue?!?!?!?!

Firstly, I have followed your story since joining Visa Journey and I am really sorry about the massive screw up that happened with your application. I can't even begin to imagine how terrible that must have been for you and your family.
Whilst I agree with you that walking in someone else's shoes really does give you a different perspective about the process, my point remains the same. DCF was eradicated and whilst that is a shame for those who could have used that process to get a quicker approval, the situation now is that we all get to go to the same place. And because of that, we should all be in the same queue. I'm sure everyone on VisaJourney can join in with their own personal horror story that is applying for a green card and the reasons behind it, and I'm sure they will all be as sad as the next, so that actually shouldn't come into the equation. Whilst clearly displayed from your case that visas that are sent from abroad should stay at the NBC, I do not see a reason that they should be pushed to the front of the queue simply because DCF was removed. That process no longer exists and so everyone should be sitting in the same line, with their stories of how they got there, and we should all be processed in an orderly and fair fashion, without the USCIS making allowances for people loving abroad simply because they are, and because DCF was removed.
We all want our visas to be approved quickly, I don't think you will find one person who doesn't mind waiting for ages, and having others pushed to the front of the queue because they live together abroad and because DCF no longer exists is incredibly frustrating. My visa was sent in at the same time as the two on here who have been approved already, and mine has not even been touched yet. I'm really not angry at each individual case, everyone deserved happiness, I'm just so angry at the flawed system as a whole.

AshleyLCBaker, whilst I do agree with your number2 point, my husband and I have been together for four years and have proof(bank accounts, leases etc) of a bonafide relationship up until the month before we got married, even though our marriage hasn't been very long. And having a child doesn't seem to sway the auto-expedite as many of the other who have received an auto-expedite on here have not yet had children. My husband was a university student in the UK which is where we met and have been living together ever since, until they told him he couldn't return from our honeymoon because the visa laws had changed suddenly (despite our research on the contrary) to the tune that I had to have almost $90,000 in the bank to be able to "prove" I could support him, even though a couple of months earlier when we had done the research this was not the case. Unfortunately this change was not publicised until after it was in effect, or we would have done just what you did Pw3T, to try to make the application easier. The fact remains that I could not return home from my honeymoon with my husband, all my belongings have been shipped to the US and I am now living with my sister and her husband till I can finally live with my own husband.
I provided more than enough proof of a bonafide relationship, but the fact remains that those living together abroad get put into a separate queue from the rest of us, and that is what I object to. Having read on this website a detailed rundown of how these visa's get issued by someone who used to work in one of the USCIS offices, I know it only takes around 15 minutes to process a normal case, which I believe you and I both have. The waiting time is simply where we are in the queue. Point is, that those living abroad with their spouse get put into a different and much shorter queue than the rest of us from the offset and that is what upsets me, this should not be the case at all, even if it is only a small percentage as it is still a percentage that has been "bumped up the queue" so to speak.
I am so terribly sorry to hear about your mothers passing, and please accept my sincerest condolences for you and your family. My parents currently live in Zambia and whilst they are not ill thankfully it is also very hard to have them so very far away.

Even though this is going to sound like a rants(because it is) please do not take any offence those of you who have received or will probably get an auto expedite because of living abroad with your spouse. I know it's not your choice and really, getting your NOA2 quickly is a joy anyone should be happy about but I'm starting to get really pissed off at this system. Why on earth should those people abroad applying for an I-130 get processed quicker than the rest of us because their spouse is living with them outside the US? It is so totally unfair!! All the rest of us are separated from the ones we love for months and months waiting for the NOA2 to arrive and those people lucky enough to still be living with their loved ones get their approved quicker?! It is just so unfair! Ours should be processed quicker, not theirs, they are not the ones desperate to see their brand new husband after months of separation because they cannot afford the airfare for a quick trip, they get to see each other every day! Why do they get auto expedited?!
Sorry, I know it's not you all personally so please do not take this as a personal attack and attack me for it, I'm just so fed up with reading comments here and on the January and December filers boards (who I stalk) of all these bloody auto-expedite cases when the USC and the beneficiary are still living with one another!!!! It's so unfair!! :'(

Hi everyone =) I know the thought of not even having your case show up online must be very stressful, I have the 'Initial Review' and even that is stressng me out, so I cannot begin to imagine how stressed you must feel.
I have been reading on the forums that even if your case status isnt showing up online you can still sign up to recieve email/text updates about your case, and these will be sent to you when your case is 'touched' 'transferred' etc etc etc

sign up using your MSC (etc) code and once signed up look for the 'email alert on' and 'text alert on', and clisk one or both of those =)
I hope that helps ease a little of your worries! I havent yet recieved any email updates but at least I do have 'Initial Review' =)

I'm a little concerned about the I-864a form also because this is what is listed on the USCIS website about it:

The new I-864 was also issued ion the same day.
If they accept old versions do you think it's better to send an old one, incase they are having the same issue?
Does anyone els heave an older version of the I-864a form they can send me?
