Are you serious? Did you read the actual first post by the OP? This has nothing to do with getting to the US and then wanting to immediately leave and not wanting to wait for AP. AP will NOT help the OP's situation.
There is no written documentation on how long one can be out of the country with AP. It is a temporary document that allows you to be able to leave the US and re-enter by being paroled back in, while you are waiting for your permanent residency(green card) to be approved. The EAD/AP combo card is valid for one year after approval. If you have not received your green card yet before it expires, then you can renew it. Sometimes people do have to wait over a year for their green card approval.
The person getting a job abroad is the US citizen spouse. He DID have a job in the US. He is being transferred to Asia. Again, did you read the actual post? This was not planned. They did not know they would be leaving the US. They planned the K-1 and getting married in the US with the current knowledge they had, that they would be living together in the US. His employer is transferring him overseas, and therefore his new wife would want to go live with him wherever he is. She does not have time to file for AOS, have her green card approved and then file for a re-entry permit because she will be out of the country too long to maintain her permanent residency.
Yep, read it. Nope, wasn't alking about the OP. In General, I've seen a lot of people get to U.S. and then need or want to leave right away... Everything you said is stating the obvious. Maybe he should let his boss know he can't take the job because it inteferes with his wife's aos. Is his job more important than his wife?

Actually another member said that the AP expires after six months. Where are you getting your information that it does not expire?
Maybe he should get a job in the USA. Why do people get to the USA and then almost immedately say they need to leave for such in such reason but don't want to wait for AP....
-
well after six months ap will expire and she can go back.
-
well alright then, they got their answer.

I find this conversation interesting.
I guess some people can't care less about the USA, just want to be a citizen for convenience and all the oath ceremony "show" is an annoying step they would love to skip, much less willing to swear to defend the country if needed, etc..
For other people that still see this country as the land of opportunity, freedom, etc.. perhaps came escaping persecution or war in their countries, to become a citizen is very emotional and they look forward each and every part of the journey, including the end with the songs, the flags, etc..
To each its own, but to me it looks a bit "fake" to want to be citizen, and then find annoying that they have to go through the Oath ceremony, nobody is forcing anyone to be citizen it is your choice, your GC is good enough, so if no ready to do what is required then why going through the hassle?
FYI the same day ceremonies, like mine was, includes the speeches, the videos, the singing, etc... in my group of around 40/50 people there was no flag waiving, but some were crying and visibly emotional. It lasted about 40 minutes or so. I understand that when the ceremonies are schedule for thousands, go much longer (obviously) and can have more added "for show", as news cover them at times.
I imagine some of you won't like my post, sorry.... but when I started my journey and it was not an easy one, I knew what it would entail and I was OK with it, no "tailoring to my preferences" needed.
Government tailors to no one.

Thanks for the links, and for the information.
I didn't know that it was allowed to have a joint interview in Moscow -- that's interesting! It would be expensive to fly there, but I will consider it. =) Is it frowned upon if I am not there -- as in, do the chances of approval decrease if I am not there?
Also I saw you had an RFE on your timeline -- if you don't mind me asking, what was it for? =)
Good luck on your interview! =)
~ Samantha
The RFE was for failing to submit a G325a for myself. I did one for my fiance but forgot about myself. It was an easy fix and not a lot of time wasted. But still, don't forget anything!
I've heard some people say its the better deal to be present with your fiance at their interview. I personally feel the same. I also would even suggest you consider living with him in Russia for awhile. It just looks good for the consulate--words from a consulate. I've been living with my fiance for five months and probably will be a nother month or so before we leave for U.S. (if he is approved!) I, and I'm sure others will agree, highly recommend you go with you fiance at least. As I've said before, this process is not cheap.

K1 all the way

I heard 1050 but everyone else says 1070 so go with that. If its wrong, its not like you're overpaying much.
-
It doesn't matter if i130s are back logged now, there is no point getting AP, getting a green card and then moving. You cannot live outside the US for more than 6 months, she will have to forfeit her green card.
Or renew....?

Hi Everyone,
My fiancee is in Russia, and I am in the U.S. I finally received NOA1 and our application is being processed at the Texas Center. I am aware that I have to wait for NOA2, but is there any documentation I should be getting ready while waiting for NOA2?
Also he should be preparing his documentation for the interview in Moscow while we wait, right? Are there any documents he needs that take longer to receive in Russia than others -- as in, is there anything he should be prioritizing working on right now?
We are both upset that he has to fly all the way to Moscow to do the interview and the medical, and I still don't fully understand how that part of this works (how the appointments will be set up, etc.) so we want to be fully prepared for that time.
I know there is a lot of information already on this site, and I have been looking at it, but it helps me to receive fresh info, hear new stories, etc. so thank you very much for your help! =) If anyone else reads this who had a fiancee in Russia (or is waiting on one) like me, I'd be happy to hear from you, too, just for support, etc. =)
~ Samantha
Congrats, first off! Follow the links I gave above. They will give you the info you need to know.
I understand about being upset about having to fly to Moscow for interview and medical. He should fly two days before his interview, get medical done, wait a day for results if not given right away, and rest, and on the third day, have his interview. That is what My fiance and I are doing. This process is not cheap so get used to that. My fiance and I are going together into his interview and I suggest you do the same. Its allowed in the Moscow embassy.
Glad to help and support!

My fiance and I will get married this Saturday (1-4-14). This morning at work he received a call that he will be transferred in Asia to manage their showroom that may take more than 2 years. He might leave the country in 3-4 months from now. We don't know what to do, I want to go with him. Do I need to file AOS/EAD/AP or we need to file I-130 for spouse visa so I can return here in the US?
Thank you.
Get AP. It takes two to three months to be approved. He can leave before you if he has to, and you will wait not that long before you get your AP and you can go to him.
I think I-130s are backlogged and if that's true, I wouldn't go that route.

Now this is really funny stuff. You cant write two or three letters correctly? Practice, practice, practice and roll your eyes while you do it which should make you feel good again. LOL
I'm glad you are humored. It simply looks more professional when it is either ALL typed or ALL handwritten, not a little of this or a little of that--filling out the I-134 isn't your Grandma's scratch recipe for Tom Yam Goong. Anyway, if you could read or at least, pay attention to earlier posts, you would know that I have already resolved this issue. I simply typed VG since that is the abbreviation for Volgograd.
Mods, this topic can be closed.

My roommate came to this country unlawfully from El Salvador many years ago but has been granted tempororary status thanks to Obama's DACA program. Despite this she is in immigration proceedings due to her chronic non-filing of necessary paperwork and due to the fact that she has been arrested several times for driving without a driver's license and insurance. In order to get out of this she is about to marry her US citizen ex-husband, even though she does not love him anymore, lives separately from him, and has told me many times that this is just for immigration. Should I report her?
On the one hand anyone who knows me will know I am vehemently opposed to illegal immigration (my wife's I-130 is "in processing" right now and nothing ticks me off more than seeing people didn't follow the rules get everything we're fighting so hard for), but on the other hand she has kids and even grandkids here (long story, she's not that old, but her 17 year old son already has two kids out of wedlock). I really want to report her, but I am afraid I will feel guilty. What should I do?
You say she drives without license and insurance. In the State of Virginia (Which I'm assuming that is where you are), it is a criminal offense to drive without a license. Explained here: http://vincenzeslaw.com/fairfax-traffic-lawyer-fairfax-county-reckless-driving/driving-without-a-license-in-virginia/ So, what you need to do to gather information to report her is, a criminal record. Fill this out: https://apps.vsp.virginia.gov/catspublic/public/publicHome.html It costs $15.00 to send it. Here is the full website where I found the form so that you can check it out for yourself: http://www.vsp.state.va.us/CJIS_Criminal_Record_Check.shtm Driving without insurance is not a criminal offense, but it certainly puts others at risk when one drives without insurance. I would write a statement that you know for a fact she does not have insurance when she drives. Get it notiorized.
Don't lie, bend the truth or purposefully cause something to happen that would help your report. Just report the facts you know. When they see you have gathered her criminal record...which might contain more than driving without a license (even better!), then I believe you will have a good start. Like many have said, this can take awhile. I've never reported someone who is illegal. But I have used other auxilaries and it always takes awhile to build any type of case.
I also mentioned before that it might not be possible for her and her ex to remarry because they would need a new certified marriage license and some states do not issue them unless you are living and have been living for a while with your intended spouse. I went ahead and quickly looked it up, but since every country clerk office has different rules, it might not be correct. I looked it up for Arlington county. It does not appear that they have that rule, however, it does say that if you were married before and now divorced, you must show the divorce decree. Also, you need some kind of identification like a license (which she does not have) or valid passport... You can show that her benefits are about to expire and show the date on their marriage license and the fact that they were divorced and now remarrying. It'll deffinately look like she is only remarrying SO QUICKLY because she wants to stay in the USA. Also, the license must be used within 60 days of the issue date, or it will become expired and useless to her. And if they do get a clergy to perform the ceremony to concrete their license, there is still a way to prove the marriage and license is invalid. If the clergy does not have an active congregation, then it is illegal for him to perform the marriage and if he does, then its basically like asking Grandma to do it because its invalid. The clergy has to have proof of his active congregation and Certificate of Ordination and identification. If not, again, its invalid.
Can you show proof that she IS or will MOST DEFFINATELY become a public charge?
I also have a few questions for you, as I've contemplated your situation for the past 48hrs. I'm wondering why she would tell you, almost consol you, that this remarriage is only for gaining benefits, not because she loves him. I do not mean to assume or even remotely accuse you of having any relation with this woman other than, she is your roommate. However, it seems odd that she would tell you that, knowing you could and even most likely would, report her.
Then I think, what if she only told you because 1. She thought you would feel sorry for her because you know she has kids/grandkids. 2. She was drunk or high 3. You are a trusted friend of hers and she truly would never expect you to report her.
I don't mean to step over the line: I only contemplate situations thoroughly. I do hope everything I have suggest for you to do, actually helps you to report her. No matter what is going on with you, her, her family, SHE IS ILLEGALLY ABIDING IN THE UNITED STATES OF AMERICA. Please, report her.
Oh and I also would be careful about *tape recording* her, because that could be considered illegal...reference this link: http://www.dmlp.org/book/export/html/1246 There is a section specified for Virginia's wiretapping laws. Scroll....
Just want to make sure that you gather the correct evidence, the correct way.
-
What physical proof could I possibly get, besides tape recording her? She said they might not move back in together, that seems proof enough.
Some county clerks will not issue a certified marriage license unless you are living together. Doesn't she need the marriage license in order to keep getting benefits?
-
https://arcc.sdcounty.ca.gov/Pages/marriage-licenses.aspx Certified copies in one week. I don't know your county though and it might be different news for your county clerk office.

no need to be rude by rolling eyes
about sponsor i assumed but forgot to put, so chill...again as i said read in K-1 general forum there were million answers for people unemployed and with a co-sponsor.
good luck and hope u will be more picky with experssing urself when people post trying to help u, i am not offended but surprised with the ¨rolled eyes part¨ all the best with warmest wishes
I'm chill.
I didn't mean that towards you. I was just rolling my eyes in exhaustion. Sorry though, for it did seem like I was rolling my eyes at your answer.
As I did explain, I can't expect everyone to know the details of my situation, that I already have a co-sponsor/so forth...
Do you know exact links to these topics I can reference?
-
hi, are you above the poverty line? i recommend to ask this question not in RUB forum but in general, people there will be able to answer this specific question ( i mean there were already similar questions from people that are in the same situation as u ), my opinion is this: if you are currently unemployed and u sponsor ur K-1, what kind of docs u submit as a prove of income?
before putting something in ur form, i recomend to first see what docs u add for financial support....just to be on a safe side and not commit a mistake.
Kinda rolled my eyes with this one but I can't expect everyone to know my situation. With that said, I have a sponsor. There is nothing more that I need to say. I asked a question and hopefully it will be answered soon so I can continue to fill out my form. So can anyone tell me what I should do?
-
Ah and another question as I am unemployed, I was going to put "Unemployed, reference attachment" and then just attach a paper explaining that I've been living in Russia the past five months without a work permit so I have not had employment. What do you guys think? Should I do that or should I just put "Unemployed" without an explaination. I will be attending the interview with my fiance so if they have questions when they read it, they can ask me directly.

I doubt they will care if it is all printed or all hand written. I am at work so I couldn't open the link but I think I found a site that says the abbreviation for Volgograd is VG. VOG is for their airport.
Check this site and see what it says.
Thank you.
-
I doubt there is an official 2 letter abbreviation for Volgograd.. Why not have someone with better hand writing fill out the form with you then sign it?
Or make an amendment page directing that question number to a separate page and type Volgograd as the answer?
Nah. Do you think I could leave that blank and then print it out and simply write in "VOG" or does it all have to be printed or typed, not printed and typed? Maybe I'll just practice writing it and then go with the best looking copy.

Sometimes VJ members are helpful. This is not one of those times. VG is the abbreviation for Volgograd and I will be typing that in my I-134. I will also bring a copy that is left blank. Since I cannot get a straight and correct answer from anyone, this is what I will have to do. No problem. Thanks.
