BOS_LHR reacted to Ebunoluwa in denied visa now trying to appeal
This applies to spousal visas not K1's. K1's will be purposely put on the track for expiration. Period.
Re apply or marry and file a CR1 and address the 'relatives' issue appropriately.
The burden of proof will be on you. Get creative with the evidence. Those are your only options.
It can't be that difficult to proof that you aren't related.

I-129Fs are left to expire.
I-130s are reviewed and NOIDs are issued, with a chance to rebut.

Yeah, absolutely. My response was because OP put "a tourist" in quotations like that... I read that as insinuating there would be some premeditated plan to adjust rather than legitimately entering as a tourist. Plenty of people adjust status in the US for completely legal, valid reasons -- like people on student visas who fall in love and marry USCs, or in your case when the decision to stay together was made after entering the country.
But yeah, I thought that was a crummy question to ask during interview. What a punch in the gut.

That's fraudulent use of a tourist visa, although it happens. It's easy enough to lie and say you'll be going home and then just never do it, but that's directly against what that AOS option was designed for. Some people are denied entry to the US on tourist visas because they have so many possessions with them that it looks like they're moving. If you were to turn up on a tourist visa and tell customs you had no intention of going home, they'd put you on a return flight straight away. Lying about your intent is a misrep that can get you deported and banned from the US.
It's also worth noting that the legal AOS option is available to comparatively few people, because you need to be part of the VWP or have a valid tourist visa to get to the US in the first place. Applying for a tourist visa during IV processing is difficult in part because it opens up this loophole and the government doesn't want it abused.

GUYS!!!!! We finally got the application for a social security number through!! :joy:
Quick recap: POE was July 2 but no SSN arrived in the mail. We went to an office to apply and discovered my husband's name was entered incorrectly, which prevented him from applying. 1 horrific visit to USCIS, 4 chats with CBP, and 3 trips to SSA later, IT'S DONE! We're relieved beyond words. So much time, energy, and anguish went into fixing this issue... now on to figuring out why the green card hasn't arrived. But still, in the meantime,
Congrats and welcome home!!

Seriously guys, it's worth it now more than ever. With 60 day review times, an extra read through the requirements to give yourself a sanity check is a very worthwhile use of time

Assuming you're talking about documents for AOS and IV packets, you don't have the option to send them by email -- that's only for a very few specific countries. Postal mail is the way to go

NVC issues a "checklist" when you've made a mistake, whether by omitting something or by entering it incorrectly. They ask that you resubmit the documents with corrections made according to their instructions, and right now, that'll set you back a month or two. Leaving that address field blank is something they very unfairly consider a mistake, so don't let them trip you up

If you qualify for the EZ go ahead and use it. It's shorter and simpler -- no fields for multiple beneficiaries, use of assets, etc. Only thing to watch out for is to not leave the second address field blank. The instructions say to do so, but you'll get checklisted if you do, and NVC will not remove the checklist.

They're only closed on federal holidays. The next one is September 1 for Labor Day

They give you a receipt, I believe, when you file the paperwork. You are supposed to keep that on you incase the GC expires before you're issued a new one.

Funny how times change! I visited a Revolutionary War fort this weekend and the tour guide showed us George Washington's banner, saying it flew outside wherever Washington was. It was considered very rude to shoot an officer, so flying a flag to announce his presence was perfectly safe. The good old days

BOS_LHR got a reaction from J_d_Petitioner in Passport type photos for IV package
I put the photos in a snack sized Ziploc bag. I stapled the bag to a blank sheet of paper (just one side of the bag so it could still be opened) and wrote beneficiary name, DOB, case number and item description on the paper.

Sometimes things are outta ur control. I already mentioned I m the beneficiary and my husband wasn't believing the fact that tax returns can't be sent alone. I got to the point where I got tired of arguing and said that fine send whatever u want. That's the reason I have been so anxious all these 45 days because I know what's coming. I realized the second he sent as well that he screwed it up but I couldn't do anything about it. U have everything in ur hands ur case in different.

bdrew was initially declined for an earlier interview date at London, but she and her husband kept on the embassy and eventually the date was moved up after their MP intervened on their behalf. Might check with her exactly what they did Best of luck!
