Good luck to you. Take every possible evidence you can gather. I would also contact your senators just before interview and let them contact US Embassy on your behalf. That might be a great help at this particular embassy.

Every country is different. Phillipine is one of the easier embassy to get approved. Even in high visa fraud countries not everyone gets denied. All these years I am following visa journey website, Philippine has one of the the best approval rate among all embassies. Cambodia is a different story among with few others such as Ghana, Nigeria and few others.

Malaysia is not on a high fraud visa list. Every country is difference. Cambodia, Ghana, Nigeria on top of the list on K-1 visa denials. Specially with one visit. It doesn't mean everyone gets denied there either. But denial rate is very high on those countries.

CO let me stand with my wife the whole time on our first interview (K-1). He asked me almost every questions. Not a single question raised any concerns or alerts. I thought it was a great successful interview. But I was wrong at the end. That’s why I am convinced it was already decided even before interview. As far as visits, it was my 3rd visit during interview. Though we did get engaged after first visit and I petitioned her. I also spent 4 whole days inside embassy on different occasions during my 3 and half year visa journey. Everyone can see and hear every interview. I witnessed countless interviews and that’s what I observed. Filing after first visit that’s what they focus on most at this embassy. Again, this is not what I think or just an opinion. It is the fact I experienced and witnessed myself again and again. I saw they were grilling a lady for 30 minutes just this same question again and again. How can you engage with a person you just met like a week? She was trying to explain they know each other for months but he just came to engage and then visited again later on. They don’t even listen to any of that. CO and others inside the glass laugh and make fun of this kind of situation and make petitioner nervous and scared.

It's a requirement to apply K-1 to meet at least once within last 2 years. For most countries its fine. For tough embassies, it's a problem. Specially Cambodia. I experienced a lot of denials over the years on this issue only at this embassy. Didn't matter how much evidence you have or how many times you visited after applying. I was inside interview room witnessed many interviews on few different occasions. It's the 3rd or 4th question they ask how many times you visited before deciding getting engaged. If answer is one then they stop right there. Keep asking questions regarding this matter. They make jokes, laugh around themselves, intimidate you. Keep ask you how can you decide to spend rest of your life with a person in a short notice when you just met? I witnessed again and again this same situations. I saw they kept asking this same questions for 20 minutes or more not going to any other questions and finally denying visa. I had 3 visit by my wife's K-1 interview back in 2011. We also travelled few countries internationally together. I had overwhelming evidence of relationships you can think of. They didn't focus on that question on us. Actually they didn't focus on anything that cause any alert about us. Interviewer was joking and laughing looking at our pictures in Thailand, Malaysia and Bangladesh. He even joked with my wife how her parent in law in a different country. If they liked her or not. She visited my parents in another country. Anyway when I thought its done deal she passed, he said at the end he can't approve her visa. Wouldn't even give a reason. Just give a generic reason that based on his observation he can't approve(I guess profiling on our different ethnicity) and USCIS would get back to us. So this embassy actually I think pre approve who to give visa even before interview. Those days 9 out of 10 K-1 they used to deny. I didn't know that until we were denied. I never thought we would be denied because we were real. Anyway after denials and heartbroken, I regrouped, did extensive research, made many visits, communicated with many people, witnessed many interviews, got married and brought everything but kitchen sink to next interview in 2013 and approved with flying colors with an apology from Interviewer for denying us first time. I think embassy got little easiar these days but it still one of the toughest for specially K-1 even CR-1/IR-1. You already applied and nothing you can do now. Just get everything you can do. Try to attend interview and get ready to face this specific question. This embassy doesn't even look at your chat logs or communication logs. They focus on actual visits. More visits more better.

I am sorry I just ran into your post. I haven’t been checking into this website for a while that’s why I missed it. Anyway there is nothing wrong with the interview and no wrong answer. It is normal for this embassy and nothing you can do about it to correct or change the outcome. I know how you feeling after the denial. I went through this personally at this same embassy for almost 4 years. I did lots or research, travelled 8 times to my fiancé and wife(Got married after first denial). There is no point to look for reason of denial at this embassy because there is none. I don’t know where are you at this point. But if you really want to be reunited with your love you can succeed. I did. If you need help please let me know. I can use my hard fought experience to overcome this. I did myself then helped many others to overcome this as well. I am so sorry I didn’t visit this page for a while to guide you sooner.

My wife went through ROC in July 2015. We submitted exactly 2 letters not notarized. No RFE and also interview was waived. It did take almost a year (11 months) to finally get 10 year green card

Well your story very similar to me. How you met through family and stuff. You even did the similar things like me contacting senators. But I learned my lesson. You have to do all that right before interview. Nothing can be done right now. So basically you just regroup and re apply. There is no form for a waiver letter. You just have to write for a K-1 waiver letter with a heading K-1 waiver. Anyone applying for K-1 2nd time within 2 years need to file this waiver. Also write another letter to request withdrawing your previous case. Write all the case number, beneficiary info everything. You must have copies from first application. Use those for everything else. That's it. You should have an interview within 6 to 9 months.

Just realized you also had a lawyer. And you wasted all this time? Why did you pay your lawyer for? Anyway, at this stage lawyer is useless. Lawyer didn't advise you correctly anyway. You should have applied for a new K-1 right away. Why your lawyer didn't advise you this? My guess is he is not familiar with K-1 cases and specially not familiar at all with Cambodia. I would fire that lawyer immediately. I helped many people in the past here mostly denied cases in Cambodia. Because of my job and family I cannot give more time at this forum anymore. But once in a while case like yours I feel an obligation to help. I fought this embassy for almost 4 years. But I learned if you are really committed, you will win at the end. You want to win or not its up to you. Don't rely on useless lawyers or misinformation.

You may not know that 9 out of 10 K-1 cases in Cambodia used to be denied just like you. Most of the time for no reason at all. You know your cause but I never knew why exactly. Most people never knew. They don't pinpoint either. Anyway it is very common at this embassy and there is absolutely no problems filing 2nd time at this embassy. It actually proves that you are really committed. In my opinion, it's another way they try to weed out fraud. I witnessed many cases over the years at this embassy and rate of passing the interview very high here. Very rare the reject 2nd time unless they find something really wrong. In the mean time if you visited your fiancé more chances of approval goes way up. This embassy mostly deny K-1 cases for only one visit. If you have 3/4 visits, very rare they deny you.

Trip to your local USCIS office is a waste of time. In my personal case I called and was told on the phone don't do anything until I hear from them. That is of course a misinformation. I personally petitioned again after denial but as CR-1. But I personally know and helped at least 7/8 people just like you. They all members of this group and also in Facebook visa journey. So far, everyone successful and last few ones recently got their visa. Everyone got approved so far who I helped. They all became my lifelong friends. Happy ending in the end. If anyone one of you reading this post can confirm this. But if you just wait you just waste your time. K-1 petition expires one year after the date. But you can apply immediately before expiration date. You need a K-1 waiver letter. Your old case expires or not you need that waiver any way. There is no hope in your old case. So why waste time? I can personally give you few people who went through this but need to as them first. Most of them are members here. You may be able to check some of my old correspondence with them here. They all been approved and already in the USA.

You lost more then 5 months waiting to hear from USCIS? You wasted all this time for nothing. Forget about previous case and re apply for a new K-1 immediately since you cannot get married in Cambodia. You can file it tomorrow. Just make sure you write a K-1 waiver letter with your new petition and also write a letter to withdraw your old petition. You will never hear from USCIS about your old case until it expires. Then you will get a letter saying your case has been expired. Don't waste any more time and file tomorrow. If need any assistance just ask. Cambodia used to be one of the toughest country to get approved for K-1. Recently more people getting approved but still is a tough embassy. They deny cases for no reason at all. As a K-1(Denied in 2011) and CR-1(Approved in 2013) veteran of this embassy, I know a lot about this embassy. Ask any question you might have.

They may make your result available once they see your interview date. Just go ahead as planned. Usually takes just few days for results. I think my wife's result was available in just a few days but it was more then 3 years ago. If you don't have the result still go to interview. Embassy might reschedule at that point

Do not book a flight until visa in hand. Yes he can travel himself. But no way to know when he will get visa in hand even he pass the interview. They give back passport with visa only on Friday's. It could be a week after or 2 weeks after he passes interview.

There is no way to predict what's enough and what's not. If they target you then nothing is enough. Like I said I had overwhelming evidence and interview was perfect, but they still failed us. But there are cases not enough evidence and only one visit, but still approved. Sometimes they may just go by appearance how couple look like. That might happened to us. Different race, religion,language etc etc. So you never know. You do best you can, do everything you can do and try your best. Remember don't leave anything at home if you have anything might be related to your evidence. Good luck

They are not looking for a correct response. All they do is to intimidate you or your fiancé/wife to get nervous. They are trained interrogators and use intimidation to scare people. Usually people get scared and change the answer or get nervous and answer wrong. That's all they look for. You have to stick to your response. Once you change your story that's it you are done. If you don't have any pictures from your first visit you must have many other proof of your visit. Such as entry and exit stamp on passport boarding pass, airline tickets etc. You can show those.

Take photo copies of your passports entry and exit to Cambodia, Also visas and boarding pass/tickets. The chances of your passing interview this time is excellent. Like I said I witnessed many interviews personally over 4 different occasions. Also involved with this process for over 3 years and communicated with many other people who were going through process. Then after we were done I helped many others for last 3 years at this embassy. I don't. claim to be a lawyer because I am not and that's not my profession and I don't advise people for money. I just do it because I know the pain and how difficult it is at this embassy for real couple like us because of some corrupted people abused the system. I know for fact lawyers help is completely useless at this embassy but they try to tell people otherwise because it's their precession and they have interest in it to make money. I don't so I can tell the real story. Lawyer will tell you if you pass interview because you had lawyer and tell you you answered something wrong if you fail. Believe me I know this game of lawyers. My wife came with me to USA 3 years ago. Since then I helped and advised countless people. I heard it all. One thing I can tell you for case like yours who are going through 2nd time and also asked for senatorial help. I have not heard any failure of visa interview among them so far.

Well you might have discovered the reason why they denied my wife first attempt. You just asked me how come I petitioned a Cambodian woman when I am from Bangladesh? May be that's what happened. May be the first CO who interviewed us was biased. Even though I am an US citizen, I don't look like white or black American , neither do I look like Cambodian ancestry. May be you hit the right button. Even though I had overwhelming evidence, may be he was biased though that is against the law. Different race,religion, national origin....sounds like breaking a serious US domestic law. But it goes right through the window outside the USA. They have ultimate power and can decide who to approve who to deny. Nothing you or me or anyone can do about it. And they don't have to give any reason and have no accountability.

They cannot officially black list a country. That will be a discrimination against a whole country. It's just unofficial black listed country. There are few of them around. Cambodia is one of the toughest.
Well when there is a criminal case lawyer represent the criminal at court. Lawyer argue and talk on behalf of that criminal in front of judge. In this case lawyer is not allowed to go in with you to the interview. Only you and your fiancé need to face the interview. Lawyers are not present and not allowed. So that argument doesn't apply here. Also on RFE if you follow all the instructions correctly should be no RFE. If you read many stories here on visa journey too many people got RFE when they had lawyers. So RFE goes both ways either have lawyers or not. Based on many interviews I personally observed at the point of interview, it doesn't make any difference you have a lawyer or not. But it does make a difference if a senator inquire about you. I have personal experience and knowledge about that and I can share that if you want privately.
Well if you are in law enforcement I don't think it matters. You already found that out. Your fiancé was denied before.
It's all depend on evidence and actual physical visits. Not online or Facebook or chat logs. Also how much evidence you already submitted initially because I got strong evidence they actually pre determine before interview who to pass who to fail. They don't pay much attention to what you bring to interview. They don't have time or manpower to do that. They are conducting 25/30 interviews a day and some lasts hours.
All these warnings I am giving you just to make you prepare not to scare you. They do pass a lot higher percentage of people second time around if people do come back and apply again. I met people who succeeded on 3rd or 4th try. But they do approve most people on 2nd attempt unless there is something they suspect bad. They don't give you a chance to dispute or bring additional documents. They just take easy way out just deny if there is a slight suspicion.

If you can do everything for $1200 you are lucky. My guess between $1300 to $2000 just to go through the process. Not counting if you have an actual marriage ceremony. It will take almost 4 weeks minimum to process and you have to be present the whole time. You have to get permission from Cambodian ministry of foreign affairs and there are many steps and many tea money(Bribe) involved. I went through this back in 2012 after our K-1 was denied a year earlier. I am pretty sure it’s still same. They do have legit brokers do this for a fee if you don’t want to get hassled but still you have to be present whole time. This process actually harder then actual visa journey itself. Brighter side is if you can go through this your visa journey will be a breeze compared to this. People from other countries not familiar with this. It’s one of a kind with Cambodia. That’s why you got some confused answers.
