  1. Dear VJ,

    How does the process work when hiring an attorney from the beginning? Meaning, when starting with a new visa application does the attorney/paralegal charge for a specific amount, retainer, etc? How much did it cost? What was included? What was not included in the fees? Does the attorney/paralegal fill out the application for you and then ask you to send the evidence directly to the attorney/paralegal? They compile everything and send it in?

    Sorry not sure what to ask; just wondering what the entire attorney/paralegal process is like?

  2. That's okay. I am just trying to figure out the quickest way for this couple to get to the United States. I was curious if there was a small loop hole, like applying for a "spouse visa" 90 days before the actual marriage. Something like that, I can see that can not happen. So from your responses and what I am reading on the K1, K3, & CR1 is that either they wait until they are married then apply for the K3 or CR1, or apply now for the K1 visa and get married in the US.

    However, it seems to me that more K1 visas would be denied, only because the couple is not married and is promising to get married within 90 days when arriving in the United States. I am not sure if the evidence supports my opinion, but I will find out.

    What happens if they apply for the K1 and then get married before leaving?

    Sounds like these questions are for infopass?

  3. A friend in Colombia wants to begin the Visa Journey :)

    They are engaged, she lives in the united states, he lives in Colombia. They lived together for about 2 years then she came back to the united states to work. They will be getting married sometime in October. Should they wait until after they are married and then pursue the K3/CR-1 or apply for the K1 now?

    Their situation is different than ours so I don't know what would be best. I know the goal is to get to the United States as soon as possible.

  4. We arrived at 12:15, there were about 50 in line but it moved very quickly. The ceremony started on time at 1:00. The notice said to arrive promptly at 12:15 which we did. I guess they want to be sure everyone is checked in. There were about 200 applicants and 61 countries represented. Once it started the Immigration Judge gave a small speach, gave the oath, & lead everyone in the pledge of allegiance - this took about 7 minutes. The rest of the ceremony was for videos. It was a nice ceremony which lasted about 30 minutes. They had a passport and social security table available after the ceremony but we did not stay. We went to get something to eat and then went to the social security office to change the status of citizenship, this took about 5 minutes. In the next day or two we will apply for the passport. The End!

  5. The oath letter says to bring the following:

    This letter

    PR Card

    Reentry Permit/Refugee Travel Document (we don't have these, maybe they ask everyone to bring these?)

    Immigration Documents (I guess this means all the papers we have acquired during our journey?)

    If the naturalization application is on behalf of your child(ren) bring the child(ren). (I have a child that will become a citizen based upon me becoming a citizen. Does that mean I should bring my child?)

    My family is traveling to New York City in August. If you have either been to or live in New York you certainly have more experience on the city than I do. This will be our first trip. Any advice on transportation (to/from airport taxi or shuttle bus) (best way to get around NYC - subway, how to purchase tickets, etc) and when to visit tourist attractions and what attractions to visit (how much time does it take to visit each). We will only be there for 3 full days and want to prepare an itinerary as best as possible.

  9. NickD, you are right...he could have just taken copies. But we have several certified copies for immigration/government use. I didn't mind them taking 1 of the many original certified copies we had. I prefer they have something more official than from the xerox machine. Just a personal preference I guess.

  10. The interview was scheduled for 11am. Since we live less than 10 minutes from the USCIS office we stopped at FedEx kinkos to get the unnecessary updated passport style photos. We arrived at USCIS at 10:40am. We walked through security. We were the only people going through security. 2 of us and 3 security guards. Major difference from when we went for our GC interview 2 years ago. Anyway we went upstairs in the waiting room - the waiting room had large windows, flat screen TV with CNN, 1 security guard and many seats similar setup as the airport. Maybe 20 people waiting. We all were not there for N-400. There were 3 separate doors and an IO would come out every 2 minutes or so and try to announce someone's name. It seemed like the officer's from our door were solely naturalization cases.

    After sitting down we watched some breaking news about a slim jim factory collapsing. Then at 10:59am (yes I looked at the exact time on CNN) I was called in. I asked if my husband could come with me and the officer politely said no. My husband told me to ask :) We went to the end of the hall and went into his office. I took the oath and then he asked me all the yes and no questions. He asked me to write George Washington is the father of our country. Then he asked me 6 questions (listed below) from the civics test. I answered them all correctly, he had 4 more in case I missed any. He asked if I had a good marriage I responded that I had a normal marriage. He asked to see the birth certificates from our children. He kept the originals. He then received a phone call and excused himself. He said "this is my brother is Brazil, I am sorry". I didn't mind it - actually made the situation much more comfortable. He finished and asked if I had ever been married. He didn't ask for ANY other documents or the passport photos I took. I will use those for my passport. I could have taken my passport, GC & children's birth certificates and would have been fine. I noticed that my file probably from beginning to end, was very large. Where do they have room to store every persons file? Anyway he said that he was approving my case and said congratulations. He also gave me 2 pieces of paper. One with his decision of my case and the other with the Oath Ceremony instructions. He said I would receive the notice of Oath ceremony in the mail shortly. I went out and noticed it was 11:20am. So it took 20 minutes which included a personal phone call :)

    This site has been a very useful tool for me and my husband and we will continue to use for years to come.
