  1. I just have to ask....What kind of non taxable income? Is there an asset associated with it which you can use to meet the guidelines?

    va disability income. i was below the 125% in taxable income last year but made above 125% in non-taxable va disability. now i have a job with the dept. of veterans affairs and make above the 125%.

  2. hi VJ. when i'd be able to present all of my financial documentation at the embassy? from what i've read on the consulate reviews here the filipino screener just takes your most recent taxes and w2. we're wondering how the process works when you have other income you need to show that's not taxable. would that wait until we see the american co? just don't want that filipino screener to only take my tax info and w2 and have already made a judgement because it's low for last year without looking at my non taxable income and my current sustainable income. thanks.

  3. She must be rushing things for 2 reasons. 1 is that she doesn't have anything to do and 2 she wants to work by the time she gets there :) Talk it out with her for the real reason. To issue a CES report needs a good full 2 months to process excluding the mailing days and the school or license office here in PI can take weeks to months to process your required docs.

    TOEFL - she can take it anytime and anywhere while here in PI. They actually have a schedule on their site and the result is released after 2 weeks or a month I believe & expires in 2 years.     CGFNS - will do a CES professional report for your wife. CES will ONLY do an academic evaluation so you don't have to send anything to the PRC or licensing office. The CGFNS will have a summary of the papers needed to be sent to their respective office after you pay for it. Results are released after 2 months and expires after 2 years.

    NCLEX - contact your board of nursing for their requirements. If they require SSN then get it first. States like WA has a paper where you are to state if you don't have SSN and send it with your application but some states like CA don't allow applications without SSN. NCLEX scheduling and exam doesn't take too much time compared to TOEFL and CGFNS. You two have the choice :)

    Just REMEMBER to never take NCLEX without any results from CGFNS since this will be the reference of the board of nursing whether to allow you to take NCLEX or not.

    Thanks so much for all of the info and advice guys! @Emmandenn is it really that the CES expires in 2 years? i read somewhere else that you have to register for the NCLEX within 12 months of getting your results and it expires after 1 year.

  4. She can prepare all the necessary documents (e.g. Transcript of Records, RLE hours, etc) needed for submission to CGFNS while she is still in the Philippines. CGFNS are the ones who will do the evaluation (they call it CES). as soon as she will arrive in the U.S., she can start to file for her academic evaluation (CES). She can also take NCLEX review classes while waiting for visa approval.

    She seems to want to do the CES while she is there. I don't understand why but that's what she has her mind set on. So if she does it while she's there would she just submit the evaluation to the colorado board of nursing when she gets here?

    I would recommend she take the TOEFL for her English proficiency. That she can take at any time. Please do not let her think it is a smiple exam. At least look at testing material for it. Good luck!

    Where can she take the TOEFL in the PH? Is there a separate payment for that besides the CES?

  5. My wife has a Bachelor of Science in Nursing and wants to work in nursing when she gets here. I've called the Colorado state board of nursing and they said she doesn't have to take the full CGFNS exam she just needs to do the Credit Evaluation and take the English proficiency exam.

    My question is when should she do the Credit Evaluation and take the English exam? Is it best to wait until she is here in the U.S. or should we get this done while she is still in the Philippines??

  6. If that were your whole story, you might be worried but what you describe doesn't sound much like your situation at all. You had income that wasn't taxable. Even if they are very concerned about last year's income, it's income they are concerned about, not just taxable income. Can you spell "p a r a n o i d"?

    geez man. i guess if you want to call me paranoid thats fine. i'm just trying to get my wife here. i appreciate your help.

  7. Ya but you are ignoring your $19K income, their situation is not your situation.

    Hank did you make an income sheet to document your non-taxable income or just present the award letters and bank statements? I also had income from the post 9/11 GI bill, they pay you a monthly stipend will you're in college, but i don't think i can include that. i just really hope they take the disability income and current income and don't just look at my gross income from last year and deny us because it was low.

    i did get about 14k in unemployment income also. they probably don't like to see that. if they look at the totality of my financial picture i think it won't be a problem. but i've heard the CO will sometimes not even look at other evidence if your taxes the prior year fall below 125%. this guy, though he didn't have disability was still asked to get a co-sponsor though his current income is above 125%.

  8. According to the latest I864P for two people the amount is $19,387 for 2013 (it went up from last year). Still your disability income does count, so for sure include the documentation for that. My wife was approved and they accepted the documents I provided showing what I receive.

    i will, thanks hank. i guess they are requiring last years taxes to be above 125% also now. i really thought it was more on current income. this sucks.

  9. Yeah my current job I make above the 125%. In 2013, without any changes in pay if I continue to work the whole year there my taxes would show around 22k at the end of the year. I really think what happened is they ignored the letter that said I only worked 3.5months in 2012, and assumed that I somehow earned $6500 for the whole year. And didnt care that my letter of employment confirmed this amount. If you are in a similar situation(your 2012 W2/tax return doesnt show above 125%), I'd recommend you bite the bullet and get someone to fill out and sign for joint-sponsor but dont submit it unless the embassy does like they did to me and says it isnt enough.

    I really don't have anyone to use as a co-sponsor. I can't believe they denied you because of last years income if you now make above the 125%. I've read numerous threads on here where they went off current sustained income even if last year was below 125%. I'm sure you saw them too. I don't know what to do now.

  10. Well it seems like my "current income" they decided is based solely what I earned in 2012, even if I only worked for 3.5months of the year. Even though I have documentation that I work full time, and my employer gives an income of just under 22k(I work a tip-based job so he cant say I make an exact amount he can only estimate, which was lower than the actual).

    So you currently have a job with an estimated annual salary above 125% and were denied? If thats the case I am in the same boat. I only worked a couple months last year but make well over the 125% now.

  11. Well bad news, she passed her interview but they are saying my income is not sufficient even though I made the equivalent of 22k/year...since my W2 will only show my earnings for the 3.5months I did work we need a joint sponsor.

    So you're saying they denied you because of last years taxes being below the 125% even though your current income is above the 125% requirement??

    From everything I've asked and read they go by your current income. Now I'm very worried.

    Are you currently working with an income of above 125%??

    Is 19k above the 125%? Yes I had 19k in disability payments last year but I'm just worried because of the latest tax returns. The previous 2 years were above the limit because I was still active duty military. And now my current job is above the limit. Just want to make sure I get everything correct and if I need to ask a family member to be a co-sponsor (i REALLY don't want to).

    If you can prove that you currently are making above 125% with pay stubs(most recent 3 in a row), and/or a letter from your employer stating all your personal information and confirming your salary they probably will not require it. I am in a similar situation in that I did not work at all in 2011(I was living in ph with my wife), and I only worked from July to October in 2012(I moved back to US in july, then back to PH to be there for my daughter's birth). The NVC processed it no problem with provided pay stubs showing that I do work 40hrs a week, and a letter from my employer that stated my estimated income(more tricky for me since my job is tip-based) for a 40hr week by 52 weeks per year to estimate a yearly salary. However, the final decision is done by the CO at the interview. Our interview(I cant be there) is TODAY, so I'll update you on whether or not the above is good enough or if they may require a co-sponsor or other evidence.

    Edit: After about 2 weeks from receiving NOA2, you should call NVC and get your MNL case number, so you can pay AoS and IV fees ASAP and then send in your I-864 and DS-230 packages for fastest processing time. You will also need your spouse to email for DS-3032 appointment of agent, so that all correspondences from NVC go directly to your email. Doing this saved me weeks of time, since my wife is slow to react to these things. The spouse will need to sign the DS-230 packet(part 1), so factor that she will need to complete that part(you cant save the form and just send it to her), and then Fedex a signed copy(do NOT sign part 2!!!) to you along with any other original documents(recent NBI clearance), NSO certified Birth and marriage certs, etc!

  14. Hi all! I got the text message we'd been waiting for today. Our I-130 was approved at the NBC and it's now on to the NVC. How long can I expect to wait to hear from them? What things should I do ahead of time to prepare for the next phase at the NVC??

    We're so excited!

    My only concern now is that my income last year was below the 125%. I now have a good job with the Department of Veterans Affairs and make well over the 125% and also have VA disability income. I've asked this question before but I hope to get more of a response now as I'll be needing to send my I-864 in soon....

    Will I need a co-sponsor because last year I was below 125%???? Or will they look more at my current income which is above the 125%??? HELP PLEASE!!!!
