As for 'whats next'? Lets find out in another month, aye? If it's denied, usually it's denied within 60 days of submittal, with no prejudicial stuff. If there's an RFE, expect it to be issued on the date that it WOULD have been approved.

Why would she not follow the instructions and complete everything? That seems so odd to not follow any of the directions and include anything at all. My guess is that they would request all of the supporting docs to be sent. Did they cash the check?
Yes - they cashed the check. As for why would she not follow the directions? That is another story. I gave them to her directly from the USCIS website and told her everything we had sent in our packet. The fact it took her a year to try a second time (after filing the wrong form) makes me tend to wonder if she is serious about the process of getting him here.

Hey guys!
My husband has a friend back home that married an American lady back in spring of 2011. She sent an I-129F in to start their process and was denied in Nov. 2011 of course because she sent in the fiance packet and not the I-130. She sent nothing again until this last fall. This time she sent in the I-130 form and the fee and that's it! No marriage certificate, no birth certificate, no divorce records from her, no G-325A forms, no passport photos, no proof of anything... literally just the I-130 form and the fee.
Now my question is this - I would assume they will just deny her instead of requesting an RFE for absoultely everything, but we never know I guess. Is there anyone out there that has missed a lot of paperwork and was either flat out denied or received an RFE?

So here's my story, My mother has been living in the United States for about 25 years now without the proper documentation. I am 21 and would like to petition and sponsor her to get her Visa.
Is this petition intended for this kind of situation where she has already been living here?
I have already filed the I-130 and received a letter saying I need to file an Affidavit of Support (I-864), I am a college student and don't have much assests and my income taxes are very low and I am not currently working, will they accept that? I'm not even sure why I have to prove that since she has been living here on her own and supporting herself very well.
Assuming you are a citizen, the I-130 is a correct form. The income is definitely a problem, however it is minor compared to the fact your mother has been here without proper documentation for 25 years - which I assume means illegally. I am not an expert in that area so I will not comment on bans, waivers and such but I imagine you just opened a can of worms that will be an issue to deal with one way or another.

When I spoke directly with the CO at the embassy in Algeria she told me it was standard to put all men ages 18 - 40 through AP. It is a general rule standard that I am sure runs across all MENA countries.

Keep in mind he may have been put in AP, it is Nigeria and would not be uncommon.
They gave my husbands passport back to him until they were ready to actually print it since there is no guarantee how long that process will take. IDK, just another thought...

I organized all my papers according to the cover letter. I used paper clips to keep similar items together. When my packet was ready to be mailed, I simply slid all the papers in a priority express mailer at the post office, and then mailed it.
You dont need to do anything fancy, just put the packet in an envelope and mail it. They will reorganize it how they want it.

I just put our pictures in a zip lock bag so they stayed together and sent them off with the paper clips. They are going to go through and put everything how they want it anyway... so just make sure it is ALL in there and you should be good!

His address is not an issue. Just make sure it is one he can receive anything from the consulate.
Once approved, the petition is valid for 4 months and can usually be extended in 4 month blocks for up to one year. Once issued, the K-1 is valid for 6 months. Add the current processing times for petitions and you are almost there now.
Verify that the consulate you will use will grant extensions. Write to them and tell them the same story and ask if you can extend the I-129f approval. If yes, you can file the I-129f now.
Be advised the consulate you are dealing with is not an easy one, and will require signifigant proof of relationship. That will be yours to produce while your fiance is in the military. I have little to offer in advice on that.
This last statement is very correct.This consulate is very difficult.You will want to gather as much proof of your relationship as possible, it will be more difficult while he is in the military. Keep in mind the timeframes when you choose to file as you need to have seen him face to face within 2 years. Hang in there, it will all work out in the end!

In this information age, some people instead of becoming information wise, they became information lazy, they share, post, repost, copy/paste or absorb information without checking its accuracy.
Ah... I said it was put up for sharing knowledge. I never said it was good or accurate!
I agree with you - however anything on the internet is something I rarely take at face value myself.

I believe your wife has an incorrect receipt number or she turned in something she should not have. If you are living in Algeria and she filed an I-130 to start your CR1 process to come to the US an I765 Employment Authorization is not needed or filed. She should call the USCIS and verify the receipt number and talk to someone to find out if they did in fact receive an I-130 packet at all.

Wendy, you will need to call the USCIS and wait however long they put you on hold. It is completely necessary at this point and it will be worth your time. Honestly this waiting time is very minimal to what is ahead. If you have the patience and do the research a lawyer is not needed at this point. We never used one. But you have to be willing to wait on hold, mail in what is asked for, fill out the forms, etc. A lawyer will do it for you but as mentioned previously... they will still need all the paperwork and answers.

True! - It costs about 20-30 dinars, but is only good for 3 months. It expires after that so he will most likely need one for the NVC stage, and at least one for the interview/approval stage. We went fairly quickly but my husbands expired from the time it went to the NVC to the time they gave him an interview. He needed to bring a new one. Then, he had to do yet another one when they issued his visa as the one from the interview expired by then. Basically he just needs to keep a close eye on the expiration date through every step.hello;
a police certificate is called "casier judiciaire" in Algeria;he can get it in the court,but he needs to bring with him his birth certicate & also the birth certificate of his father and his paternal grandfather.
it's a fast procedure,it only takes 1 to 2 hours.

I have no idea what time frame you should expect for your embassy, however 6 months does seem like a good bit of time. You said you emailed the NVC - have you tried calling and getting a live body? Maybe they would be more willing to actually pull up your case info and check it out instead of just pasting back the standard email reply.

When I came back from Canada to Washington State they did not take and keep my Alberta driver's license, however I did have to give it to them. They put a hole in it with a paper punch to invalidate it and gave it back. I had it, but it became invalid at that point.
With that said, every state is different so it is better to call and ask

Rant: So i mailed out our petition on November 8th..YAY!! I got delivery confirmation on it (Thank GOD!!) and the post office tried to deliver it on the 10th (which was a saturday) The post office said that a notice had been left stating it needed to be redelivered. Okay..so my rant is this: It has been almost 5 business days and NOTHING has been updated on the postal website. It still says the same thing it did on the day they tried to deliver it..So..I called USCIS and waited 40 minutes just to be told that they couldn't tell me anything and to call back the end of the month!! what the #######!? By the end of the month, my package will have been sent back to me! IS it really that hard for them to see if someone had tried to get my petition? He said "Someone in our mailroom will get it if a notice has been received" REally? that's all you can tell me..and then he tells me wait TWO more weeks!!! I'm sorry if i seem childish. I'm very upset..To think it would take A MONTH almost to know whether or not they even received it!!!Something that should have only taken a few days..I'm in tears. Thanks for listening!
P.S. Word of advice to those who are about to send out a petition: DO NOT mail it close to the weekend!!!
I had the exact same thing happen to me. I called the post office, they said they were waiting for the packet to be picked up.
I requested they attempt to deliver again the next day and they did so. All was good.I recommend going with help from the post office first.

I suppose I'm still not seeing the problem. If someone did come in on a non-immigrant visa, even with the intent to change over and apply thru the I-130 after already there (this is NOT our intent), I'm not seeing what the problem would be anyways.
The problem is it is against the law. Plain and simple. You don't have to convince us of your intent, but your wife does have to convince the officer.
We do not have to like it, or agree with it. Rules are made for reasons. If you want your wife to visit you must follow them.
I know it may feel like it some days but the immigration laws are not out to get us. They are in place to protect us. By us I mean the country in general. Yes, these are the prices we pay married to a foreign spouse. Is it fair? Maybe - maybe not, but it is what it is.
I think the advice you have received here is very sound. I am sure it will help once your visa/immigration over there is complete.

Thought about that, but that's ridiculous. It would take months, just to be turned over. Also taking away from someone who wants it in the process.
Yes, it would take that long - it boils down to how important is it to have your wife be able to visit in the US?
She would not be taking up someone's visa number as spouses are immediate relatives and visa numbers are always available. It is not part of the "wait in line until one is available" category.

Not always true. They did not keep my husbands passport at the interview and he was not denied. They requested it later when they were ready to approve and issue it. No forms for more info, no second interview, no fuss - just a call asking him to drop it off.
Sure it is a good sign they kept the passport, however if you do not find your cosponsor they can still return the passport with no visa. Just make sure to turn in everything they request ASAP and all should go well!

Actually i had provided 4 police clerance certifcates (since i lived in four areas.03 in my home country and 4th in kingdom) with following date of issuances:
1-17-JULY 2012
2-10-AUG 2012
3-04-SEPT 2012
4-08-Sept 2012
so all above certifcates were not expired at the time of interview since my CR-1 interview was in first week of NOV 2012.
Understood. But if any of them expire before your visa is printed you will be required to send in any that are outdated at that time, remember AP can take months. My husbands was only good for 3 months. If they are valid longer and still good when your visa is printed you will have no problems and will be good to go!

I beg to differ here. By the time my husband went to his interview he had to provide a new police record that day because the one that went to the NVC had expired. Once he had his interview and we had our issue of his being marked as not showing up all cleared up, etc... by the time they went to print the visa they called and requested a new one as the one from his interview had expired. They did in fact request a police certificate after one was provided at the interview. If it expires - they will ask.

Agreed - it will be pretty difficult. They definately have enough against them to make it a huge uphill battle... I would have thought making sure the I-130 was done correctly would have been a MUST!?
