Why would they send a ten years green card if iam not allowed to enter the united states ? why they didnt denied the application when i filed it , why they send it after 2 years and half of filing the remove of condations !!! ? i never heard this before , that someone got his green card while he was away for 4 years almost . so this is confusing
what will happen if i enter the united states with this ten years green card ?
Did you ever inform them you moved out of the country? They obviously did not know. If you try to use the card they will see you haven't traveled out of the US, you are only trying to travel in within the last four years and they will turn you right around. It will not work, your wife needs to file the I-130. I know you miss your family, but look at it as a small price to pay to ensure you remain legal.

Your plan won't work. What matters is current and ongoing income at the time of the interview (and again for AOS). Normally I'd suggest a co-sponsor, but USEM doesn't normally allow co-sponsors for the K1, so your best bet is to delay and find a new job asap.

I'm not sure what your point is with the part about me saying "he" as in my friend. Yes, I am embarrassed, because this embassy represents my country, and I have a list of indescrepancies and bad behavior on their part. I am the CEO of a Corporation and we help facilitate international students.
You had not stated any of this until now so I was just explaining how it looks like based on the information you have given us. Additional information that helps clear things up always makes for better feedback.
Just because your experience with the Algerian embassy may have been a good one, doesn't speak for hundreds of others that are likely treated in the same manner as my friend/facilitated student.
A never said my husband's was a good experience. I said he was also called back after his approval. Although his interview was pleasant, the embassy marked him as a no show for his interview and he got lost in their system. So do they have issues to work on? Sure. Is it legal for them to approve and then deny a visa? Under certain circumstances sure. Under yours? Maybe they shouldn't have, but only immigration law can answer that. Maybe ask a lawyer.
They tell you not to book your airline ticket until you have your visa--but many people read that as, if a consular officer tells you that you are granted a visa, and hands you all the paperwork that says congratulations you have been granted your admission into the US, and your visa will be to you within four days via UPS, and here is your shipping label for tracking purposes, that is pretty much for most people their idea of "having" their visa.
People are warned for a reason. We were told in writing he would have the visa in hand in 10 days. He actually got it a month later.
I agree with you it is ridiculous what happened and is most likely unfair, but it is not unheard of unfortunately.

My wife is going to be interviewed at Casablanca consulate on Feb 6,2013 and it is for IR1 visa ( I-130). Prior to the interview date, I mailed I-864 to NVC and was accepted by them. FYI, I am a self-employed and sponsoring my wife and was told by some friends to send form I-864 for affidavit of support. I read so many CO reviews and most of them were denied coz they used the wrong form. To my understading, NVC accepts any form and leaves the final dicision to the interviewing consulate.
My question is, since I am not an employee but a self employed ( I own a small business) petitioner, should i send I-864A or keep the one I sent to the NVC ( form I-864)...I am worried and do not want my wife's visa to be denied due to submitting the wrong form.

Keep the I-864.
The I-864 A is when a sponsor's income and assets do not meet the income requirements for the I-864 and another household member combines their income with the yours. You should be good here. Maybe make sure she has a copy to bring with her to the interview as well, just in case.

I disagree that you should wait on the police checks. Apply for them NOW! We had to wait months for ours and it really slowed us down. Most are valid for 1 year. It might be wise to double check before applying, but definitely start on that now. You will be thankful later!
I agree to check and see. DO not assume it is a year. Algeria's expires after 90 days and my husband wound up needing to get his 3 separate times before the entire process was over.

You keep saying "he" as in your friend, but at the end of your original post you said you were embarrassed and you were working with the congressman and it really is bothering you.
Small discrepancies like this made here are no big deal - but any made at all during the interview can make a CO think twice. Maybe there was differences in something your friend answered between the first time and the phone call.
The Algerian embassy is very though and actually my husband was called back after being approved his visa for something they needed. While he was not denied after the fact - it is entirely possible as Darnell said. It is never really a done deal until it is in your hands. That is also why it is has been cautioned a million times here to never purchase a plane ticket before visa is in hand

Please my wife earns $22,000 and she lives with my step son who is 16 years and still a dependent.Is her income enough to sponsor me for the Affidavit of support?Please help........

It looks like with her, the son and you that is three for the count which is $23,862 for the 2012 guidelines. She should look at a cosponsor and it should be fine. She will need copies of the last 3 years of taxes as well.

I hope they don't reject it, I wrote in blue ink then realized it was suppose to be in black so I went over in it in black, because I couldnt print another form. I also scribbled out some mistakes, so I'm not sure. I heard they won't cash the check and reject the paper work unless they approve it.
I sent our original marriage certificate and translated, our pregnancy test results, a apartment lease that we live together, I sent copy of my birth certificate and passport. A passport of my wife which states her birth place and everything. I sent everything they requested for. I'm just worried about the black ink over blue ink. I'm also worried about scribble.
I actually so know someone that was denied their petition and still lost the money, however in your case I would not worry about it at all. It sounds like you did your homework and I am sure it will all turn out fine. If they do not like the blue ink or scribbles I could see them just sending an RFE asking for a new copy. Especially if this is the only thing that wasn't correct. Time to relax and wait it out... it's all good!!

Good news, bad news. The bad news is that this is the longest waiting part of the process.
The good news is you are well into it and will be done before you know it. I had to wait 7 months for this part of the process, but once it was done the rest flew by comparatively!!

Just because they cashed the check it does not guarantee approval.
If you put the I-130 packet together well and have the proof of relationship there should be no problem. If they are missing or need anything they will contact you with an RFE (Request for evidence). For now all you can do is play the waiting game. While doing so just make sure to keep adding to the relationship proof for the interview. Best of luck!

Oh wow! Just when I wasn't keeping tracking of it lately(so bz w/ work), the decision came out! After 164 looong days, it is approved!!! YAY!!!SO happy...
Was informed by email. How long do you think will we receive the approval letter from USCIS? And what's next? Thanks everyone! God is good all the time!

The letter itself will come in a few days. Now it moves on to the NVC stage!!
If you haven't checked out the NVC guides here you should do so now. We had prepared everything ahead of time so when we got a case number at the NVC we were off and running. Best of luck!

Actually it is funny you should ask NY_BX! She has lied in the past about what she turned in and when, but had excuses for each one. She actually gave me a copy of her NOA1 with the case number, it went to the NBC. See my husbands friend asked if we would help since they were married before us and my husband is now here in the US with me and they have gone nowhere in the process. His friend thought his wife needed help... I just don't think he knew what type of help she needs!
I will definitely run an update. I really am very curious to see how this is handled at each phase!
Maybe she wants to get denied and thinks he loves her and they will live happily ever after in Algeria lol

I hate to say it like this, but my husband is 27 and his mother is 45... is there a chance that this woman might not be together enough to be making this choice with fully informed consent? I worry about this woman and hope she really has thought critically about this.
Actually you put that all together very well. When I talk with her she seems to have all her wits about her, but I don't know. I know she had high hopes for a while of moving to Algeria but he refuses that idea completely. I agree with you in hoping she really is capable of making sound, wise choices. Especially now if not before.

I agree, I don't think it was the norm either, he got lucky! My husband and I were questioned in Algeria (same country as her husband) about our age difference and ours is 8 years. That was just one of many grillings, they were fairly tough! I doubt they will ever make it to the interview stage anyway as she has no job or income for the last few years and no cosponsor. But that's another whole topic in itself!
It will be interesting to see what the USCIS does with her packet and if she chooses to follow up in time.
Ah well... She refuses to come here, I don't know why. This place has been a life saver for me!

They will send the application back and if lucky the check/money order. I know this couple that did the samething (twice) and got the application back with the check...But really why not read the instruction is it that hard to make sure to cover your #### when sending important documents to immigration (i guess not). I have read the I-130 application and the instruction multiple times to make sure I don't get an RFE or denied and even asked different couples about their case and what they sent with each application...SMH

I personally think that if absolutely zero effort was made in the petition there should be no check sent back! If you forget something ok, that is understandable - but in a case like this I would keep the fee. Especially since it is the second time she filed and the first was the wrong form completely which means she didn't read any of that one either!

how long did yours take?
We had a "special case" so it was actually expedited. When I spoke to one of the two officers in the Algerian embassy back in September they were a good bit behind on APs. There is only one guy pushing that paperwork.
With that said though there is no way to determine how long it will take. If it is a matter of standard background and security checks it can vary based on his name, if it is similar to any on a watch list, etc. all kinds of different factors come into play. She did say their goal is to complete standard APs in 6 - 8 weeks however there is absolutely no guarantee at all. It could be much sooner, it might fit that time frame, it may be a good bit later. This is where the final stretch of patience comes in. I know it sucks, but look how far you have come! Just stay positive and hope for SOON!

My fiance has got a response from the embassy after he sent an email and the email says the application is on adminstrative processing and this case is not yet complete. as soon as it is complete we will contact you. Please what will this mean?
Administrative processing is their final background checks (for security) and such (anything they need to check or follow up on, etc.). This process can take anywhere from a few weeks to a few months or more. There is no way to speed this process up, it is just a waiting game at this point. Hopefully it will not take very long and it will all be said and done before you know it!

I dont know if it helped at all but he did his interview in English.
I believe this is very helpful. My husband also did his in English at the Algerian embassy and he mentioned how happy, comfortable and friendly the interviewer got when my husband spoke English to him. Keep in mind French or Arabic will not be the COs first language and things may not be communicated or understood as well as if they were in English. Just a thought!

nice, thanks for the info. on another note, do you know anything about writing in pen after having had print out the forms? I forgot to state my fiance has no middle name I just left it blank, and I didn't date it either I'm stressing because I don't know how strict they are about all of this.
The Algerian embassy did in fact ask questions regarding my husbands employment in Algeria as they were using to see what he was looking to do for employment once he got here. They can and have asked. I do however agree if the employment type is just on the current forms that should be fine as passports are pretty long term and changes do happen.
As far as the ink, if you are just adding the N/A and a date I am sure it is fine as long as it is in black ink per the instructions. I think the issues come up when people try to write over or cross/scribble something out to change it.

The I-129F instructions state to leave nothing blank, and to use N/A.

It always amazes me some people and its either their lack of simple concepts to read or they are just so vapidly ummmm not smart to get it.
You have those who don't feel its necessary to meet to file. You have those who don't find the time to flippin get divorced before they marry and file.
You have the "why do we need evidence we are in love and they better approve us.
And those will be the people who post the "CO was so mean and unfair".

I am sure she is aware of what happens at the NVC stage as I told her. But I also told her how to do the I-130 correctly, so go figure. It's funny because she does keep saying "I don't know why they denied us the last time. What's wrong with us?"... when in fact she DOES know - it is because she filed the wrong form over a YEAR earlier. Yikes.
DZ is the country code for Algeria.. I have no idea why.
My husband tried to explain but frankly he makes no sense to me regarding this!

Really?! Spend some time in the forums here and check it out. The USCIS DOES make mistakes, it is not uncommon at all. As for your other questions, it sounds like you really have your heart set on trying to use the card regardless. I just hope it does not cause you bigger issues then the wait for an I-130 would.
