    Why is everyone telling the OP to come back to the US and wait?
    He has a joint sponsor.
    He has a boss that is going to hold his job for him while he's gone.
    He has a wife that will work while they wait together so they don't have to be apart like most of us on the forums.
    If everyone that posted their opinion, of which he did not ask, had the means to do it, they'd be waiting with their loved ones in their arms every night instead of thousands miles away while the US Govt takes it's sweet time in doing what it does.
    He asked simply what he could do about the Visa issue.
    He didn't ask whether anyone thought if it was a good idea, or if they thought he should come back to the US and wait.
    I'm glad you found some information Michael about what to do. I wish you the best of luck and I hope you are able to stay with your soon to be wife for the duration of the process.

    This is true, but if it just sat in VSC? If they think this route will be faster, just imagine what we might have been waiting for in Vermont. Though of course we will never know that answer, because plans are already in motion. Also the 10 days is just to drum up an estimation. They may be processing them sometime this week, and possible look at how many their agents are getting done a day/week. If they don't generally process them, they will have to do them first to get a rough idea. Either way lets all hope to start hearing acceptance letters from TSC soon.
    Just another bump in the road, life will have many of these, and your gps unit will not divert you from them either. So we just slow down, hit the bump, and keep on driving....and yes that was a dead body we just ran over. Shh Shh! don't look back.

    I wanted to write about my experience at CFO for those spouse/fiancee who will get their Guidance and Counseling Certificate
    I just went at the CFO today, and received my Guidance and Counseling Certificate. I am from Cavite so i woke up at 2 o'clock in the morning, left the house at 3am and arrived there at 4:15 am. I dont want to take any chances of not getting any slot as they only entertain 15 slots in the morning and 15 slots in the afternoon.
    CFO is located at the Citigold Center, 1345 Pres. Quirino Avenue Corner Osmeña Highway (South Superhighway) Manila, Philippines
    When I arrived there, a lot of people are already there waiting. But i noticed that the line in the left side which is for spousal/fiancee counseling are more longer than the others but they are spouse/fiancee of different countries. I brought a folding chair with me because i know am gonna wait for hours there. But i suggest that if you are planning to go there for GC Certificate, might as well bring a biscuit and a bottled water with you because its gonna be a long day.
    You should bring with you the following:
    1. Marriage Certificate and a photocopy
    2. Two valid IDs, have it photocopied as well
    3. 400 pesos
    4. And supporting documents. Ex. photos of you and him, divorce papers (if applicable), and birth certificate of spouse.
    These supporting documents might be requested by your counselor. Because its gonna be a hassle if you are from somewhere far, so be sure you have these with you.
    This is only for spousal passport amendment requirement meaning you will need GC to use your spouse name on your passport.

    At 7 am, they opened the door and let us in. They took one of our IDs and will give you CFO pink ID that is for spousal and fiancee. We proceed to the third floor where forms will be handed out to fill in.
    Now, in filling in forms, be accurate. You should know your husband's information well like his address (if in military, it should be his resident address and not his deployment address), zip code, his/her mother's maiden name, telephone number, cellphone number. They will not issue your GC without filling in all the needed information.
    They will encode your name and take a picture of you for your GC certificate.
    Afterwards, your filled-in form will be reviewed and this is where the counselor asks for supporting documents if there is something amiss or suspicious in your form. So always be ready with your documents. The counselor will give an okay mark on your form and H mark if your are ON HOLD. On hold mark will be given a one-on-one counseling if you have a sensitive issues regarding relationship with your spouse or fiance or if you have a pending documents to be seen by your counselorr. You will be paying 400 pesos at the cashier (window number 5). Then you'll be given a receipt and go back to third floor for the counseling.
    When the counseling is done, you will go back to the first floor to window number 4, present your receipt and tell them you are done with the counseling. They will give your Guidance and Counseling Certificate. And you are done.
    I actually got my GC certificate at 2 pm. I was sooo hungry and tired.
    Now I believe that there is really no love without pain.

    So, from what i read elsewhere this has happened to other people. The process is something like this...
    1. The first application is made,
    2. The couple breaks up, the fiancee does not turn up for the interview
    3. The petitioner does not withdraw the application.
    4. Time passes,
    5. The 2nd petitioner applies for the original beneficiary,
    6. The application is approved by USCIS, sent to the embassy
    7. The Embassy denies the application stating 221(g)+Other "Multiple petitions",
    8. The embassy returns the application to the USCIS district director that approved the most recent petition
    9. The original petition is reevaluated and denied
    10. The new petition is approved and sent back to the embassy.
    However, it's not clear to me yet that stages 9-10 always take place, i've read conflicting reports about CSC just sitting on the applications when they are returned and allowing them to expire, while VSC does do steps 9 and 10.
    The embassy does not seem to make the judgement as to whether the original application is expired, they leave that to USCIS, so the 4 month expiration window mentioned by various people to show she has multiple applications ongoing at the same time is not true.
    I honestly believe what she has told me, she was up front about that before we even talked about visas but i just never pushed for enough detail due to the age of that relationship. Even if i had more details, i would still have assumed that the original petition had expired and was therefore no hinderance. Really, i'd ask people to refrain from further judgement as to her intentions because my intention here is to find useful information which can also hopefully help other people avoid the same situation in future. I would not wish the last 22 hours on anyone, and i don't want to spend my time defending my beloved against any accusation or insinuation that she is scamming or misrepresenting. If you don't know her you don't know just how special she is, incredibly smart, kind, loving, hard working, quirky, funny and wow she's so beautiful. I truly believe there is not a person on this planet better suited to me than she is. There have been so many occasions where she's been presented with a choice where she could easily have taken the easy option but every time she goes for what's best for both of us, even at her own expense. I could go on and on, but please believe me when i say that my fiancee is 100% legit and trustworthy, and she is not deserving of any doubt from people who don't even know her. I know many simply have my best interests at heart, but don't worry for me about that, just concentrate on useful advice which can also help others to learn from our experience.

    There would have to be severe reasons to get an expedite approved. Either military, something going on in the originating country or something similar. Without more information on who they saw approved, I would take it with a grain of salt.

    This process does try one's patience but, so does marriage from time to time.I hope things work out for you but, maybe it's better you found out this quality, or lack thereof, before you were with him in the U.S.

    Withdraw your petition and go there and marry.
    Ditch the bullshit lawyer that is charging you for nothing.
    Follow all the guides here on the site and re-file. This time the I-130 (married visa).
    Ask any questions you may have.
    It will save you a bunch more money and it may in turn be faster. If you are married and file the I-130 you don't have to pay the AOS fees after he gets here (I don't believe).

    I am sorry for your loss.
    Why can't she still fly to the USA? I know that she will not be able to fulfill the K1 because of the death but getting a tourist visa will be next to impossible. Why not use the K1 to fly, spend time with the family, get some closure and then fly back before the 90 days is up so that you will not be here illegally?
    Just a question.

    All the I-129F is for is to make sure the USC meets the requirements to file the petition to bring the foreign fiancee/fiance over.
    They check to make sure
    1) proof you have a bonafide relationship
    2) proof you have met within 2 years of filing the I-129F
    3) proof you are a USC
    I think there are a few more things they check out like if you have any domestic abuse cases and stuff like that. Everything else comes when the foreign fiancee/fiance gets before the American Consular.
    Any paperwork above what the I-129F calls for is a waste as you will have to include all those documents again when the interview at the Embassy happens.

    I'm a September filer and I'm being patient and supportive of everyone else, but really?
    We have all been waiting for our loved ones for entirely too long. The system is broken. Constantly complaining and always assuming the worst is not going to help anyone.

    You sir are beginning to be a real sore spot on these boards. If you don't have anything constructive to say then please just refrain from posting.
    Every post I see from you is complaining about the Amnesty Act which you don't even know how it works (as evident from your other postings).
    Post your timeline so we can see where you are in this process and to see if you are even entitled to be complaining like this all the time.
    Don't keep giving people misinformation as they are trying to deal with this rather trying time in their lives and they sure in the hell don't need to hear your disillusioned, over exaggeration about the process.
    People need hope and people to talk to that share their pain, not negative comments telling them they will be doubling every waiting time they say. I just hope people are smart enough to see your posts for what they are and not as gospel.
    Sorry if I seem rude, but the constant complaining isn't helpful to you or anyone else.
