I am in a process of filling up the I-130 Petition For Alien Relative form for my parents.
For the Section 14 b. Did you gain legal permanent resident status through marriage to a US citizen or lawful permanent resident?
I interpreted it that since I became a PR through marriage to my US citizen hubby that I should answer YES. But hubby thinks that I should just leave it unanswered since it doesn't pertain to me anymore because I am filing this petition as a US citizen & not a permanent resident. Who is right?
I think he is actually correct since you're no longer in PR status. If you read question 13 it also ask about US citizenship which i am assuming that you. You can't be a PR and a USC at the same time so i'm thinking that don't pertain to you. But wait for another member with more experience to respond to you. But i think he's correct

Please help I need all the info I can get I hope I am posting in the right place. I dont know where to begin. We were just married a month ago we have been together over 1 year. My husband came on a visitng visa over 5 years ago and overstayed. How do I start the visa process what do I file for what paperwork and what do I need to do first? Any help or advice would be greatly appreciated.

I'm assuming that he's in the US right now, if so you need to fill out forms I-130 Petition for alien relative, I-485 Petition to adjust or change status, G-325A Biographic Information,I-765 Employment authorization(if he wants to apply for EAD) I-131 Advanced Parole(If he wants to travel before his green card is granted), I 864 Affidavit of support. Get all those forms together read instructions carefully and acquire the supporting documents requested. After everything is filled out, signed and dated you mail it to the appropriate address and sit and wait for a response from USCIS:-)
P.s Under no circumstance should he live the U.S between now and the time he receives his green card cuz he'll be banned from re-entering for possibly 10yrs. Good luck

Rule of thumb for EAD is 90 days ...a little less after biometrics are done
How was your info pass appt? Where they able to shed a lil more light on the situation?

Hi Guys, I just checked my case status online and it's now under Decision. It says:
Decision
On September 28, 2012, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later.
Does that mean I am approved?

Morning!!! Hope I get the paperwork back soon. I still plan on going to my infopass tomorrow and see if I can get some answers (and hopefully make Sean understand...)
I asked my FIL for a complete tax return and W2, plus a few other stuff like biographical page of passport and last 6 pay stubs.
He will overnight it ASAP. Already have all the other stuff. Hope to get it out this week.

Good morning to my external family. October is here... Those of us having interviews soon, it's time to start organizing our folders if we haven'tbdone so yet and good luck to us all. I hope we can all come back with the great news of approval. To those of you still waiting for that text, email or snail mail about interview appointments; hang in there it's coming soon. Those with RFEs how you can get them out soon so the ball can be rolling again.

Tell me about it. Having to prove to someone that you are one with your significant other is beyond me and having them determine the outcome of your life is beyond stressful

I agree. The funny thing is no matter how come it is I sleep in hubbys boxer and his under-shirt. I sweat line an animal during the night. I don't know about you guys but after all this AOS thing is over I'm taking a vacation. A long one.

No no no. Im in Illinois and it snows here. It doesn't back home so never seen snow before. Not thrilled about it
I'm from Dominica so when I came in March. I was anxious to see it. But a few weeks after I got there we had a horrible snow storm(I'm in NYC), I was so over it by the 2nd day. It's cool the first few times you see it but It's really nothing to be thrilled about unless you're a kid or don't have to drive or go wait for the bus.

Hi,
I am adjusting from f-1 and my AOS is pending.
I'm want to know what will happen in the case your AOS is denied. There are no reg flags in my application, i just want to be prepared for the worst and of course i'm hoping for the best.
Can someone tell me how to add time line to my profile?

If your AOS is denied depending on the reason you may have an option to either re-open or re-consider appeal, you may be given a date in which you are to leave the U.S if you are already out of status. Someone else may have more detail for you on the subject. To add your timeline you go to settings(inder you name), then click on profile, then Change Signature and you type it in

OMG!!!!! Men. My husband is a super procrastinator too. He's still driving me crazy with that, sometimes in nit sure he realizes how important this is. Hope your Sean gets his head in the game soon and get on with it.

I-864A is only filled out if the joint sponsor is in the same household as the primary sponsor or the joint sponsor, so her FIL would need to fill out the I-864 only. *If* her FIL wants to use his wife's income to meet the minimum requirements, his wife (iaia's MIL) would need to fill out the I-864a since she shares the household with the joint sponsor (FIL). OR if they were living with her FIL then he would fill out I-864a. Hopefully that makes sense, it was all confusing to me at first because my dad sponsored my husband When her FIL fills out the I-864 he marks choice d. (I am only the joint sponsor) on part 1 of the form.

Yeah, we are getting a joint sponsor. I'm still going to my infopass on monday, but my FIL will be my co sponsor

He pretty much the same as the sponsor. He has to give his tax returns or assets and proof of his U.S citizenship. he has to fill out the I-864A

Thank you. We are going to the infopass next monday with everything we have so far and also, I'm putting my house back home as an asset. I'd never guess that the RFE was about the affidavit of support. Sean got really screwed with the taxes last year since they never 1099 him. That also stopped us from buying a house when we got here. Thank god we still have assets to put in the paperwork
Everything will workout. At least you're not in the dark anymore and wondering what the hell the RFE was for.

Do we need arrival/departure records for AOS interview ??
I lost my I-94 and did not get a replacement, instead i FOIA'd my arrival/departure records so i can have proof of my legal entry(also my I-94#). I was told that they generally ask for and keep your I-94 at the interviews.
iaia- I'm so sorry that your situation is a bit more complicated than you expected. I don't know much about it so i can't input. I do hope that you can get a clear picture f it at your infopass appt. Good Luck
