    The heading on the section clearly states "Complete the information below if your relative is in the United States and will apply for adjustment of status" (emphasis mine).

    Exactly. Question #22 does state that very clearly. :)

    Blank or n/a would be appropriate if the beneficiary is not in the USA applying for adjustment of status.

  2. I am also in Alabama and therefore was routed to Atlanta as well. Definitely more I-130s pending at Atlanta office than the Salt Lake City office (as per the USCIS trend chart), but I know we will all be approved soon. We just have to stay positive! I will follow all of you sent to Atlanta so I can see how quickly the NOA2s come for all of you! Best of luck.

    My local office is Atlanta, too! Hope ATL gets the ball rolling on our I-130s soon!

    OMG that is such great and wonderful news for us transfers! I was getting a bit demoralized, but now seeing your post I'm so excited, and I feel like you have given us all hope! Best of luck for you to also speed through NVC. I was reprimanded before by a senior VJer or moderator for repeating some things that were in a guide, lol, so I'll just say follow the shortcut guide to be proactive with NVC!

    6 inches thick on the submittal package for the I-130, and I totally forgot to fill out Q22 (the right side) on the I-130.

    Will I be sweating an RFE ? It seems rather apparent (from the rest of the casefile) that she's in China and will be interviewing in China.

    Isn't question 22 supposed to be filled out only if the beneficiary is in the USA and wants to adjust status? That's what the form says.

    Seems OK to me that you left it blank. I did, too. I recall this situation being posted about before. You shouldn't worry about it.

  5. I am an August 2011 filler and received and RFE in August 2012 and quickly replied to that with many evidence proving my marriage. On October 17, my case went back to "initial review" and said my case was being transferred to a local field office. I then contacted my congressman for more info, and all I got was, "Your file is in transit to the Detroit District Office as of yesterday. Once it arrives here, it will be scheduled for review with one of our officers in 90 days.  Unfortunately, I am unable to provide you with an exact date or time when the I-130 Unit will schedule this one for review. The I-130 Unit is diligently working on these petitions and giving their undivided attention to each case.”

    And today I check Uscis again and it says my case is transferred to a USCIS office. I'm so confused and devastated because I really thought I would be getting an approval by now.

    Any insight on my situation?

    It took them from August 2011 to August 2012, a whole year to send you that RFE? That's horrible! It seems that your case got kicked back to the starting point. I'm sorry I don't have any other insight. I hope USCIS looks favorably upon your case.

    Thanks, hamigirl, I did register back in August. I created a portfolio and registered my case number to get automatic updates by email and on mobile but never received any email/mobile updates other than for the very first NOA1. Do you get an email/mobile notification of a "touch"?

  7. My case was transferred to NBC on 9-19 and it was last touched 9-28. I am guessing the 9-28 is when it was sent to or arrived at my local office.

    hamigirl, how do we find out if/when our case was "touched"?

  8. Open the USCIS website and click the Check my Case status,below you will see Processing Times,you have to enter what Form you filed,the Form sub type and the office,you will see the result

    Oh my goodness gracious, A&T is correct! The National Average has been updated to 7.9 months! It used to say 5.0 months. Yikes, that is scary. Of course we have no idea yet if the process for us transfers will be faster (because of wider distribution) or slower (because workers at our local offices not used to this). I was just wondering if there are any members of Visa Journey who were transferred before me so I can keep track of their progress. Anybody know?

    USCIS National Average -- 7.9 months

    I strongly suggest you fire off an email, contents resembling:

    1. USCIS Receipt #

    2. statement of misrouting (NBC vs NVC vs EAC vs WAC)

    3. ask that immediate investigation be started, as you know of MANY cases with this mis-routing

    4. ask that immediate review of ROUTING software be started, as the software used for routing was changed in April 2012.

    I just wanted to say that I did take Darnell's advice and contacted the ombudsman. A nice representative from the ombudsman's office called me and basically told me that since the normal processing time had not expired as yet, no one will probably start an investigation.

    And prior to contacting the ombudsman, I did call customer service and talked to a tier 2 officer who confirmed my file was in Missouri and insisted that it was not a misrouting, though he could not explain why it would be sent there.

    Just to give a bit of background on my case... I'm a USC. My husband has never been to the USA. My I-130 got transferred from Vermont so fast that the transfer notice came in the mail before the receipt notice from Chicago. I don't believe for a second it was because of some red flags.

    it was a mis-routing.

    Ask your wife to call into USCIS, get an ISO human, and see what's up.

    Missouri doesn't handle Visas for spouses of USCitizens.

    After I got the transfer notice, I did a search on google and read online that the National Benefits Cente handled backlog reduction a few years ago for petitions, including I-130s, from Texas Service Center. So, it may not be normal for them, but couldn't they possibly be processing our I-130s, Darnell? I mean there are so many of us here and also on other forums with petitions received on different August dates not just by Vermont but also by California, I see from this thread, being routed to Missouri. For a mis-routing, that would be a pretty major screw up.

    My husband and I have been married since Dec. 2007 but the visa he was granted shows CR1 instead of IR1. Has anyone had this experience before? What do I need to do to make sure he is a permanent resident and not a conditional one? He interviewed at the nairobi embassy and this is where the visa was granted. At the port of entry, the officer said he did not know why my husband was granted a conditional residence even though we had been married since 2007. Any insight is highly appreciated.

    Hi there, and congratulations on your husband's visa. Did you do a search on this site? I think I got this info from VisaJourney (pasting from my notes)

    "OK, I heard somewhere about conditional permanent residency...what the heck is it, and does it apply to me??

    Due to immigration fraud, the CIS gives ALL immigrants by marriage a conditional permanent residency green card unless the couple has been married for over 2 years at the time of interview. The conditional permanent residency green card is valid for only 2 years from issuance (the day your passport is stamped by customs or CIS), and the couple must file an I-751 form to remove conditions 90 days before the 2 years is up, or the immigrant will lose his/her green card For more information on Removal of Conditions go here. "

    Have you checked your status recently,you remember I was sent to Lees Summit too but I think we're now back at USCIS.....I have no idea why some of us seem to be travelling around.......when my husband called about our case being in Missouri he was told it wasnt an issue..its still worrying though when you feel you're the only applicant there.

    Yes, my status says the same thing...

    "The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office."

    ...by USCIS office, I think they are referring to the USCIS National Benefits Center in Lee's Summit, Missouri.

    I checked the postmark on the transfer notice. It was mailed from Vermont.

    I did get a notice of receipt (postmark shows mailed from Chicago) that says VSC received my case. But this notice was dated earlier than the transfer notice. Someone in Chicago was just slow to put it in the mail. So, untiI I get any more notices, I feel sure my case is still at Lee's Summit.

  14. Hopefully all of the August 2012 filers can use this thread to keep each other updated on the status of our cases. It is nice to know how others with similar filing dates are doing. My I-130 was sent to VSC and from all the reading I've been doing, they seem to be very backed up. I hope they can pick up the slack. I am really not wanting to wait more than 5 months. I hope we're all in for a smooth ride.

    Can we try to find out how many August I-130 filers cases have been transferred to the National Benefits Center at Lee's Summit, Missouri?

    Did all the cases transferred to Lee's Summit come from the VSC?

    How can we found out if this is a good thing? Maybe this will work out faster for us? (sent to NBC for processing because VSC is overwhelmed)? I read that NBC has helped with I-130s in the past for backlog reduction.

    Is there any way that this transfer of the newly received I-130 petitions to the NBC can be bad for us?

    phew, nice to know that!

    It's just that in our I-130 form, we forgot to indicate where I'd be having my interview (US Embassy in Kuala Lumpur), so was worried it might affect our petition or have the USCIS think that I am in the US at the moment and will be AOS-ing from there (we are not). Anywho, my husband called the helpline who told us to write a short letter indicating the missing info and send it to MO.

    I wonder why ours got sent there. Are you doing AOS in the US?

    No, my husband is in Côte d'Ivoire. So he is not doing AOS. Adjustment of Status is for a beneficiary who is already in the USA (for example, arrived in the USA on a tourist visa or student visa and got married while in the USA and is still here). In your case, if the beneficiary spouse is in Malaysia, and not in the USA, then you did not need to answer question 22. I'm sure a VJ senior expert will correct me if I'm wrong!

    Welcome, christian sister! So, which service center has your case? That will help determine how long it takes. There are many other factors as well. I'm sorry to say that Christmas in US with hubby is highly unlikely; however, with God anything is possible!

    we'd appreciate your feedback.

    We sent in the I-130 two weeks ago, got the email and text saying it was sent to Vermont, the check's been cashed then we received the NOA1 saying it's sent to Lee's Summit, MO.

    I was a little worried so I asked my husband to check the copy we have. Turned out for Question no 22, we didn't write down the name of consulate where I'd have my interview, since we're not living together at the moment.

    Anyone has any suggestions on how we can amend this?

    I just wanted to let you know that several of us, who filed I-130 petitions at the same time you did, got the same letter. We're not sure exactly why our files went to Lee's Summit, but I don't think it's a bad thing. USCIS has a service center in Lee's Summit, Missouri. They process different applications there. It is not where you would have an interview. The letter didn't say anything about an interview or an RFE, did it? So you can relax and just be patient.

  18. Hey everyone! I would like someone to help me answer the following question. It would be greatly appreciated :). I am a U.S Citizen and my husband is an Indian citizen. I sent in my I-130 on August 20, 2012 which was received to the Chicago Lockbox on August 22, 2012. I got the e-notification which said they have accepted my I-130 and is at the Vermont Service Center. A few days later, I checked my case status which stated that on August 28, 2012, my I-130 has been transferred to another office because they now have jurisdiction over the case. What does that mean?

    If someone can tell me in detail how all this works, please let me know.

    Was your case transferred to Lee's Summit, Missouri? Mine was, and so were a few other petitions that were filed at the same time we filed ours. We all got NOA1s that said Vermont. Because the petitions were just received, and because there are several of us, I don't think it's because of some red flag in your background check. A senior member of VJ said it was a routing error. My suspicion as that due to case overload at Vermont, the center in Missouri has started helping out with processing of I-130s. But I don't know for sure, I am not an expert or a senior member of VJ!

  19. Hello I am new to VJ and I hope to gain a little knowledge through everyone's ones experiences!

    I have a very unique story and I hope I can gain some sort of comfort and direction through this forum! My story starts about 24 days ago. I went to visit my great grandma with my grandma in the Philippines cause she's sick. My newlywed wife (The one I am petitioning) is my grandmas friends granddaughter and they introduced me to her. I didn't leave her side after that. I decided I wanted to marry her. I asked my grandma and she let me have her engagement ring to propose to her on my cousins birthday. Got married the day before I left (10 days ago). She got my grandmas band to. I got a stainless ring until I got back and my grandpa gave me his. Now here comes the complicated part, I am only 21 years old, I am a college student with no job at the moment and not the greatest financial situation. I am reading all these stories and instructions with I-130's or I-129's and I'm at complete loss. On top of that I have a slight blemish on my criminal record that occurred almost 3 years ago but it is quite minor although I am still afraid the bumps it may cause. I want to petition her now but I am afraid it will be denied because of all this and lack of history. I have great support with all of my family and even had offers of AOS from several family members. I'm looking for any advice, and guidance! I hope to share my journey with everyone and hopefully it is a successful one! :)

    Congratulations on your wedding! May you have many years of happiness together! You sound like a good guy to go all the way to Philippines to visit your grandmother when she's sick even though you have no job at the moment and poor finances!

    So, I know it seems overwhelming AT FIRST. The more you research, the more the process will make sense. Since you are already married, you need to apply for a CR-1 visa. These are the forms you start out with:

    I-130

    G-325

    G-1145

    You download these forms from USCIS website and mail them together with many other documents (read the guides). Your wife's original signature needs to be on her G-325 so she needs to get that in the mail ASAP.

    After you send in this initial packet, make a wise decision about which of your family members will act as co-sponsors (research "Affidavit of Support"). Based on what you said, I don't see how you will be denied, but be prepared for a long visa journey!

    Things may go faster to get your wife to the USA if you follow this guide.

  20. Sign with your legal married name. I also have not changed my passport due to a new multiple visa issued before my last trip and my passport is two years old, so if I changed it, I'd have to pay for a new passport and new visa. I am carrying a color copy of my marriage certificate (my original marriage book) and my drivers license (which I did change because it was a cheap change.) I also changed my name on my SS Card (free) and all of my utilities (free), added my husband to my bank account as beneficiary, life insurace as beneficiary and I added him to my health and dental insurance as well as my car insurace as a non-driver.

    I am certain my flight tickets are going to have to match my passport, but I will inquire with the airline at choose at the time I book my flight. Should be no problem if I have to book in my married name because I have the marriage certificate and marraige book to prove I married in February.

    Just wanted to let you know that if the name on your airline tickets don't match the name on your passport, then you will definitely have a problem. If you don't want to get a new passport, then please put your old name on your ticket.

  21. I'm really glad you asked before buying the ticket and showing up at the airport. Nigerians need visas to go just about everywhere, sorry! There are many "restricted nationalities" that have just got to check visa requirements each and every time they travel. This is based on my work as a travel agent and also working at the denied boarding desk at Atlanta airport where the poor souls come when after not being allowed to check-in. The UK, Europe, Canada, USA, Australia, are you kidding me? However, anyone can go to Mexico if they have a valid USA visa /green card!
