    This is not a website affiliated with USCIS. (uscis.gov) Websites like these take your money and run. So my advice would be to RUN from this website as fast as you can!!!!!

    It looks at though you have hooked into a commercial website, that is NOT an official USCIS website, read the fine print at the bottom of the commercial website. Additionally, the website has a ".com" ending. You need to go to an official US government website with a ".gov" ending. Such as this official USCIS website about ROC: http://www.uscis.gov/i-751
    On the official link I provided is access to the official USCIS form, instructions, mailing address, etc.

    Indeed, not sure why your post seems to be hostile. Your tone suggests you are upset or something. I am simply saying logical things here. A letter from the employer suggests just that a letter from the USN stating my service of employment. Having been dinged for far less of a Symantec term I am just attempting to clarify this. As for the military part of the forum, I can hit that up as well but this was my first stop as this is associated with my AOS. I did consult other military people and they said they ONLY submitted their LES. People who just went through this process less than 5 months ago who I work with told me this. So while I understand the importance of this I am not sure why you seem hostile. Thank you for the detailed information and guidance and I will be sure to get all the info I can. We have an infopass appointment and I have legal that will be going over these documents with my wife.

    I will post this in the Military thread as well, but your issue has come up qite a bit (myself included)..
    The LES isn't always enough, many people on here have had to get an employment record while in the Military. Often called a Proof of service letter, or Statement of Service letter and I've seen people get theirs online, or their Finance Office or even their S1s (I got mine there) depending on branch of service.
    I'm having a terrible time today trying to find the old threads, but there are several in the Military section. Do a search for Proof of service, statement of service or my old posts for more details..
    also- my RFE was similar.. because I was deployed, my taxable income showed I was under the poverty line, even if I made considerably more... click on the RFE link in my signature block- there might be some helpful stuff for you, good luck..

    We didn't AoS but I think he had something that was a statement of service. He printed it, that's all I know. We also sent 3 years worth of tax transcripts and 3 months worth of LES's.

    I have NO clue what its called... but my husband USAF - went to work and came home with a print out showing his position and pay and rank and all this stuff and it was printed on his squads paper. Not sure if you can get something like that?
    Another thing he was able to get was a letter from his boss/first shirt whatever they are called lol and basically stated how long he had been in, his rank and pay etc signed on squadron paper again. We didn't include the letter but did include that paper with all the other info on it that he had printed out at work. We also included a paper showing his promotion when he got his new rank that showed his new pay grade and all this fancy stuff.
    We front loaded the AOS petition pretty heavily.
    (even got the paper print out from security basically stating the military allowed him the ability to marry me as my background check was completed without any incidents etc etc.)

    Guys, lets not bash her, she was simply saying the same thing we all think. We are all gratefull for the service that soldiers, sailors, marines, and yes even the airforce *grumble* put forth for us. Some people express that gratitude by wishing that we got more things or that we received better treatment. We should not be upset at somebody who thinks that; rather we should be upset at the people who abuse those types of people. There are many who would take the actions of those who cherish our sacrifices and would turn that to further their own selfish desires ( a person who fakes injuries to gain 100% disability ). The point is we should not be attacking somebody who is passionate about her love and devotion to our service members. I think we can all agree that the issue is those who choose to exploit that love. As i said before this is not the main purpose of this topic so please try to not edge this on further.
    San Diego, if you want to help you are more than welcome to do so but I am currently deployed/not at home base. My wife could meet you with some of her friends and look over the paperwork if you wished to help. I appreciate the offer.

    Lets keep this civil. I think the answers have been posted and this thread has done its course. No need to make this about anything other than how to file the AOS with the RFE that was obtained. Again I thank all of you from the bottom of my heart as it is a great asset and relief to have a support group to turn to that has done this or is currently going through this. My wife and I would not be able to have dealt with this as smoothly as we have without a place like this. So I very humbly thank each and every person who has taken the time to post.

    Eh... pretty sure that was you thinking something that I was not saying. The joy of the internet and being unable to read somebodies tone from it. I was making a haphazardly joke... While some people you may know try to use whatever they can an excuse to get out of duties and responsibilities I certainly can speak for myself that I do not. You don't know this but its the internet... give me the benefit of the doubt here. Anyway, we will gain nothing going down this road. I very much appreciate your help and your desire to post detailed information. I have taken your suggestion and posted in the military section. I wish you the best and thank you again for your concern with this matter.

    First, this is an RFIE (request for initial evidence), this means they did NOT get your initial evidence, not that they're asking for more evidence. This means you forgot to include your most recent return, or it's missing, or they didn't see it, or it wasn't complete.
    1. The 2011 return is the "most recent tax year" until April 15, 2013. if you have 2012, submit that as well. Order Tax Return Transcripts from the IRS here: http://www.irs.gov/Individuals/Order-a-Transcript or go in to an IRS office. Make sure it's a "Tax RETURN Transcript", not an account transcript.
    2. Did you submit a letter from your employer? It is a requirement per USCIS here: http://www.uscis.gov/i-864
    They said the amount you wrote says you meet the guidelines, but you've shown no proof of that income (which implies to me, letter from employer). I googled LES and it means "Leave and Earnings Statement" and you're saying you included the last 5 of those, but that's not proof of all the things you listed. A letter from employer should solve that.
    3. How exactly did you write the household count on your I-864? Your wife is not your wife on the form, she's the immigrant. Your household count should only be 2 (unless you have kids). You didn't write her name in 24(b) did you? D and E should have been un-ticked/unmarked, that's what you did right?

    I guess they lost some of your documents that's why they asked for it again.. It happens all the time, people do get RFE for documents they've already submitted.. Just submit everything they asked on the RFE letter and you should be good to go!

    Did you meant you submitted your 2011 return and not 2012? Because you said you added her to your 2013 return, 2013 is not due until next year.. Based on your timeline you got married Dec. 2012 so that means you will be filling or filed your 2012 taxes as married this year..

    I got an RFE too. Did you file an income tax return jointly with your wife? because that's what I and my husband would do after I get my green card as some of the members here advised me to do so. Anyway about your thing, We got the same thing, although we thought that we submitted all the required evidence but when we went for our infopass there are things that we forgot to submit. if you have cars or any things that can be converted into money, you can add that too, copy of the title of your car and I suggest use the kelley bluebook for checking the price of your car as advised by the officer in charge with my infopass. If you think you have done mistake on the filing of I-864 then redo and submit it again together with the letter that you got. I suggest that please try to get an infopass for you to have more clearer understanding. take a copy of everything that you submitted for AOS in your interview for info pass so that the interviewer can give you more clearer answer and exact thing you need to do. tax return for 2012 should be filed jointly even if your wife is currently not working.

    Are you sure that the tax return you sent was complete? Did it have all W2s, 1099s, schedules, and everything in a paper return?
    Something was wrong with your tax return, so they ask you for your wife's income and say you don't make the poverty line etc. The real issue is the tax return, if you can fix that then the other issues will go away as well (they are dependent on the first).

    Hello!
    First of all, I'd like to refer you to this sample form. Most of your questions will find an answer right there http://www.visajourn.../Form-I-134.pdf
    If you can get the letter, great... but , this might be Embassy specific. My husband's LES was sufficient to show everything related to his work and we didn't present any letter.
    Once the visa is approved, it takes a few days (about 14 give or take) for the Embassy to return the passport with the visa stamped. Once she has the VISA in her hands, she will have to make sure all the information on it is correct.. if there's a mistake, she will have to contact the Embassy so they can correct it, otherwise she's free to travel as soon as she gets her passport back.
