    Hello VJers,
    I dont mean to brag, but Im extremely happy that my request for expedite under the financial hardship category was approved after 17 days! Firstly, I want to let you guys know that getting your Congress Representative involved in your case DOES help. On September 24, I requested an expedite under financial hardship. On the same day I received a request for evidence. I sent my evidence on September 28th through fax. I received a fax confirmation and that's it. I practically called the USCIS everyday. On October 10th, I requested an expedite for a decision. The Tier 2 operator told me that by Monday October 15th, I will receive a decision. However, I didnt all I received was an email stating that they received my evidence and that my case was still under review. So today when I called again the Tier 2 said maybe I should contact my Representative. So I did out of frustration. Being that my first K1 petition was denied at the US Consulate in Jamaica, I contacted my Congress Representative back in Janaury. And I had no idea that any other case sent to the USCIS is reported to my Congress Representative. Luckily, my Congress Representative is Jamaican like me. Anyway, when I called the office today they told me that they sent me mail and if I received it. And then I said why what happen? Then she said to me that the VSC center emailed them letting them know that my second I129F petition was approved for expedited processing on October 11,2012. Just to show you how inaccurate the USCIS can be. It is better to get your Congress Representative involved because they directly contact the Service Centers. And once you get them involved, they will follow up on any other thing that you do with the USCIS. Also, for anyone that feels that they will have a good enough reason for an expedite please do it and pray on it. I received a lot of negative feedbacks from some VJers. The ones who believed that only US Deployments get approved. Also, those with medical emergencies. Financial hardships do get approved! And I make way above the poverty level. So please dont assume that this will effect your case in any way. Just cause you make enough doesnt mean you can't have financial hardships. If you guys have any questions please feel free to ask.

    She can only get a green card through her husband who filed the K-1 for her.
    It would be fraud for her to get a green card at this point as she no longer has a bona fide marriage.
    She needs to get a divorce.
    She needs to return home.
    You need to file for a K-1 fiancée visa.
    There is no way for her to become legal by staying and marrying you. She can only become legal through her K-1 petitioner husband.

    This is some information I PM to people about to do interviews. I've gleaned it from VJ posts, books I've read, attorney's I've spoken to. For those prepping for an AOS interview, I can recommend a small but very informative book titled "Green Card Interview Questions and Answers: Dos and Don'ts, Keys to Success", by Joseph Rotomi Famuyide, Esq. It is self-published, and although I found it through interlibrary loan, he lives in Brooklyn, NY and a copy can be obtained from him directly. These tips and questions are applicable to any country.
    Here are some tips for the interview:
    1. Do not volunteer information. For most questions, the shorter and more direct the answers are, the shorter the interview and the higher the chance of success. If the question is a yes or no question, give yes or no answers only. If the question is a simple question like "What is your name?" answer simply with your name.
    2. If you do not know the answer to a question, do not lie. Say, "I don't know the answer to that at this time." or "I don't remember."
    3. The answer to many questions will be in the papers that were sent in the petitions. Questions like, "what are your husband's parent's names". They will expect you to know the information given in your petitions. Review everything in your paperwork with your wife before her interview, and do a mock interview to see how the information may be applied.
    4. Avoid saying "I think . . .". Women do this a lot. The examiner will expect you to know not be unsure, of your answers. Also, avoid adding "umm", "you know" and "ahh" type fillers to your speech.
    5. When applicable, don't just state, demonstrate. If the examiner asks a question that can be answered with a document or photograph(s), provide it along with your answer.
    For example, if the examiner asks, "What does your family think of your husband?", give them a picture or two with your answer; "They like him very much. Here is a picture of him with my mother and father at my parent's home."
    Or, "How many attended your wedding?" Answer, "(give a number, then say) We have some lovely wedding photos of our guests having fun. Here are a few that I can show you."
    6. Give American answers for dates and times. 12/24/07, not 24/12/07.
    7. Dress well, but not overdressed.
    8. Try to appear calm, well organized, and friendly. Nervousness raises suspicions.
    9. Remain focused. If the examiner makes jokes, smile and enjoy, but do not make jokes too.
    10. Make proper eye contact when conversing with the examiner, and try to control your own facial expressions so that your face remains pleasant and cordial.
    11. Be audible so that your examiner doesn't have to ask you to repeat your answers.
    12. Organize your papers in a way that will allow you to retrieve them easily and quickly. Examiners appreciate order and someone who doesn't waste their time.
    13. When the interview is over, always ask for the results. "What should I now tell my husband about my visa status after our interview?" Before you leave, have them explain any papers they give to you and/or any procedures they will be taking to complete your case. Try to get the examiner's name for future reference, if needed. Write it down.
    14. If the interview is in another city than the one you live in, arrive a day or two early to complete biometrics and get the results of your medical exam.
    15. Arrive early to the consulate, but also be prepared to wait for a time past your scheduled interview appointment time. Be careful of thieves around the consulate if you have to carry cash. Bring ID; you cannot enter without it.
    16. It is rare for the consulate to give you a visa on the spot. Be prepared to return for it, if approved.
    For the interview, your SO should bring:
    1. Original marriage documents, translations and certifications.
    2. Formal, long form birth certificate.
    3. Copies of any divorce records or death decrees of former SO(s).
    4. Passport, with an expiration date of no earlier than 6 months. Try to have more than 6 months before expiration.
    5. Police certificate with "Nothing" written on it, indicating no criminal record
    6. Fingerprints (consulate will instruct you regarding how, when and where these will be taken). There is a fee for this.
    7. Medical exam results (consulate will instruct you regarding how, when and where this will be taken). There is a fee for this. Make sure you get a copy from the medical examiner.
    8. Passport type photos of each of you. (consulate will instruct you regarding these)
    I made a list of what I've seen other people say their SOs were asked at consulates. Make sure that your fiancé can spell your COMPLETE name.
    Possible interview questions:

    Has s/he used any other names?
    How many times have you met?
    When and how did you meet?
    When was the last time you were together?
    How long have you known each other?

    Oh man, I have had one heck of a weekend!! For the last few weeks, on Fridays especially, I've started getting REALLY down. This weekend was probably the worst of it. I actually had a full blown panic attack earlier today.
    So I came home and I was talking to my fiance, Tom, about it, while he was on break at work. And I hung up and asked him to call my mom and tell her what happened so that I didn't have to. So 10 minutes later, I hear my phone ring, figuring it was my mom, but it was actually Tom, and he just said "WE GOT IT" and I was silent. And then I was like "That's not funny." and he goes... "No, I'm not *!@ting you. I just got off the phone with your mother, and I checked my email... and we got it"
    And I immediately went to the website and checked our case number, and I was like, shaking and crying and freaking out.
    Holy #######. I can't even believe it.
    I swear it was just USCIS playing tricks on me, wanting to see how far they could push me until I absolutely broke. LOL.
    Seriously... we were "officially" approved as of Friday, and I went through SOOOO much drama between Friday and today, mostly because of my insanely melodramatic moods. That's just karma kicking me in the butt for something I must've done wrong at some point

    4am - i woke up to get ready
    6am - I arrive at the Manila US embassy
    6:30- security are checking our bags etc.
    6:30 to 7am- we are on the first line for cheking our DS 156,156k and 157 forms + the passport
    7am - we are waiting for our number to be flashed on the screen..
    9am - my number flashed for finger print (i was asked to go back to my sit again)
    while waiting for your number pls prepare your , birthcert, cenomar, nbi , pictures of you and your fiance , affidavit of support, income tax return and w2.
    9:30 - filipino pre screener.. (she is very nice to me) she smiled and i felt very relaxed.. she asked me few questions
    why you correct your name / whyyou change your last name ( i said because all my documents are in my mom's maiden last name so i decided to remove the last name which is my foreign dad's last name to my mom's maiden name so that all my documents will be on same name)

    then question and answer begun .. this is it..i stayed calm and friendly..

    then he never look at my pictures or my fiances hotel etc. he just ask those questions and said " everything seems to be in order please go back to your sit and wait for window 72 to call you for the next step" i jumped into conclusion that i thought i am lacking some documents because of my corrected birthcertificate but the CO said "HAVE A NICE TRIP" i was like :OOOOOOOOOOOOOOOO do i have to ask him if i am approved or not but he already said have a nice trip , i return to my sit and wait for window 72 to find out, so when the guy in window 72 call my name he said that my visa will be deliver at home and i can go home now" i wanna cry but everybody is looking at me because i have the biggest smile at that moment hehehe.. I am so blessed God guide me all the way on this process,, thank you Lord for the wonderful plan you have for me.. my interview went veryyyyyyy smooth... ty vj and good luck to all :dance:

    When you first applied you used the K1 visa as your "proof of legal status", which was invalidated when you got married (once you get married the K1 visa is gone). Then they told you to use the I94, which was close to expiring.
    The way to get an SSN when entering as a K1 is either:
    A) before getting married using the K1 visa OR I94
    B) after getting married using a valid I94 (more than 1 day of validity)
    ** This is information I got from the SSN office, who told me my I94 was expired when I tried applying in my married name. I'm not sure if the part about the I94 is accurate or not because it's hearsay**
    So yes, now you need to wait until you file for AOS. I had a similar problem with my SSN. I applied and received an SSN in my maiden name prior to our marriage. I then tried to change my SSN to my married name (after both my K1 visa and I94 expired) and they denied it because I do not have proof of legal status.
    Unfortunately you kind of got screwed over :/

    It is a sticky situation but there is something he can do.
    First of all, he should file a complaint with the USCIS for he entered in good faith in what turned out to be a fraudulent situation. His ex-wife is liable for she is the one who filed the initial paperwork, even though they were already married. As the US citizen, she is the one who initiated the fraud. Add extortion and mistreatment to the basked and he may have a good case against her and take her to court.
    IMHO it would behoove you to speak to a lawyer who can advise you what his status is in the eyes of the USCIS in regards to his marriage. A lawyer can advise you if the divorce he obtained here in the US invalidates their marriage in their home country as well or it may turn out that the marriage contracted here in the US should be deemed null as a result of the previous marriage. If that should be the case, he should consider seeking nullification of his US marriage, and returning to his home country to obtain a divorce there. That is a requirement if he had any plans of marrying you at some point.
    In the event his divorce here clears him from his previous marriage to her, you can marry him here, else he needs to go back home and get that marriage dissolved. Once that is done and he is free to marry again, you can marry in his home country. After you're married you can file for his CR/IR which will include the filing of a waiver for the ban to which he is subjected as a result of his overstay. For spouses, the waiver is almost a formality and provided he does not have criminal record in the US, his crime being none other than overstaying, the waiver should be granted, for separation of couples is deemed as a hardship, for obvious reasons. It is uncommon that a waiver be denied to a spouse with a clean police record. I don't think he can resolve his situation without leaving the US to re-enter as a legal immigrant, but there may be something in his particular predicament that might be brought before a court in the form of an appeal. You know lawyers, they sometimes pull rabbits out of their hats. However, if he has to leave, his case is better served by his leaving on his own volition than under formal deportation proceedings by the USCIS.
    I don't think there is one simple straight answer to his situation and I would definitely begin by talking to an immigration lawyer. It may seem daunting with so many variable, but if you work out an action plan and tackle one goal at a time, there is no reason for you not to be optimistic and pursue a life together.

    Good Evening Everyone,
    I was feeling a little down today and I thought I could express my self a little on here. Seeing as most of you have found yourselves in similar situations, I thought I could write a little bit here to remind other people (and myself) that we are not alone. I am really missing my wife these days. We were married on 12/9/2011 and I have only seen her a total of 32 days since we first met in June of last year. We are in the final stages of the visa process as I just sent the actual Visa application on 8/2. I guess I'm just feeling very lonely today and missing my wife terribly. I hope anyone else out there who finds themselves in same circumstances that the process goes quickly and well for you. Wishing you all the best of luck. Goodnight and Good Luck.

    Went to the interview for my K-1 and my fiancee came with me. When I was called to the window, the consulate pointed to my fiancee sitting down and said she should come up to the window also. (She had seen the photos of us. She asked us:
    When did we meet?
    What was I doing in the USA at the time we met? (I was working on H1-B which I'm sure they knew)
    How did we meet?
    Where was it?
    What attracted me to her?
    What do I not like about her?
    She asked my fiancee what she loved about me.
    What kind of work do you do? (she asked both of us this even after looking at the i-129 why would she ask my fiancee this I'm not sure?)
    She asked if we had been together since we met. (we broke up once and told her about it)
    Why did you break up? What made you get back together?
    How did you enter the USA all those trips? (on VWP - to which she said "oh that's right I was wondering how you entered without a B2" I wasn't sure if she was serious, she forgot about VWP i guess?)
    Did you get her a ring? (My fiancee tehn proudly showed her the ring, she seemed uninterested)
    Where did you buy the ring?
    Did you buy if before or after you applied for the K1?
    How did you propose?
    Do you have wedding plans?
    How many people will be attending your wedding?
    What date do you have set?
    She then looked through the paperwork and a few more photos. She took my fingerprints and then said "Everything seems to be in order, congratulations your K-1 visa has been approved, we will contact you when it is to be picked up, in about a week or so. Have a nice day"

    I just wanted to post this info for others who are due to have their K1 interview at the London Embassy. The interview letter I got sent me to a web link where it said I should pay the visa fees on the day at the embassy. I was expecting to call the expensive phone number and pay in advance, but the letter said otherwise so I went with that. They only asked for my appointment letter and passport on entry - got in no problem without the mrv receipt. At the first interview stage the lady went through my paperwork, asked a few questions then 'have you paid for the visa?' - I hadn't so was simply asked to go pay at the cashier (2 windows along) then come straight back with the receipt. More useful info: taking you're fiance's credit card details so you can pay in dollars and save on the exchange rate doesn't work - you must have a physical card in your own name since you must sign for it (hey, it was worth a try, I had my own card anyway so paid without a problem). Interview all easy and relaxed. Yay I got my visa approved and get to see my hun soon Good luck to all who are still going through the process.

    Yes its happened to me in the past and somebody here just recently. I contacted the congressman in my district. He found out that it was put in an "Offsite storage facility" instead of going off to NVC. Same with the other poster the congressman was able to figure it out.
    Good luck! Thats the whole problem USCIS and NVC don't seem to coorrdinate, leaving us little guys in the dark.

    I've been looking back through K-1 applications that have received NoA2s It looks like there are a considerable amount of people who are still waiting from mid-may to have their petitions either a) delivered to NVC or b) released from NVC. So there are one of two options here. There is an intense amount of people waiting to hear from NVC or people have stopped updating their timelines. If it's the latter, I'm none too impressed.

    Not at all, 90 days is given so people can make wedding plans. If they wanted to give people time to get to know each other state side, they would do like Australia and provide 9 months or more to get married using the fiance visa.

    Well if you are worried then maybe your paranoia is warranted.. I have many years experience and myself many many past paranoias.. Fraud is an ugly word unless true so be careful when accusing..
    Ask yourself a few question that only you know.. Are you normally non-trusting?? If so then look at your fiancee and ask yourself why you feel this way??? I was burnt before in RP but some due to my own issues which brings its own paranoia.. Just because her sisters did one thing does not mean she will. Mayhe her sisters now have regrets that your fiancee does not want. Dig down why she wants to put her kids in school elsewhere..
    I know I am not much help as this is a tough one. Only you know your gut feeling and what you are witnessing. By all means if this all is not passing your smell test then DO NOT Marry her.. You should talk it out with her. Watch her movements.. Filipinas are not good liars if you peel back layers and are good at cross examining.. I know that sounds bad but this is process of elimination in terms of what is in your mind..

    It tells you absolutely everything you need to know about what happens from now (NOA2) to your interview.
    The NOA2 that you will receive will not tell you anything new. It's basically just the same as the email/status you received. In fact, your NOA2 hard copy will incorrectly tell you it's been forwarded to the consulate, when it actually goes to the NVC.
    Here's a very brief overview of what you can expect. Read the thread in the UK forum for more info or ask questions there:
    1. USCIS will forward your approved petition to the NVC. NVC will forward your case to the embassy. This can take about a month so basically, you wait 5ish months for the NOA2 and get all excited to wait another month LOL. But, you can save time in preparing for these next steps.
    2. Call NVC in 15 business days to get your case number. You don't have to do this but people like to, to make sure everything was received on time and there's no other delays. There can be some hold ups at NVC, but it's not common.
    3. After the NVC stage, the London embassy will physically mail a piece of paper to the beneficiary that says "Fill out these forms and send them back to us." They won't even mail you the actual forms, you have to go online and get them yourself. The only useful thing about this letter is that it has your case number and it means you can start moving forward. Also to save time, here is the website link that the letter will direct you to: http://london.usembassy.gov/iv_15.html Read through the process and you can even start filling out the forms already since they need your employment/school history, etc.
    4. Once you have the "packet 3 letter" you can schedule your medical exam with Knightsbridge Doctors. You need the case number on the letter.
    5. Mail back all the forms to the London embassy (you don't need all the supplemental stuff on the DS-156K or the photo, just mail back the forms).
    6. If you haven't already done so, have the beneficiary get the "long form" of his/her birth certificate, police certificate, etc., all the supplemental things noted on the DS-156K.
    7. Once all that's compiled and you have your medical exam date, send the DS-2001 with a cover letter to the London embassy.
    8. The embassy will mail you back a letter with your interview date.

    There's been many similar threads started in the last week with the topic I got my NOA2--Now what?? If all the questions are in one thread, people may find the information they need more easily. I'll start off with some general information specific to London K1s.
    Advance preparation for the London part of the K1 process
    When your NOA2 is near, it’s a good time to start your preparation.
    Petitioner:

    Order your tax transcripts. Only the most recent tax return is required, but you can order three years at a time for free from the IRS. Tax transcripts are summaries of your whole tax return provided free by the IRS. They can't be faked because it's a copy/summary of your whole tax return picture, basically certified by the IRS because it's issued by them. That's why you don't have to include any 1040, Schedules, W2s or 1099s if you send a transcript. They are free from the IRS. Transcripts take the place of sending a complete tax return.
    If you call 1-800-908-9946 (the transcript line) , there is an automated system for ordering transcripts. You'll have to enter your Social Security number and the numbers of your street address. It will generate an automated request to mail your transcripts. You can also order online on the IRS website http://www.irs.gov/individuals/article/0,,id=232168,00.html
    Start filling out the I-134 Affidavit of Support. It will have to be signed and mailed to the UK the slow way. Get familiar with the form. When the NOA2 is received is a good time to finalize it with the supporting documents and get it in the mail.
    Don't obsess printing Skype logs, emails, photos, or Facebook status. London does not want to look at that. Really they don't. London does not want to see a copy of your I-129F petition or NOA2. They got that in the file from NVC.

    UK beneficiary:

    Get some passport photos taken. You will eventually need
    2 US sized for the Embassy
    1 UK sized for the police certificate
    1 either size for the visa medical exam.
    (and for AOS in the US, 6 more US sized photos)
    You can take your own and size it using this uploader tool from the Dept of State. Scroll halfway down the page. http://travel.state.gov/passport/pptphotoreq/pptphotoreq_5333.html Save the jpg file and print at home or at a photo place. Also available at Snappy Snaps, Photo-Me booths, Jessops, Gould's Pharmacy (by the embassy), near the Bond St Tube station (Oxford St) which is closest Tube to the medical exam.
    Go to your NHS doctor and get the immunizations you will need for Adjustment of Status. You can get a K1 visa without having any shots, but you will need them before AOS. It’s really wise to take care of it before getting to the US so you can aviold civil surgeon hassles and $$$. Many NHS doctors will do them for free, but they are not obligated to do so for immigration purposes. If you had these shots as a child, Tdap/Td must be no longer than 10 years ago or you have to do them again. Get the shots documented by your doctor to take to your visa medical exam. Here’s the shots needed for 19 through 59 years of age:
    Td or Tdap - Maybe not available in the UK, so get DT, DTP or DtaP and it will be accepted for AOS
    MMR (if born in 1957 or later) Get a second shot 4 wks later if you have time
    Varicella – Not routinely given in the UK ; a history of having chickenpox excuses you from the shot. They take your word for it at the visa medical exam.
    Influenza - During flu season only, October 1 through March 31. This was a new recommendation dated November 2010 for all ages over 6 months. Older lists will say flu shots for over age 50. It changed.
    Order your police certificate. It takes some preparation because you need a passport photo signed off on by somebody officialish who’s known you two years. Here’s the application. Read the instructions. A police certificate is good for 12 months. Must take it to medical exam. http://www.acpo.police.uk/documents/Application_Form.pdf
    Look at your passport and make sure it will have 8 months remaining after visa issuance. If not get it renewed now. If you've damaged it or gotten it wet, it will need to be renewed.
    Study the list of original documents London wants you to bring to the embassy and get those in hand or ordered. http://london.usembassy.gov/application_documents.html
    Make photocopies of any document you want back. They will verify the original and file the photocopy.
