  1. If they say 'what is your reason for travel' just say 'vacation' (true). The less details you give the less they have to pick on. In my opinion so long as you tell the truth and embelish as little as possible there shouldn't be a problem (unless you've spent too much time in the US in the past 12 months).

  2. I read this following quote a while back. It's from this site in the Visa FAQ. has to do with surrendering i-94. maybe not all that helpful but i post it. Information of it is out there that you have to.

    A...There is a way for a K1 visa holder to do this, but only if you are not married yet. After marriage, you must have Advance Parole.

    If you DRIVE into Canada or Mexico (not fly), and if you do NOT surrender your I-94 (which is normally surrendered upon leaving the United States), you can re-enter the United States before the expiry date on the I-94. One newsgroup participant did that in early 1999, when he was required to take his K2 kids back into Canada in order to comply with child visitation requirements. He received conflicting answers from USCIS (INS) when researching the issue. He left and re-entered the US at the same POE (Detroit, Windsor Tunnel), and consulted with the USCIS (INS) folks there before doing it.

    I think when he returned they should have told him about surrending it. doesn't look like ur fault.

    Hopefully you don't have a problem. good luck. I have never had a i-94 and don't have evidence at all for leaving the states from any of my visits as i had no passport and didn't fly. i'm from canada and took the bus. I also hope this isn't a problem of proving I left at in a certain time.

  4. On the plus side with her being approved for tourist visa, we have more evidence to show to USCIS. :D

    This is a good idea. I wish I had of known about k1 requirements before my visits so i would have been more prepared for what they ask in evidence. I would use the visitor visa as your meeting in the last 2 year requirment to gets lots of primary and secondary evidence. you will know ahead of time of whats needed in detail and this will be less stressful when u file the petition, if thats the route you choose to take.

    To Lynne14: If your planning on a febuary wedding you still can do that with a k1 since that is 10 months away. petition approval takes 1-3 months and visa approved is about 4 months after that (i dont know uk approval times.) You would still be able to have your UK Wedding since it is a year later and you could get AP well before that and likely greencard by that time. downside is after civil marriage u can't return to uk in a month. have to wait for AP approval or GC.

    I'm from Toronto. Our weather is pretty much exactly the same! It's not like Canada is cold year-round but some Americans seem to think it is!

    That's another one of my favourites. My fiance is from Connecticut and I'm from london ontario. The weather is practicly the same since its almost straight east to get there, but I get asked if I like the warmer weather there too.

    I have heard a funny story from a guy from Canada was across the border and saw another guy, an American, that had ski gear on the top of his vehicle. He asked him where he was going to ski. The American replied saying he was going across the border into canada to sky. This was in the late June! The American wouldn't believe him that there wasn't any snow in Canadian when he crossed the border. LOL. true story.

  6. The oot and aboot thing irks me too. I have noticed (I work for an American company serving Americans) that Americans tend to say Abowt where we say about. I have people say to me on the phone oh i can tell you are Canadian by the way you say aboot...#######?? No I don't!

    Totally agree. I have been told that too. No one Canadian says 'aboot' either. I would like to know where this started. When I first went to the states to meet my now fiance all his friends asked me to say 'aboot'. It's 'ABOUT' Damn it! American stereotypes....... :no:

  7. It says on the NOA2 till when it´s valid, it should be a expiration date on the top part somewhere.

    I saw the expiration on the notice (7/31/06), however I am unsure what it means. Does it mean that the request for K1 visa has to reach the foreign consulate by then or does it mean that my fiance must receive the K1 visa from the foreign consulate by that date.

    Generally 4 months, so im guessing you were approved march 31. it has to reach the foreign consulate by than. The interview can take longer than that to get and if it no fault of your own, meaning you sent in packet 3 and such and its just taking them a long time to schedule the rest, they automaticly extend the date past the 4 months. It's been mentioned on here that you can also write to them requesting an extension. So no you do not HAVE to receive the k1 visa by that date. If your consulate processing times are generally less than 4 months you shouldn't have to worry.

    ah since ur profile says verment this quote seems a little high. :whistle: Vermont is normally 30 to 45 days til NOA2, unless your like me and get a RFE. Congrats on getting to go through the quickest service centre and noa1.

    That was pretty rude. Just a "Thanks, do you know if the same applies to my embassy?" would have done.

    If "maybe" or "Im not sure but..." was acceptable enough,then I would not be here posting a question SPICIFIC to K1 Fiance Visa in GuangZhou China.

    Nobody here owes you an answer. Remember that first and foremost. If we are not sure of what information you need, our general philosophy is that "more is more" - even if it's not directly relevant to your embassy.

    I suggest that if you don't like this approach that you pony up the cash to ask your embassy because although you say they offer no help, there must be someone who can tell you SPECIFIC to that embassy - which NOBODY can do BUT that embassy.

    Hi, I live in London, Ontario and I'm going through Montreal. your lucky u live in the same place as consulate. Yes our dollar is going up and I'm sooo glad. I cheer it on everyday, hoping by the time i leave it will be equal. fat chance but i hope.

    I thought that the answer would be like what meauxna said. It would be better for someone your american fiance knows to co-sponser and i have heard it looks better if that person lives in same city or area.

    I was wondering if my sister's husband can co-sponser me. He lives in Canada with his wife, but he has dual citizenship, American/Canadian.

    Can he sponser me if he doesn't currently live in the USA? If so, how do we calculate his income? Can we calculate it in Canadian funds?

    ok so i just re-read this and you are not the american, and you would probably know the exchange rate and will be loosing a lot too when you move. I'm not going to dig myself a hole as i could be wrong and post about co-sponser.

  13. By the sounds of this you would just apply for AOS since you didn't enter the usa with the intent of getting married.

    It's perfectly legal and accepted to enter the US with the intent of getting married. It is intention to immigrate that can cause problems and is illegal.

    Ok I said the same thing here as englishsammy "you could just get married and just adjust status, you came to the US with no intent to marry (student, work visas etc) so I don't see why you would have any problems." so why is what i posted getting centred out like i said something that wasn't right? how was I not right? he didn't originally get a visa with the intent to go there and marry someone. he met someone afterwards and as such could adjust staus with no problems. If he knew before getting a non spousal visa to the usa that he was going to marry a usc, but didn't go with that type of visa, is that not misrepresentation and considered illegal? your seriously confusing me. i feel as if i was misquoted, cause what you said didn't appy to the situation i was talking about. I'm really sorry if I'm completely out to lunch here. I'm not trying to be a b*tch.

    All's cool :) not centering you out at all........englishsammy's post was after mine and I would of posted the same to that. It is not even misrepresentation to enter the US on a visitors visa or VWP with the intent to get married. Many of us have done that and returned home for the petitions to be filed and apply for a visa. It would only be misrepresentation and illegal if one was found to of had intent to immigrate if one applied to adjust status. So the last part of your post is correct. It just confuses members though when they read "with the intent of getting married" Not trying to be picky at all and I apologise if it came across that way.

  17. Wow, You guys are like 'oh my God! He wants a green card' It's hilarious. But thank you for all your comments. Here is the situation: I am a guy wanting to marry a Beautiful USC, A girl I met a few months after I arrived, So yes, it is for love, (actually her birthday is next month which is when i shall propose, in some big romantic way :) After leaving my studies I was employed by a Diving company, (I trained as a commercial diver) and shall be with them for many years I hope. I will automatically apply through them for my visa form (whichever number it is) for continuing employment. Apologies for not making it clear before, but I work 12 hours a day seven days a week and I'm very tired. I'll try the guides, as indicated, but any further help would be great

    By the sounds of this you would just apply for AOS since you didn't enter the usa with the intent of getting married. If you went k1 visa route you wouldn't have leave and could do it when you are there until you have your interview, but when you enter on it you can't work until you get your EAD and i think this would be a problem in your case since you already have a job in the usa. it can take 1 or 3 months to get the EAD.
