  1. His should be pretty simple, due to my own overthinking I thought it wise to pay for a consultation with a lawyer. In reality his case is very simple. We haven't been out of the country since 2019, havent moved, he's had the same job... we're pretty borring. However I know myself so I thought it best to talk to someone beforehand. I made the apt but I am not sure we will keep it. The annoyance of the wait might push me to just forgo the lawyer. Or find another one if the wait is truly excessive. I don't know maybe its normal...
  2. I am an overthinker... Lets just preface with that one. My husband would like to just apply for the N-400 and not be bothered with an attorney However, I had some specific questions that I just wanted to go over with an attorney so we agreed to find a lawyer and do a consultation. Finding an attorney proved to be a frustrating process - yes there is the database I can look up, however I was hoping for a referral. I got a few referrals, however none of them worked in naturalization. I finally found someone, emailed her - liked how she responded in the email (personality etc) and called today for an apt. 6 weeks would be her next available apt for a consultation which seems like such a long time away and now I am questioning if this is even worth it, if I can put some of my overthinking to sleep and we can move forward without it. My husband's case is pretty simple. I was hoping to have put in the application before then. Is 6 weeks excessively long (i've consulted with a different type of attorney previously and I was able to talk with them right away)? Also if anyone has worked with an attorney in the greater Philadelphia (pennsylvania) area who works in Naturalization and you liked your lawyer - let me know Thank you
  3. Ok so no 'Just Answer' Has anyone talked to an immigration lawyer ? Is there any paid online service where you can talk to an immigration lawyer or do immigration lawyers do paid consultations? I don't need them filling out the form or submitting it, I would just like to verify a few things.
  4. With that being said - am I overthinking about the traffic incident AND the secondary inspection - do they need to be mentioned on the application? Thankfully its not ME who is doing the interview its my husband and he is cool as a cucumber with all of this.
  5. So not detained - but would it be 'confined' ? Does anyone think we need to include the secondary inspection? Does anyone think we need to include the traffic incident and go to my insurance company to get the old letter?

  8. Pertaining to 'have you ever been detained' Question. What is the definition of 'detained'? We were traveling back from visiting family, my husband was in the midst of getting his conditions lifted from his green card and we were traveling with his extension letter. At our first port of entry back in the USA the immigration officer pulled him aside to verify the letter. I was in the hall waiting - he was in the office. They asked him a few questions and sent him on his way. The question reads in section 9. 15b. Have you EVER been arrested, cited, detained or confined by any law enforcement officer, military offical (in the us or elsewhere) or immigration offical for any reason, or been charged with a crime or offense? Does our situation match the definition of 'detained' or 'confined'? We didn't get any type of receipt so I wasn't sure how to answer any of the boxes provided for more information. No crime was committed - they pulled him aside to verify his extension letter.
  9. Yes - I guess I got hung up on the 'seriously injured' part. I don't think she was seriously injured but i'm not sure how they are defining 'seriously injured' . At this point I can call my insurance company to get a copy of the letter they sent us in 2017 (I am only guessing it was 2017 I can not remember), if they have record of that. I don't know how long they keep records -do you think this is necessary or overkill? The other person did NOT continue to pursue anything with my insurance company (to my understanding) There is no police record of this whatsoever.

  11. Now I'm confusing myself - i'm referencing the instructions in part 9.... on the actual form N-400 there isn't ANYTHING that lists traffic incidents. I do have another question - in part 9. 15b - detained for any reason? Once we were stopped at the first port of entry coming back from visiting family out of the country - We were waiting for his conditions to be lifted and we were traveling with his extension letter. They pulled him aside to verify his letter and ask him some questions. Once verified we went on our way and continued back home without incident. Does that count as 'being detained'? i'm unsure how to then fill out the questions ' what was the crime or offense' no crime - they just wanted to verify his letter of extension. This was years ago... maybe 2017. It looks like we would say 'yes' he was pulled aside by an immigration official to review his extension letter - My issue is, in the area to give more information is all says 'what was the crime or offense' date of the crime or offense, date of conviction, place of crime or offense. No crime... no offense... they just wanted to verify his extension letter. I'm sure I have his extension letter to verify the year but I would have to dig for it

Going over the paperwork - i'm the citizen my husband is applying - he's never had a traffic ticket - I taught him to drive - shortly after he got his license he had a fender bender with someone - no police called, insurance was exchanged - 2 years later she submitted to our insurance that the incident aggravated some existing back issues (If i remember it correctly). Everyone was wearing their seatbelts. From everything I understand they decided NOT to pursue anything further. (the incident happened around 2014 or 15 and the letter came nearly 2 years later, indicating the statute of limitations was nearing and I don't even know if I have that letter from my insurance company any longer ) My question pertains to the crimes and offenses area. It states if you have ever been in a traffic incident, you must provide documentation of traffic incidents only if the incident: 1. involved drugs or alcohol 2. Led to an arrest; or 3.) seriously injured another person. In my opinion, my first inclination is to say no - she was not seriously injured- just want to make sure we are answering things correctly. If needed I could contact my insurance company. don't want to go overkill here just want to get the questions correct.

Thank you, I am a maniac this week - I got all stressed out just now because I almost filled out the form incorrectly (effective date of change of address - I am so tired I almost put today but thankfully I always download and read the accompanying instructions) - Then I freaked myself out wondering if we put the wrong date when my husband filled out his AR-11 but I just checked the actual form and they don't have an effective date so there is no way we filled that one out incorrectly. There aren't even instructions and its basically impossible to mess up . Just a rough rough week, I obviously want to make sure things are going smoothly with naturalization.
  14. So I'm the spouse - husband is studying for naturalization. I don't know how I didn't know about the I-865 as his sponsor. I feel like an idiot. Since we've been married we moved 2x - one of those times bought a house...etc. Never filled out an 865. I'm assuming I should just fill it out now. Any repercussions for forgetting? I feel like i'm going to be sick.
  15. We will probably file online. He's been studying for his civics test and wanted to wait until he's 90% there , he's very close to it so he will probably apply in the next few weeks. I just downloaded the instructions for filling out the form and we are both physically (and mentally) gathering docs. Thank you for your advice - I was thinking that the general provision makes the most sense - spousal seemed to be hinged to being here for 3 years and its been like 11 at this point!
  16. My husband is preparing to apply for naturalization and we are gathering necessary documents. We can't find his old passport, his new one was issued in 2023. He hasn't been out of the country since 2019 to visit family but without the passport how do we prove that? We don't think he threw it away - so we're still looking but its a puzzle. In that time we've bought a house and have continuous tax docs (And he has been at the same job since 2014). How crucial is it to find the expired passport and what would we do if we can't find it?
