    Yes it will impact her application since it just recently happened.  She is most likely facing a denial.

     

    Also largely depends on the outcome of her case and what the final disposition is.

     

    Worst case scenario is she is denied for the N400 since it happened within the past 3/5 years and the IO determines she does not fit the Good Moral Character requirement, and/or she is placed on probation, and the N400 is denied because the probation period is still open by the time the new interview date rolls around.

    You need a lawyer.  The definition of crimes of moral turpitude (the kind that counts against good moral character) is complicated.  Did the treatment involve confinement in an institution?  Bear in mind that Form N400 has a question about that. 

    It does not involve confinement in an institution. More like going for a weekly checkup. Out-patient treatment. Psychiatrist appointments.

  3. So 6 days before my wife's citizenship interview, she gets arrested. Four months later she takes an "immigration safe" plea deal. Plea deal involves accepting a misdemeanor charge in exchange for a mental health treatment program. Misdemeanor is for reckless assault. Her citizenship interview was obviously missed but she gets a year to respond to the letter and ask for a new date before the money invested (in the application) is lost. It's her first record ever. First time ever getting in trouble with the law. Psychosis/mental Illness is a !

     

     

    Should she ask for a new date and take the interview?

    Will they run a background check before setting a new interview date?

    Will they run a background check if she passes?

    Does this misdemeanor prevent her from becoming a citizen, or does she have to wait a specific period in order to apply again? If so, how long?

  4. When filing the removal of conditions, you receive a letter saying something to the effect of: Your Green Card is extended for a year. I cannot find that letter, and we have an incoming trip to Dominican Republic in July. I filed in the end of August and had the Biometric done around the middle of September. We have yet to receive anything from them, so I don't know if we will receive the new Green Card before we leave or not. What can we do? Can we request another letter from USCIS about the extension of the expired Green Card or?

  5. Try walking in...go in person and explain that you missed the appointment. It works better than calling.

    Your words....."My $%@%# wife" tells me you're awfully mad at her. Things can happen. Try not to fight about it. Sticking together (even when you're angry) is the best advise I can give.

    Yes I was mad, more worry than mad. I have since calmed down and apologised to my wife. I have asked her to get ready to go tomorrow. Hopefully they will take care of her or re-schedule :( Thank you for the advice my friend.

  6. Hey guys! Long time without posting, but I always read the comments people post about there updates.

    I guess it was our time, we finally received my wife's green card today. We filed on the 27th of December, 2012 adjusting from a K1 visa. We decided not to file an e-request, and just wait our time.

    We also did not receive any heads up by email or text message.

    Upon looking at the Green Card, I noticed that it expires in 2 years (2015) and I was wondering what we needed to do to get another one?

  7. Well that is what we thought, too. But we didn't foresee that the clerks of the SSA might be incapable of doing their job properly... We went to the SSA again because we didn't receive anything from them after our last visit and it was already more than a month ago. We went there in the first place for the name change right after we received the marriage cert and well before my I-94 expiration. Now, one month later without any move by them, my I-94 is within the two weeks expiration frame. I think now the same thing happened to me as to your wife. I think the clerk who served us when we went there for the name change a month ago screwed something up. They said it is out of their hands now, they have sent it to New York, where my data is checked (I thought DHS has done this already for the visa and is probably doing it again now after the biometrics) My records cannot get any cleaner, and I have been checked by probably every authority that there is in the last year, and now this clerk tells me that maybe they need to do a deeper analysis on me because it takes so long? :blink::bonk: Funny thing was that I was able to get my State ID and driver's license (yay, Germans don't have to do a test!) It's in my maiden name, but I don't care, at least I have something now. And I thought Germany is awful with bureocracy.

    So my AOS papers are now in my married name, and my State ID, DL and SSN are in my maiden name. The GC, EAD and AP will come in the married name. Maybe they will change the name on the SS when I show them the EAD.

    That is what i'm hoping as well for my wife's sake. I like to have everything in order. :wacko:

  8. My I-94 hasn't even expired yet! Like I read in another thread, we probably just have had to deal with braindead people at the social security office. I think our guy was still learning, we should have known better and ased for someone else, but we thought this was a standard thing. The funny thing is that everything USCIS is working perfectly fine with my new last name. We will go to the SS office again in a couple of days. And we will again bring the proper copy of the marriage cert with us. Let's see what can be done, maybe with another person ...

    Biometrics yesterday was a breeze for me too, I just didn't like my picture, even if I was allowed to take a second one :hehe::lol:

    The I-94 is the only Immagration status (while valid) that our SO's have. Until of course they recieve their green card (and maybe the EAD). So, while the person attending us at the SS office had no clue what-so-ever (neither the people she explained the issue to) as to why/when my wife would be able to change the last name on her current SSN, I quickly figured it out. I explained it to her, and she noded as if she knew it all alone. She stepped out for a bit to chat with her co-workers. Came back saying "yup, it is just as I thought. She is out of status because her I-94 has already expired". I briefly rolled my eyes in slight humor and said thank you. To be fair though, she did try her best, but the system wouldn't allow the expired I-94 to go through. So if your I-94 is still well within 14 days before being expired, then you can definately change your SS card. :thumbs:

    I have my biometrics appointment tomorrow. I know it won't be anything too exciting, but still it feels good that the ball is rolling again.

    My application also went to the NBC, and it also says Initial Review for EAD and AP and Acceptance for AOS. I thought this was a little weird, like some of you. But I am a little less worried now that I have seen that others have the same statuses. We received all three NOA 1, so I hope everything is processed as it should.

    We also sent in the tax report from 2011, fingers crossed all goes well ... Like probably everyone else, I would hate the dreaded RFE :wacko:

    Another thing that is a little strange with our case is that we applied for a SSN right when I came, and I got it, but that was before we were married. After the wedding, we went to the office again and wanted to change the name. But they said they couldn't do it, the Homeland security has to do it. They said they would take care of everything, but now it's been 3 weeks and we haven't heard anything. Also, my AOS papers are all in the new name. I hope, all works out and I wish we would have waited with the change of the name on the SSN till the AOS was through :bonk: Anybody else encountered problems with the name change and the SSN?

    On the same boat as you. Went with my wife to change her last name after we got married and we were told it wasn't possible because of the I-94 being expired. We were also told to wait until she has her green card or maybe even witht he EAD in order to change her last name on the SSN.

  10. Yes, EAD is a temporary work permit (valid for a year once approved).

    Once the green card will be approved, her EAD will be void because the green card is also a work permit.

    I suggest that she applies for AP too (temporary travel permit, I-131 form), it's not much more paperwork to do, and it will be approved with her EAD (the result is an EAD card with an AP note on it). With the AP, she will be able to travel while her AOS is pending. The same way as her EAD will let her work while AOS is pending. Also, applying for EAD/AP is free when applying at the same time as AOS. It will takes 2-3 months to be approved.

    Concerning timelines, you won't find much help. Her case may be chosen to be waived from an interview, and there's no timeline available for those cases. It just takes months (it's long). If her case is scheduled for an interview, you can look at timelines from other VJ members who went to the local USCIS office in your area.

    All in all, it's really difficult to know how long it will take to be processed, as you can't know when filing if there will interview or no. It may be a few months, as it may be a year. That is why it is a good idea to apply for EAD/AP.

    Quite a bit of work to do for you! But the tax part is your priority right now. So, good luck! :)

    Definately alot of work ahead, but as long as eveything is organised by order, than it's no sweat. Plus I already got all the annoying paperwork out of the way with the AOS packet. My wife brought me her birth certificate earlier (i'm at work), and I was able to have it translated into English. The guy wanted $45 bucks :wacko: oh well, atleast it is now out of the way. I also have to update my coversheet to include a few things I added to the packet, like paystubs for both my jobs and what-not. Meh, our SO's should treat us like royalty for all the headache all this paperwork and running around brings! :rofl:
