It looks as though you have recieved good advice after your denial at the embassy, but didn't follow through. We were denied at the embassy as well, and recieved a NOIR (Notice of Intent to Revoke) I got good advice from both NigeriaorBust and Dwheels76, and we just had our second interview and recieved the visa no problem.
Since you've missed your opportunity to rebute the CO's findings, you are looking at a very difficult obstacle to overcome. If you do decide to refile, your case is going to have to be very well prepared. And if you do not include evidence to fight what the orginal findings were, then you will more than likely be denied again. I would suggest you follow the advice given above if you wish to be successful.
It is also very difficult for others to help you unless you get very specific about your case. Without doing that, the help you will recieve will not be the "best" for you. Good luck.

A K-1 is only valid for a year. They are known for holding it before sending it out so it will expire. I would advise filing a CR-1, or you could refile a K-1.

I am so sorry I know exactly how you feel. The CO also gave my husband a hard time about my ex. Our congressman wrote to the embassy and other departments, but we got conflicting reasons to why he was denied. He was handed a blank paper that just stated his case was being sent back. If you need to talk, I'm here for you. I will be home on Sunday. Keep your head up, they can't stop true love.

I feel bad that you have to go through all of this problem in your marriage. I will keep my opinion to myself about your relationship as that is not the question you asked. It is my opinion that if he were to mention any of this to the CO at the interview, he would be denied. I think that the CO will believe that your relationship is for immigration purposes, as your hubby was not faithful and his affair produced a child. You must also consider the red flags you have mentioned and the fact that Lagos is a tough embassy to go through. However, with that being said I do believe that if he finds out the baby is his and he gets approved for his visa, you could then file an I-130 for the child as his/her step-parent. The process will be the same as the process you went through with the hubby. Good Luck to you

Wow, I must have missed this somehow! I want to thank those of you who stood up for our Nigerian spouses in this thread!! I have often seen rude things being said on VJ, it's just sad that it is coming from "one of our own!" I am highly offended by comments made from extremely prejudice people! (they are not worth mentioning) I am very Proud of these people however!!
