please i was denied visa and revoked at the uscis also.i just want to ask,is it a good advice to start a new form I-130 and also what do i need to do this time around,what actually happen is that,they said,i staged all the pictures taken with my wife,i answer all the question given to me at the embassy as if i crammed it,they said the marriage is fraud.am actually confused but still think we need to continue trying.

Well one thing you caused was a BIG red flag when you didn't answer the NOIR in time. They might think now you have something to hide and now you need time to manufacture more evidence. Not saying you are but its something to consider.

Personally what I would do is have your wife move to Nigeria for a good long visit. Coming up with more pics will not help you unless you actually have been there awhile.

How long have you two been together?

How long was her viist?

How many visits has she had to you?

I am assuming you are the Beneficiary?

Saying your evidence is fake is not a good thing and you have quite a fight. You should sit down with a lawyer that knows Lagos and seek their advixe also. A consult wouldn't hurt.

It looks as though you have recieved good advice after your denial at the embassy, but didn't follow through. We were denied at the embassy as well, and recieved a NOIR (Notice of Intent to Revoke) I got good advice from both NigeriaorBust and Dwheels76, and we just had our second interview and recieved the visa no problem.

Since you've missed your opportunity to rebute the CO's findings, you are looking at a very difficult obstacle to overcome. If you do decide to refile, your case is going to have to be very well prepared. And if you do not include evidence to fight what the orginal findings were, then you will more than likely be denied again. I would suggest you follow the advice given above if you wish to be successful.

It is also very difficult for others to help you unless you get very specific about your case. Without doing that, the help you will recieve will not be the "best" for you. Good luck.

Being totally denied on a returned petition raises the bar quite high on any future petition. You will now have fraud markers in you file which means that they will look with suspicion at any future evidence you provide. If you never were given the chance to refute the old petition the consulate had some pretty strong evidence that you were committing fraud much more than staged pictures. IF you truly want help you have give up details about what happened and not just make repeated vague posts about what went on. Something went wrong at your interview or the investigation and you are hiding this . Without the truth you will never get the help you need. I would be careful with Nigerian lawyers some are more interested in your pockets than you getting a visa.

This will not be over quickly. You will not enjoy this.
