Joker69 - They have to give you a decision after 120 days have passed. Don't let them keep you hanging. Have you had a chance to discuss your case with a lawyer from the legal-aid links I gave you some months ago?

Prakash & Meera - I suggest you try your luck with the US consulate in India to get a B1 visitor visa. Tell the IO that you are happy to wait for your GC to be processed, but meanwhile would like to visit the beautiful Rockies and the Grand Canyon, the region where your husband resides. You are being honest and in the event your visitor visa is denied, smile and take it in stride. But seize the rein and try your luck. Trust me, consulate officials are not hardened, emotionless people. I speak with my own experience.

heymrdddj: My suggestion - Please call the USCIS customer service number and insist that you speak to a Tier 2 officer. That officer can give you a better answer to your question. Also that way your Mom can find out what she may have missed or inadvertently gave a wrong answer so she can correct it during her next interview. Instead of being upset, make the call and find out the correct reason.

Since you have already filed the N400, we can only hope that your IO is sympathetic to your case. However, filing taxes is mandatory and you need to have your return transcripts for the past 5 years. Please call IRS and ask them for the transcripts. Its free and you should get it within 2-3 weeks.
If asked, you may have to explain why you did not file tax returns for couple of years.
Looking at your dates, it would have been best if you had applied 4 years + 1 day after your return from the long absence. That would be 1/18/2013. That is just a little more than 6 months away. Worse case scenario, you can reapply then.
However, I hope you get an understanding IO at your interview. Stay hopeful. Good Luck!

Please post the dates you were out of the US. Also, any reason why your parents did not include you or file tax returns on your behalf for those years?

6 months is counted as 180 days by USCIS. And 2012 was a leap year. So this cutting very close, hopefully the OP should be fine.

One day here or there is minor detail. The bigger issue is this -
Have you been outside the US from 09/07/2011 to 03/06/2012 ? That's almost 11 months. How are you going to explain that absence?

My apologies. Yes, I did not realize that. However this is what I found -
You do not need to file the I-131 form and get a reentry permit if you will be outside the United States for less than 1 year. If you have been outside the United States for less than 1 year, you may use your Permanent Resident Card as your travel document.

Its better to apply for Re-Entry permit, Form I-131. Usually, your GC is safe if you return within 1 year, but having the re-entry permit allows you upto 2 years to return. Also it ensures that you did not intend to abandon your permanent residency status.
