  1. If you are not a greencard holder yet then no, you cannot file for your child.

Hi Penguin thanks for response, I am LPR and i just filed my son's Visa" Bringing family members to USA and he was approved 10 months only

after I filed and I have another child also to petition 23 yrs old and is that okay If I file I 130 while me as petitioner waiting for VISA number in NVC for my son?

will not affect the process of my waiting process from NVC? thanks again

  2. To clarify: you can file any time from the 90th day before the two-year anniversary until the date of your anniversary (although you should allow at least a few weeks for delivery and processing: don't try to file the date of your anniversary, or it will be too late).

Don't know when the 90th day before your anniversary is? Here's link to help: http://www.uscis.gov/dateCalculator.html

So on the 90th day before, your "window" opens. You don't have to get your application in on that day, but you must get it in before the date of your anniversary.

    Good luck!

    AJ

    Thanks caeremonarius

  3. I haven't, but those above 21 aren't immediate relatives, so in addition to the processing time you have to wait for a priority date. Here are the current Priority Dates. If you are a US citizen they are in category F1, if you are a permanent resident they are in category F2B. It looks like this month they are up to March of 1998 for F1 or May of 2002 for F2B for the Philippines, so be prepared for a long wait.

Thanks keljop for the info, is there anything I can do to expedite as it is really a long long way as u said

that 2002 will be this year like wise 1998. so after the approval as I can see 2 1/2 yrs in the website it includes all together

the the 10 yrss waiting? this is long way to go :(. HOPE you can share how to expedite. thanks again.

  4. Other than the sealed envelope that she reviewed, what else does she need to bring with her to clear immigration? Does she need the cd with the medical on it? Any documents from st Luke's?

    Thanks

    Dale

Hi cd from st. luke they won't asked anymore the passport is the most important thing for they will stamp

the I 194 in your POE. and a short interview. good luck. welcome to USA

  5. Thanks everyone for the replies. I feel a little better, maybe I can sleep more than 2 hours tonight. I still don't know why I did not find this site before, it would have saved me a lot of worrying and now hassle. Like I said, it took me a couple months before I finally mailed the form because I did not know what to do. After talking to 3 different people at USCIS, and them all tell me I just needed to send in the form, I figured I was good and if needed they would just request more info.

Now, am I better off starting over and submitting a new I-129F form and all the info, following the guide on this site, or appealing the denial?

Maybe I am just jumping the gun and need to wait until I get the letter. I am just going crazy here and needed to sort of talk to someone or get some advise.

Hello, was reading your comments, Once you send the I-129F form ( Fiancee visa-K1) you need also to submit the documents the evidence

that you can support your fiancee and the rest of your documentation that you are a citizen of the USA, it's not all the money

you had been sending to her but like receipts, the e-mails communication, pictures of your visit to her, plane tickets that you were in the Philippines, phone calls, your W2 if you are still working/ retirement -if you are retired, and your payment :)...that's it if you can still add more that's better. Good Luck!

  6. Aloha!! I guess it would be hard for you to get your other child since he is already 21 years old. I believe child on k2 visa should follow within 1 year from the time you came to the US, beyond 1 year, he cant follow anymore.. Maybe other visa will do.. Goodluck!

Aloha! :) thanks for ur immediate response but it will be only 1 year this September 2012 after a year ...I mean my visa for K1 expires Sept. 2012, can I still process for his K2 ...

  7. Good day VJ members,I came here to US as K1 visa now a permanent resident and 2 kids in my DS156 list for under 21 years old children and 1 to follow with me which he came here May 2012.

I would like to ask for an information if my other child can still come here with me as he works over seas and now 21 years old, can he come as k2, during my son's interview in the US Embassy he was asked of this too. Your comments and info is very much appreciated, thanks guys :)

  8. Has anyone here in VJ's encountered this,I filed an AOS for my son and this is what I got

My son is a derivative of my k1 visa and I am confused of this mail that they sent me after

I got last week the Notice Of Acceptance of AOS.

    Request for Initial Evidence.

Submit evidence that an immigration visa petition has been filed on your behalf,

If you are not filing as a beneficiary of an immigrant visa petition submit documentation

in support of your eligibility to become a lawful permanent resident.

Your responses are really appreciated guys.
