  1. The people at the USCIS office or lockbox who received the I90 applications, however, should have rejected them based on this category. It looks like even they had no clue, since they accepted them and cashed the check...

    They can't reject an application that has been specifically filed. People actually do correctly file Form I-90 you know. People who have lost their conditional resident card can file I-90 to get it replaced if within the two year window but not within the 90 day window to file for ROC.

  3. Hello VJers!

    It's been a while since I posted. In any case, my wife and I applied for ROC on April 12th, 2014, so please add me to the list.

    I have one question: My wife's GC will expire on May 8th, 2014 and so far no response from Vermont. Does anyone have any suggestions regarding what action to take if her GC expires and we have still received no response from from USCIS?

  4. Your case has been expedited.

    DO NOT send any more documents to the NVC. Your local beneficiary's us embassy will review the application file once they receive it and send you correspondence. This correspondence can possibly include the date of your visa interview and any missing documents that are needed. Just gather everything (AOS, IV Package, Documentation, Proofs etc...) and hold on to anything that hasn't been sent to the NVC yet. You will be asked to present anything that is missing at the visa interview.

    Now, just wait for your local beneficiary's us embassy to contact you. In the meantime, you might want to be ready to get your medical completed, as you will need that to be done *before* the scheduled interview date.

  5. This is not normal. My wife arrived May 8th, 2012. On May 18th, 2012 we received her welcome to the USA letter and May 22nd, 2012 we had her conditional green card in hand.

    You need to contact USCIS immediately and pursue this matter. Did you receive a welcome letter? If you didn't it is possible that they may have lost your file. It happens sometimes.

    After having 3 prior DUIs and a no-contact violation against him, do you really think it's a good idea to lie to US immigration? Honestly?

    And no, it's not that simple. Your husband will be asked very serious questions about his immigrant intent at his AOS interview if he enters as a tourist and attempts to adjust status. Especially in this case, with his multiple DUIs and what not the questioning will be that much more serious. It is a very real and probable possibility that US immigration will discover his immigrant intent which will qualify as material misrepresentation and is a VERY serious matter.

  7. Also, note here that "certified" does NOT mean "notarized" If you send any copy of any document that is merely "notarized" by a Pakistani official, it will be rejected.

    It either has to be Original or "certified" by the ISSUING authority. This means if you want to submit a certified copy of the beneficiary's birth certificate, you have to get it directly from the cantonment board that recorded her birth. Only that will be accepted.

    Personally, for Pakistan, this is not worth the hassle you have to go through. Just send originals and you will get them back at the interview.

  8. -You will have to file the I-130 petition.

    -DO NOT WAIT. File NOW. Without wasting any more time. The so-called "expedite" for filing from abroad is not officially mandated by USCIS. To this day they deny any expedite exists. This means that even though you will most probably be expedited, don't chance it. Just file now in case you AREN'T expedited for whatever ridiculous reason.

    -If you are expedited (which you most probably will be), you can manually control the speed of your application once it gets to the NVC. You have 12 months to respond to each of NVC's requests. This means you could take your case up until the point where NVC requests an "Application for Immigrant Visa" from you, gather all the necessary items needed for said application and then just not send it in until you're ready. This way YOU control when your application is processed and aren't sitting at the mercy of USCIS.

    -Be forewarned that your wife will need to prove domicile in the United States as well as have income @ 125% of current US poverty level to qualify for your affidavit of support. If this cannot be done, you will need a joint sponsor.

  9. This is just an educated guess, so please don't rely on this and CONFIRM it by calling NVC, but, I believe you can submit your IV package without the PCC. They will either approve it and ask you to bring the PCC at the interview, or, they will issue you an RFE asking for the PCC, which then you can use the RFE letter to request the PCC from the passport office as it will be on official NVC letterhead and have both petitioner and beneficiary's name on it.

  10. Alright. I have to be completely blunt here. Sorry but it has to be done. I don't care if I come out as rude or if it's been said before already (just skimmed thread, didn't read it fully).

    20 year old (naive), unemployed and dependent on parents with less than a decade of conscious worldly experience. *ONLINE* boyfriend from a very high fraud country. She hasn't even spent a day in person with him. Wants to get married first meet.

    I don't care how much you say it is genuine I have a really really hard time believing it. This has fraud written all over it and that is *exactly* how USCIS will view it. You can bet on that.

    Trust me. Listen to people that have given you good advice in this thread. Listen to your parents who I am 99% sure are fully against this. This will not end well for you.

  11. It appears from your facebook pictures (according to the poster above me), that you indeed performed Nikah instead of being engaged. I am not accusing you of lying, however, this is what the CO was convinced of at your interview and is exactly what he will have put as the reason for revocation for your petition. USCIS will be aware of this when they get your application back.

    To top this all off, your "fiance" has taken YOUR LAST NAME. This is a HUGE NO-NO. Name changes are performed after getting married, not engaged. By changing her maiden name to your last name, your fiance is essentially confirming, beyond all reasonable doubt, that she is married to you.

    In light of all evidence above, I suggest you prepare yourself to answer some tough questions when you file your I-130 petition. Although rare, I have read threads about people who did this being barred from the U.S. forever. They filed for K1, got denied, then re-filed for CR1 and during the interview phase they were denied again, permanently, on grounds that they lied to USCIS on their previous application by claiming to be engaged when they were actually married.

  12. If you do not go you will most likely not get a visa. It's as simple as that. Set your priorities. Do you want the visa? Or do you want to keep living where you are living without each other and re-file all over again and wait another year?

    Of course they "requested" you to be there since they can't order you to do anything. But, if you don't comply with them they are also free to do whatever they want, which is, they will probably deny you.

  13. Very hard to comprehend what you are trying to say.

    Are you attempting to inform your local consulate that USCIS has approved your petition after you got denied at the interview? If so, it's useless. The consulate's decision is final now and cannot be overturned no matter if you send mountains of letters or evidence to them. In fact, no one will even look at them. Your petition will be sent back to USCIS who will send you a NOIR (Notice of Intent to Revoke). When you get your NOIR, then it is time to submit more paperwork.

    As for the reason WHY your visa was denied, that information is on the refusal slip 221(g) that they gave you when they refused you. They will not tell you anything beyond that.

  14. HeatDeath is absolutely correct.

    Just to add to this, I think you have such strong evidence of home ties (Mortgage, Job, Horse board) that you will most likely not be denied. However, you have to realize and face the fact that a really minute possibility still exists, despite your best efforts or best evidence, that you could be denied.

    The more you visit, the more your chances for denial increase (at least that's what I've heard). So, I suggest that after you file your petition, you limit your visits to the US to minimize the chances for denial. Visit less frequently than before.

    If you are denied once, then I believe the chances of you getting denied again on a different visit also increase, since the CBP officer will most likely ask you if you were denied and then the reason for it. This will complicate things.

    None of these denials however, will have any effect on your actual petition or later application for Immigrant Visa, although, it is very possible that you will be asked about all of your visits/denials to the USA that occured while your petition was in process (if they occur). So I suggest you have a solid explanation ready for that.

  15. I don't usually like caps lock lol, but in your case, it is certainly justified! CONGRATULATIONS! I can just feel the excitement coming out of your words :P

    EDIT: Just tell your husband to take his passport to the embassy on one of the appointed days are the correct time ASAP and they should keep the passport and hopefully you'll get it back in a week with the visa! Good luck!

  16. Two contributing factors determine the time:

    1. The time it takes for USCIS to get to your case. When they receive your case it is put at the very end of their queue. They will process the applications received before you first, then get to yours. This is first major contributor and accounts for MOST of the delay.

    2. Your actual application. When you finally reach the top of the queue they will analyze and scrutinize your application. What and how much you submitted. Is the application complete? Does it have all the required documents? Country of origin, background checks, family names. Pretty much all of what the poster above me has pointed out, and more, is included here.

  17. Hey Saylin! Wow this is great work! If I had a thread like this when I went through NVC it would have been much easier for me :P Well good luck to everyone going through this in May, you have a powerful resource to refer to now.

    I'd just like to make one small suggestion. Perhaps you can add this for your FAQ as this seems to be happening a lot and people always get confused by it. It happened to me too:

    If you mail your AOS package and IV separately. That is, you pay the AOS fee and mail AOS, but not the IV package. Then most likely a false RFE is generated by NVC. As soon as they process the AOS, their system generates the RFE and sends it over to the petitioner requesting that that the NVC is awaiting an Application for Immigrant Visa from the beneficiary. What's even more confusing is that the RFE only requests PART I of the application. Part II isn't even mentioned anywhere.

    I went through this, and a couple other folks here on VJ posted threads about it.
