  1. Thank you for your reply. which "some" had to be translated?

    the entire document needs to be translated....the "some" i was referring to was "some more rupiah" to pay a person for a translator.

    not sure what she worked out with translator, but we have to pay something for translation and of course a statement about the correctness of translation.

  2. ours went 7 months to get an RFE, then another (almost) 2 months to clear the RFE....now 1 month waiting for NVC to start working, now waiting for them to process the ds 3032...that has been sent since last week (today NVC said allow 20 buisness days to process a ds 3032 and generate an IV bill.....)

    the entire process is so very very slow.

  3. On the EZ Guide Spouse it lists these things for the IV Packet:

    IV Packet a. Bar-coded cover sheet b. 2 Passport-sized photographs of the beneficiary c. Completed and signed form DS-230 Part 1 by the beneficiary d. Completed and 'unsigned' form DS-230 Part 2 by the beneficiary e. Photocopy of the biographic data page of the beneficiary's passport f. Original/Certified birth certificate of the beneficiary g. Original/Certified marriage certificate of the beneficiary and the petitioner h. Original police certificate(s) of the beneficiary i. Original/Certified divorce decree of the beneficiary's prior marriage(s), if applicable j. Original military certificate of the beneficiary, if applicable k. 1 set Photocopy of all the above civil documentsMy question pertains to letter k. Which exactly are considered the "civil documents"?

    i think it refers to having a photocopy of each and every document you are submitting in that package.

    I am sorry to hear that you lost it!

    Can you contact the issuing agency? Perhaps they can re-issue or issue a certificate?

    My wife went to KUA, the gave her a 1 page Certificate (got stamps and seals,etc) stating our names, marriage, etc. Of course in Indonesian. She will get translated, and have a translator statement, and we will mail that to USA (NVC).

    However I do like the idea of sending my Buku Nikah instead of hers. If for some reason NVC doesn't accept the KUA issued Marriage Certificate then we will send my Buku Nikah.

  6. Thanks!! Yes, I definately know about the IRS phone line.. You can be on hold for over 30 mins.. I rather visit the IRS Building, its very convenient for me.. I'm going to request updated IRS Transcripts after I amend my 2009 & 2011 Taxes this weekend..

    i believe you can enter request through internet without talking to someone, but i may be in error.

  7. My case was reaffirmed early this month. I am wondering how long will I have to wait for NVC to contact me with a case number? Does anyone know? I have called twice and both times they tell me that they have not received it yet. And does the USCIS send it to them right away or do they hold it for a while? The representatives that answer the phone say 15 business days which is 3 weeks.

    it took us a month to get NVC number after clear of uscis...approximately

Certified copies of a marriage certificate are accepted by the NVC if they bear the original seal of the issuing authority according to the DOS website, however, there's no guarantee that you wouldn't receive an RFE for it based on what country the certificate is from. In many cases NVC doesn't like the certified copy and sends an RFE for the original (just my personal experience). Keep this in mind.

    Further, your reciprocity by country states:

    "A marriage certificate (Akte Perkawinan or Surat Nikah) is issued by the following offices for the following population groups: 1) Moslem - the Kantor Urusan Agama (KUA - Office of Religious Affairs); 2) all other religions - a solemnization certificate must first be recorded with the Civil Registry office (Dinas Kependudukan and Catatan Sipil). Please note that the marriage is considered legally valid from the date of recording, not the date of solemnization.

    Do you have available something to the effect of above? If so, a certified copy would probably be okay.

    we have Buku Nikah, from KUA....it is a "issued one time only book". they claim if lost it cannot ever be replaced. (Sounds silly, but the KUA appears to stand firm on this).

    I would rather not send in mail (to NVC) a document that KUA has informed me can NEVER be replaced.

    I am hoping that the Civil Registry Office can issue a certificate that I can send to NVC.

    Currently I have a photocopy (notarized) to send to NVC of our Buku Nikha.

    ** I guess the real questions are as follows:

    1. will NVC accept the photocopy exerpts from our Buku Nikah (notarized) ?

    2. if not, will we be able to get a certificate from Civil Registry Office? and IF we can get it, will NVC accept in place of our Buku Nikah?

    3. how to ensure safety of an irreplaceable document (Buku Nikah) if we must send it to NVC ?

    4. (sidenote question) what is it with KUA that we cannot ever get a replacement Buku Nikah if ours becomes lost or damaged?

  9. Then change the name on her passport and take both the new and old passport to the interview. Far easier than changing the name on the green card later and only way to get the visa and green card in the married name to begin with.

    as i understand it, the last name comes from passport....

    so if she were to enter USA with green card with maiden name, you can apply for a re-issue card with married name (and pay more money...)

    also sidenote. i believe if a page 4 endorsement done, then that will reflect her married name and be used.

  10. Is it ok if I submit photocopy of passport with my maiden name on there and not my married last name? Or should I just ignore it and not to include in documents? My passport is still valid until 2014. Wondering what should I do..

    my wife (Indonesian) had a "page 4" endorsement with her married name....so her data page has maiden name....page 4 has married name (passport office made the note and applied a stamp)....someone in your country might be able to tell you if this is possible there and how to do it. that way you can continue using your passport and when getting a new one get the married name.

    Any air tickets / passport stamps showing you were present at time of wedding to prove it was not a proxy marriage.

    Birth certificates

    That should do. However it is always a good idea to frontload your petition with as much evidence as possible.

    for ours, i added my wife to medical insurance at work, added to benefits package through work, beneficiary, started a joint account (which i use to send her money, gave her an ATM card), added her name to lease, sent phone logs,complete copies of passport showing my trips to visit,etc.

    why would you not do this? Co-mingling of accounts seems to be an example of a bona-fide marriage.

    you could just start a new account (defferent bank even) that is joint account

    names on insurance (medical) might be another item to add.

    names listed as beneficiaries would be another.

  13. I finally get the NVC number...log in to pay and find this error message:

    "This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please contact the NVC immediately."

    This process is unreal. Has anyone else seen this error message?

    I called and they said a supervisor would look at it, and it "may be resolved" in a week.

  14. I mailed my congressman asking them to investigate about my case at USCIS which is still on the shelf collecting dust. They cited the logjam at CSC and that they really couldn't do anything unless there was a medical emergency. I then asked about my wife visiting the US on her 5-year tourist visa while her case is processed. Their response to this was,

    "As for entering the U.S. on a visitor visa while an immigrant visa petition is still pending, this action could create a great deal of problems for your wife when she returns to India for her immigrant visa interview. Finally our office cannot support you, if your wife experiences any problems either at the port of entry or at the consulate because she would be in violation immigration regulations if she attempts entry before her immigrant visa is approved."

    I asked what law they were referring to and they responded,

    "NA Section 214(b) state that any applicant who has the intention of immigrating to the United States is not eligible for a visitor visa. In your situation her entry may be interpreted that she is trying to circumvent the immigrant visa process by entering on a non-immigrant visa before her petition is approved and visa processed. If your wife had to go to the consulate for her visa, she would be denied. Although I strongly advise against it, I cannot stop her from attempting the entry – it’s your call."

    Finally I asked "how will this affect her interview when she is called in India?" and they responded,

    "I can’t answer that question – I have only one example where a parent of a US citizen who came on a multiple entry visitor visa and when it came up at the immigrant visa interview she failed to mention the visit but it was in the CBP records. As a result her visa privileges were revoked for life. "

    No lawyer or now government official has remotely advised visting on a tourist visa while the case is pending. I am really losing sleep over this. Searching VJ, there are many couples who have ad no issues but I am just torn on whether or not its worth the risk of added FBI checks or at worst being revoked for life.

    Anyone else in the same sinking boat with no paddle?

    i would imagine most (if not all ) are in the same boat.
