PAPUNMANMU reacted to Chynna/gapamix in On AP due to Divorce Decree
    Hi VJers,
I need your help once again.
We were placed on AP after our interview on October 31, 2011. We recently obtained an update from the embassy informing us our AP is due to my unilateral divorce decree (aka) Haiti quicky divorce. I have done a lot of research and now realize we will most likely be denied due to the type of decree I submitted for the K1 Visa petition.
So now knowing the possible outcome I am asking for all options possible for us to be together here in the United States. We are not really concerned with time frame. We both agreed how ever long it takes, we are willing to wait to be together. We would like to know what would be the best course of action to takea far as filing again? What is the best way to go about this to avoid such obstacles in our future filing?
I now see why it is important to have an immigration lawyer, if i did have a lawyer they would of told me my divorce decree would not be valid enough for the United States Embassy . I say valid enough because in some states in the US it is valid for example Massachusetts, where i am from and where I continue to reside currently.
    Thanks in advance.

Despite what you were told on the phone (other VJ members call it the misinformation line for a reason), anything you send to USCIS unsolicited is nothing more than an exercise in futility because anything you send unsolicited will not get matched with your file.
Based on your list of what you have already sent, I believe you will not receive an RFE for the items that you have indicated you wish to send.
If you want those items to be included with the file that will be reviewed by a CO prior to the interview taking place, you can send those items to the NVC with the DS-230 and documents that accompany the DS-230. Be aware that if you choose to include items with the DS-230 that are not asked for by the NVC, it will likely slow the processing of your case at the NVC. Regardless of whether or not you choose to send those items to the NVC, they should be brought to the interview.

My husband had an interview today. He provided the interviewer with phone bills, chat logs, emails, and plane tickets. The only thing the interviewer looked at were photos. He proceeded to ask my husband about how many kids I have and their names & ages. He then told my husband that he would NOT be getting the visa and that I needed to come back for a second interview. I'm just wondering what I should expect from this. Also, my husband had to go to purchase some kind of calling card for $10, which apparently is the only way to reschedule the interview. When I called to schedule the interview I only got a recording & a full voicemail box. Have any other Haiti filers experienced this? My concern is that I pay the $800+ for the plane ticket and he still does not get the visa. I will be beyond pissed. I'm so aggravated and frustrated right now I can't even put it into words. I'm holding on by a thread!

Here is some helpful info for you all. This I took from some other helpful VJers from my time filing.
NOA1 in hand, NOW what do I do?
For the Beneficiary of K-1 Petitioner:
    Required Documentation
You, the foreign-citizen fiancé(e), ...... will be required to bring the following forms and documents to the visa interview:
    One (1) Nonimmigrant Fiancé(e) Visa Application, Form DS-156K .
A passport valid for travel to the United States and with a validity date at least six months beyond your intended period of stay in the U.S. (unless country-specific agreements provide exemptions)
    Birth certificate
Divorce or death certificate(s) of any previous spouse(s) for both you and the U.S. citizen sponsor
Police certificates from your present country of residence and all countries where you have lived for 6 months or more since age 16 (Police certificates are also required for accompanying children age 16 or older)
Medical examination (vaccinations are optional, see below)
Evidence of financial support (Form I-134, Affidavit of Support, may be requested)
Two (2) 2x2 inch photographs. See the required photo format explained in Nonimmigrant Visa Photograph Requirements
Evidence of relationship with your U.S. citizen fiancé(e)
Payment of fees, as explained below
Note: The Consular Officer may ask for additional information, such as photographs and other proof that the relationship with your U.S. citizen fiancé(e) is genuine. Documents in foreign languages, other than the language of the country in which the application takes place, should be translated. Applicants should take to the visa interview clear, legible photocopies of civil documents and translations, such as birth and divorce certificates. Original documents and translations will be returned.
    Medical Examination and Vaccination Requirements
In preparing for the interview, applicants will need to schedule and complete a medical examination. Before the issuance of an immigrant or K visa, every applicant, regardless of age, must undergo a medical examination which must be performed by an authorized panel physician. You will be provided instructions regarding medical examinations from the U.S. Embassy or Consulate where you will apply for your visa, including information on authorized panel physicians. See Medical Examination for more information, including a list of panel physicians by country, and frequently asked questions.
K visa applicants are encouraged to get the vaccinations required under U.S. immigration law for immigrant visa applicants. Although such vaccinations are not required for K visa issuance, they will be required when adjusting status to that of legal permanent resident following your marriage. Applicants are therefore encouraged to fulfill these vaccination requirements at the time of the medical examination. See Vaccination Requirements for IV Applicants for the list of required vaccinations and additional information.
Proof of Financial Support and Affidavit of Support Forms
During the visa interview, applicants will be required to present evidence to the Consular Officer that they will not become a public charge in the U.S. You may present evidence that you are able to financially support yourself or that your U.S. citizen fiancé(e) is able to provide support. The Consular Officer may request that a Form I-134, Affidavit of Support be submitted by the U.S. citizen fiancé(e).
The U.S. citizen fiancé(e) will need to submit Form I-864 to USCIS with the application for adjustment of status to that of legal permanent resident following the marriage.
Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?
No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.
Fees - How Much Does a K-1 Visa Cost?
Fees are charged for the following services:
Filing an Alien Fiancé(e) Petition, Form I-129F
Nonimmigrant visa application processing fee, Form DS-156
Medical examination (costs vary from post to post)
Other costs may include translation and photocopying charges, fees for getting the documents required for the visa application (such as passport, police certificates, birth certificates, etc.), and travel expenses to the U.S. Embassy or Consulate for an interview. Costs vary from country to country and case to case.
Filing Form I-485, Application to Register Permanent Residence or to Adjust Status
For current fees for Department of State, see Fees for Visa Services. For current fees for USCIS, see Check Filing Fees on the USCIS website.

If you set up an account in I-129 Petition for Fiance(e) https://egov.uscis.gov/cris/Dashboard/CaseStatus.do of course you can check your status each day.
Example your number is EAC1190276990 I just checked EAC1190276971 which shows completed and they are now working on EAC1190276972 and up... so each day you can track others peoples status and see where your status is..
Really not cheating - just a way to track your visa application better..
    Hope this helps : )

Here is how the CO/ USCIS will look at it:
    - If you have to work for her to be able to make her bills, what are you guys going to do if you cannot find work? Are you going to become a public charge?
    - Is she just importing you to help with bills?
Honestly, I have never seen an expedite for financial hardship get approved. Military expedites are most common, and then medical cases (with STRONG evidence), and where the foreign country is in deep crisis )Haiti after earth quake, Iraq because it can be deadly to be known to associate with Americans etc).

Two things you also need to send: some kind of medical note or records saying she's been sick due to pregnancy and if she continues to be by herself, it can harm her chance of keeping her job. You're also going to need proof that her car is damaged and that it would cost $500 to fix. Get a quote from a mechanic detailing the problem with the car and how much it would cost to fix.
    Good luck on your expedite.

PAPUNMANMU got a reaction from Saylin in How does NVC contact the beneficiary after NOA2?
    Hi JoyDee
I understand where you're coming from as a K-1 Applicant however as a CR1 applicant also waiting in line for HAITI too. I am telling you since it seems you do not believe Saylin that NVC is the ONLY contact that we have they take the USC and the HAITIAN SPOUSE e-mail and PHONE numbers for all the processing. The K1 Path and the CR1 path are two DIFFERENT paths no matter what country your consultant is because As CR1s WE DEAL ONLY WITH NVC until we get an interview date THAT'S THE ONLY TIME WE GO TO THE PAP for any thing. In fact we do not deal with PAP until the day of the interview. That's what Saylin is trying to get you to understand. We are all here to help each other and because of that we can not tangle different informations together because it is what it is. K1 deals with Consultant where NVC is a rest stop and CR1s deals with NVC and wait there until interview is scheduled by NVC for the Country in which the applicant will have there interviews at so NVC contacts both USC and Spouse no matter what country they're in.

I was just saying that I was going to write you. I wanted to know if you could report him to the government after you guys get your result from him.he shouldn't be one of the docs the government ask us to choose from to get this process done with. If you don't mind will you?

    hi,
Yes you are right about reporting that Doc. I will have to write the person that went through it and ask her to report him ASAP because there's a lot of others who are going through this process who are not on Vj and that's not fair that he is scamming us and the US and Haitian governments. I called NVC and had a nice chat with the Rep last night and she really made some points to me she explained to me that because most of our PAP apps are being expedited because of the earth quake now it takes longer to get interviews because of the long lines so now i understand more. I really think it's good to always walk travel in groups while in Haiti either one lives their or visiting. I pray all is well for all of us,.

So wait a minute... you havent really explained "disaster" but I'll tell you this mate, I'm flying 3,500 miles to marry my fiance (ironically on the 29th) and let me tell you, If she lost her job and changed her mind and told me to go home, I'd be mighty pissed. I've sold everything I own except the clothes and few bits I am traveling with and have given up my flat. I'd be broke, jobless, hurt and homeless and I don't have the two kids she has with her with me! Think on it. You've got 90 days to make it or break it. I don't really know the circumstances as you really didn't say but I wouldn't want to return home to nothing.
