  1. Well. the DS-156 form is filled out electronically and the bar code is generated. However no information is sent to the embassy. You just need to generate the barcode - that's why you fill it out on your computer. You add the photo and bring the form to your interview. Then they take it from you and scan the barcode - and all the info is transfered to their computer.

  2. The instructions are very vague about DS-230. My fiance already sent just the checklist. I guess, if they're goign to need DS-230 they will ask her to send it?

    That means she needs to send it asap, she should have sent it with the checklist.

    K1 are processed by Immigrant visa unit of the embassy, although they are said to be non-immigrant they are processed as immigrant because the person is actually immigrating.

    (DS-230 is NOT required, this is a common misunderstanding, since the checklist is issued for both K1, K2, K3 and other visas. DS-230 is required for immigrant visas. K1 visa is not an immigrant visa)

    If she received packet 3, she should follow what the instructions say. Some requirements vary, depending on a consulate. But Ds-230 part I - Biographic data ( first 2 pages) are commonly used in K1- process. I just had my interview at the K1, prior to which they requested I send a DS-230.

    Read the instructions carefully and proceed according to what's in them.

  4. This is incorrect. Each petition gets a seperate receipt notice, I-797-C formletter.

    Each petition has a seperate case number -

    so it's one case # for the I-130, another for the I-129F.

    Please read the post carfully. I was saying that the petitioner got one recipt and the lawyer probably got a copy of the same receipt. We do not know if the I-129f was even filed!

    I was simply saying that whatever they get - the lawyer gets as well. Whetever the lawyer gets - they get as well. That's how it works when you file a petition with a lawyer and sign the G-28 with it.

  5. To the OP - your lawyer gets a copy of all the mail sent to you. When you filed your I-130 you probably filed signed G-28 form. He will always get a copy of what is sent to you and will always be able to act on your behalf - to get rid of him for good- you will have to withdraw/cancel the G-28...

    You mentioned that NOA1 was sent to your husband, well - your lawyer must have received one as well. Just FYI

    BTW, we have initially used the lawyer as well - nothing good came out of it...her actions and words led to confusion and errors....if it wasn't for VJ I don't know how we would managed... I wish we had fired her sooner!

  6. I had my done few weeks ago at the Blackrock Clinic. Just like everyone else is saying - it's a general medical examination. They just checked my eye sight, checked my height and weight... blood pressure... feel your abdomen to check for irregularities... listen to your heart and listen to you breathe...ask some questions about medical history and give you vaccines if you don't have a vaccination record that shows you have been vaccinated... and that's about it...oh and u will also need to have an xray and they will draw some of your blood...

    it will last approx 30 minutes...you will pick up the results a week later from the blackrock clinic - they dont send it. Need to pick them up personally.

  7. so i just called nvc again and they told me that they sent my package over on the 18th of may

    i read a few threads here and i tried to do what they said

    so basically they sent it on the 18th of may to ireland

    But the Embassy is closed - Monday-Tuesday 23-24th may - due to Obama's visit. My fiance spoke to a lady at the embassy in Dublin today and that's what she told him.

    It takes around 3 days for them to put it into their system...I'm guessing they won't send out your pakcte 3 until Monday 30th...

  8. Yes, I agree with the others, fill in a new form.

    As to other red flags, they will probably ask questions about the overstay, and may give you a bit of a hard time about the sister's petition- your current K1 could be seen as you trying to find yet another way to immigrate. But the fact that the relationship started before that petition should make things ok.

    That's what I thought...but I think we have pretty good proofs of our relationship to help this out:

    -approx 140h of phone conversation/month

    -he comes down to Dublin every other month

    -gmail chats (every weekday for at least an hour)

    -Skype logs (every weekend day, 4-5 hours each)

    -emails - we email each other every day

    -he also emails me a video message every single day- since i left the U.S (that would be for the past 11 months)

    -wedding plans and arrangements - i have a booklet for that

    -I already bought a dress for the wedding

    -birthday and xmas cards from him and his family

    -postcard he sends me wherever he goes

    - my fiance will be attending the interview with me

    ...well, all in all, I am getting myself prepared for some tough questions...

  9. The Department of State computer system doesn't actually store the information you enter on the DS-156. It simply generates the two-dimensional bar code. This bar code contains all of the information you entered on the form in a format that's easy for the consulate to read with a scanner. We filled out several of these forms for my wife before we finally got it right.

    Go ahead and fill out another form.

    You didn't overstay long enough to trigger a ban, so it won't be cause for an automatic denial. You can expect to be questioned about it at the interview.

  10. If you had mentioned you fired the lawyer, my answer would have been different. If it were me, yes, I would submit a form with truthful answers. The best way to do that is to fill out another one answered correctly.

    Thank you! Does that mean It's okay for me to fill out another DS-156? I'm supposed to bring it to the interview, I haven't submitted one yet...might sound dumb...but since i already generated one with a barcode I wasn't sure i could do another one....but I gusess I can...yep I will definitelly check 'yes'.

    Do you think I can expect some other red flags based on the info I provided? I think as long as we honest about everything and have good proofs of relationship , it should be okay?

    I'm just worried that by trying to extend my stay and because my sister filed for I-130 and I-485 when i was there, I'm just worried it might be good enough reason for denial...

  11. This is what you hired your lawyer for.

    The lawyer was fired before we even received our NOA2..It turned out she just took the money and actually did more damage than actually helped us. We decided to fire her and since than always turned to VJ when needed advice.

    Anyway...thank you for your time and post.

  12. We're going to have our interview in couple of weeks. I just turned in packet 3...now i have few questions...

    I met my fiancé when I was in the U.S visiting my sister on the B1/B2 Visa… I wasn’t expecting this, was not a stage when I was looking for a relationship, but it happened. We just really fell for each other. My I-94 was getting closer to it’s due date- I filed for an extension. While the extension was pending I was looking into my options…I did not know much about all that immigration fuss…My sister filled I-130 and I-485 for me while I was there. While we were waiting to hear back in relation to the I-130 and I-485…I found out the extension of my I-94 was not granted. Meanwhile I began cumulating ‘overstay’. The I-485 together with I-130 was sent back to me, none of the checks were cashed… it simply said that the paperwork was rejected because the priority date was not current. They returned everything. It wasn’t even processed.

    I met few lawyers, looking for options… I’ve decided to leave.

    The overstay was less than 3 months (therefore it was less than the 180 days that would trigger the ban)

    My (now fiancé) followed me and he proposed. He hired a lawyer and filed for I-129f in November. We got Noa2 in early April, I turned in my packet 3 (Ds-230 part 1 and the notice of readiness) approx 2 weeks ago… We’re waiting for the interview date to be scheduled; he will come down here to join me for the interview.

    In packet 3 I was asked to complete the I-156 online (the one that generates the barcode) I truthfully answered all the questions…stating all my previous entries to the U.S…and how long.

    When I was preparing it I was taking a peak at a sample form, that our lawyer had prepared for me and although I input all my visits to the u.s …around 6..out of which I overstayed only the last one… to the question – have you ever been unlawfully present in the us… I followed my lawyer’s example and checked no…

    But I’m reading more and more and I think I should have checked yes. Now, what do I do… Can I correct it (using pen)? Or should I fill out another DS-156 and generate another code? But then again the instructions on packet 3 said first fill out the I- 156 and then send the notice of readiness… should I just keep the one I have and honestly tell the CO at the interview… how doest this bar code work?

    What’s the right way to deal with all that? What’s your suggestion?

    I would greatly appreciate the input of the senior members!

  13. 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

    Not required for the interview, nevertheless, there is a common understanding that it's good to have it. All in all the embassy should receive your petition from the NVC.

    2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

    What your fiance will need from you is your birth certificate (or certified copy), I-134 with supporting evidence and you shoudl work togetehr to gather the proof of ongoing relationship and updated letter of intent.

    3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).

    4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

    yep. you need it. It's one of the most important things you need to put together for the interview.

    5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.

    6. A copy of the NOA2 that you received in the mail.

    Essential. Although they should have it.

    7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

    yep and anything else you can think of that will confirm that your relationship is true and real.

  14. We were changing consulates as well. We managed to have it changed at the NVC stage. However we did inquire about all the possibilities. When your case is at the consulate stage you need to have it figured out with the consulates themselves. You need to call the embassy where your case is and have it arranged with them if possible.

  15. Nope, it's not your interview date. The interview is scheduled by the embassy...according to their schedule and availability..the case number is assigned by NVC. LND does stand for London though.

    You should hear sth from the embassy with the next couple of weeks! Good luck!

  16. What everyone is saying is that while entering the U.S on a B2 visa, she will be questioned by the immigration officer, as everyone and the officer will ask about the purpose and about the intent. If they find out that she's planning to adjust status while visiting, they will not let her in.

    The I-130 and I-485 will not work for your brother. The USCIS will send you back all your docs and not even process it.

  17. The saga continues....

    I'm getting goose bumps finding out how long ppl wait for the embassy in Dublin to schedule the interview...

    They received my Ds 230 part I and notice of readiness May 6th ( i sent it on the 5th, via anpost express post and paid 2€ extra for the signature) They got it and signed it!...I already had my medical done and got the results...all in all I'm ready to go...so is my fiance, who's going to come down here and accompany me to the interview and help me with the whole moving stuff...so we're waiting... I called once they told me that it takes 3 weeks from when they receive packet 3 until the interview ( that was last Tuesday). My fiance called today...they told him that they didn't receive my biographic data and want do anything with my paperwork until they receive it from me. I called them after wards, and I told her that they have received it on the 6th according to anpost...that it was signed for...so she took my name and checked and all she managed to tell me was that they are pretty much booked and the interview wont be until the last 2 weeks of June... We were planning to have the wedding on the 26th of June...

    At this point...i don't care if the interview is this week, next week, or in a month... I just want to know ,so my fiance can book a ticket and we can try make some arrangements for the wedding...

    Any ideas how to handle that? Any ideas how to get some decent info from ppl at the embassy? I always seem to be put through the same lady..it seems like she's feeding me some out of the blue information and she doesn't bother to check anything... I'm just so antsy and impatient at I want to know already...

  18. I am a student going for MHA this fall to USC ,I RECENTLY GOT MY VISA DOCUMENTS BACK FROM MY CONSULATE IN India BUT SOMEHOW THERE WAS NO BROWN ENVELOPE -THE DANGER THING WHICH EVERYONE SAYS HAS A STAMP SAYING ' NOT TO OPEN THIS'.

    MY PASSPORT WAS IN A PLASTIC THING AND THE DOCUMENTS WERE STAPLED IN THE PASSPORT WHAT TO DO????

    I M CONFUSED....DOES EVERY ACCEPTED VISA HAS DOCUMENTS IN THE BROWN ENVELOPE??

    That's because you're on the student visa, which is not immigrant visa nor fiance visa (K1).
