While the eligibility requirements for a VAWA self-petition have not changed in several years, we have seen alarming new filing trends. Previously, the number of VAWA self-petitions we received each year generally grew at a rate similar to other immigration benefits. However, since 2020, we have seen an unprecedented rise in VAWA receipts. Along with a substantial increase in the number of filings, we also saw significant changes in the characteristics of aliens submitting VAWA self-petitions. In addition to the increase in male self-petitioners cited above, we also saw a 2239% increase in parents submitting VAWA self-petitions from fiscal year 2020 to 2024. These have not traditionally been populations filing for VAWA.

Hello everyone. It's been many many years since I've been on this forums and my own Visa journey. And a lot has happened in these few years.

Unfortunatley a few days ago I learned that my mother is likely going to pass within the next month or two. This news came as a complete shock, and truthfully, death is always complicated but I fear it's even more complicated living in the USA while a parent is back home. I've no idea where to begin or what I'll need to do on the day it happens, or whether there are lawyers or solicitors I'll need to work with that are specific to expats like me dealing with a family members death in another country.

In short, I'm lost. And as someone that tries to plan all the time, a coping mechanism for me is trying to get things ready, lined up, for when the day occurs so that I don't have to worry about it.

I haven't dealt with death of a family member before. And I've no brothers or sisters who can help me. Of course I'm planning to come back to the UK and stay for a while. But yeah... that's about all I know, other than my mother has given me lasting power of attorney.

In one example, an immigrant engaged in a sham marriage with an elderly U.S. citizen and subjected the citizen to "elder abuse and exploitation," according to USCIS. Another immigrant admitted to fabricating a death certificate from Kenya for $100 to falsely claim the termination of a marriage the spouse in question was alive, living in Minneapolis and the mother of five of his children.

Other cases included a petitioner who confessed to marriage fraud just hours after swearing under oath that her marriage was legitimate, and another involving an immigrant who had overstayed a visa waiver, was the son of a suspected terrorist, and had previously been denied benefits for fraud.

Sarah Shaw crossed into Canada mistakenly thinking she had the proper visa to return home to Everett. She and her 6-year-old son are now being held in Texas.

The story is contradictory as if her then husband had indeed sponsored her why would she be applying for a GC? And what Visa could she possibly have had had that was still valid 31/2 years later? The only one that fits would be the K3 but that seems highly unlikely.

My money is her coming as a visitor with presumably 3 children, marrying, maybe filing to adjust, divorcing and then VAWA. She has EAD but not AP.
