There is a presidential proclamation that suspend entry into the United States of all noncitizens who were physically present in any of 33 countries during the 14-day period preceding their entry or attempted entry into the United States. The one that applies here is Presidential Proclamation 10143 (Schengen Area, United Kingdom, Ireland, Brazil, and South Africa). Amsterdam is in the schengen. However, - certain travelers whose entry would be in the national interest, as determined by the Secretary of State, the Secretary of Homeland Security, or their designees.
The Secretary of State has determined that the entry of the following travelers is in the national interest for purposes of exceptions to all four proclamations. The Secretary may revise these national interest determinations as circumstances warrant. One category of travelers that are automatically considered for National Interest Exception (NIE) at the Port of Entry and do not require advance approval of a NIE from an embassy or consulate is fianc (e)s of U.S. citizens and their dependents (K visas). My fianc e comes this week. She flys from Bangkok through Amsterdam then her POE is Atlanta. I m freaking out that she either isn t going to be let in or she is going to have problems that she can t communicate out of just because of a layover. I think with everything I ve read she is ok but I don t know. What do y all think? Anyone have a number you think I can call and verify?

my wife is in the US (on B1/B2) with me (USC) right now and we want to file I-485 adjustment of status so we can stay here to get the green card. i just called USCIS and the person on the phone said we are eligible to file now. I submitted an I-130 application from Thailand in Dec last year with the intentions of return to Thailand in October this year and doing the green card there. on the I-130 i decarded it was our intent to file in Bangkok. However, now we don't want to return to Thailand because of all the Covid rules and worry getting back to the US next year will be a problem. Q1) so now when i file the I-485 Part 3, section 1, it asks have you ever applied for an immigrant visa at a US consulate or embassy abroad. i said NO because i files the I-130 on line, not at the embassy. i hope this is OK? Q2) on the list of things to submit with the I-485, the checklist includes this "Inspection and admission, or inspection and parole documentation (unless applying for adjustment under INA 245(i))." what is this? do i need it? i think its for people who entered the US illegally right? we are 100% legal in the US so i think that doesn't apply. Q3) when does my wife need to get the medical check? i don't see it on the application checklist Q4) my wife doesn't have a birth certificate. we had her sister to go to the government office where she was born to get a duplicate but they will not do it unless my wife goes there in person (not possible). So I think its possible to use school records, which we have. But USCIS says we have to show proof that the birth certificate is unavailable. How to get proof of a negative? we'll ask the local government to write something official but i doubt they have a form for that. thanks

I (USC) applied for IR-1 for my wife in Thailand, Dec 2020. We are in the US now, we've been here a few months and I'd like to stay longer because of problems getting back to Thailand re covid rules. I am thinking about filing a I-539 extension. if approved and my wife can stay until next spring, i think there is a good chance her green card interview data may come up before then. Can she change the interview location to the US since its very hard to get back to Thailand right now Thanks

I have my CR1 DQ d and I'm only waiting for the interview back in Thailand. However, I'm considering changing to AOS because of the covid situation in Thailand and some health related issues. For the AOS process, is it correct that I only need to submit: I-485, I-131, I-765, G-1145, and Approval Notice from USCIS? As for I-864, do I need to resubmit that since I submitted it to NVC not USCIS? Thank you in advance. (Anyone has similar experience, please kindly share with me) It s not a final decision yet but I m really considering it.

Hello all, this is a question posed by my son and daughter in law who are going through the process and I could not answer his question. "Submitted the I-751 a few days early by accident and the entire packet (including payment) was returned. By the time it was returned, I was within the window to submit the I-751. I resubmitted the same packet and received my NOA --two pages! it extended the green card 18 months, it stated to send in supporting documentation if I haven't already done so (I did with the packet). there was information about processing times and biometric appointments but on page two there is language about return of documents. IS that standard to receive a 2 page NOA with a section on return of original documents? Because my original packet was returned, i am sensitive to anything that talks about that. " Trevor
