Decision and steps at beginning of Visa process

Hello to all,

My name is Patrick and I recent got engaged with my girlfriend of 3+ years, of Thai nationality.

We were originally planning to pursue the CR-1 route, getting married in Thailand in the fall (contingent on current situation and how things progress) and then immediately start the visa process. We originally thought of the K1 visa, but decided it may not be ideal due to the processing period where she has to stay in the US and not able to return home for any family emergencies (a relative with medical condition that has ups and downs related to health).

However I recently was told that K1 with Advanced Parole could be an option. From everything I have read, it seems possible albeit 100% discretionary whether or not parole is granted. I wanted to pose the question to the group for anyone who has gone through a similar decision and/or gone through the actual steps of either visa process.

Any insight or guidance to navigate this process and the best way of moving forward would be greatly appreciated.

I-485 application to register permanent Residence or Adjust status

I 864 Affidavit of support -- What proof of US citizenship should I use? Birth certificate or passport ID page?

I-131 Application for travel document

I-765 application for employment authorization

G-1145 e notifications

Will also include 1 year IRS tax record

401 account at least 5x of poverty level

2 passport photos in a plastic bag with name on outside

Birth certificate

copy of Noa2 approval I-797

marriage certificate

DS3025 vaccination documentation worksheet

Transcribed into English medical report

Passport copies of info page and K1 visa page

I-94

We have hear from other AOS filers that we don't need a I-693 report of medical examination. I do read on here to get a surgeon general to transfer medical info to a I-693

There is so many conflicting lists of requirements out there.. Example is to just look on this website and the main AOS pinned topic is so old and flawed it should be deleted.

We have her SS card.. that took about 18 days to get. Her K1 is good until July 31 We hope to file before then.

Any help or corrections would be apricated.

Oh I was going to turn in an I-134 but I guess that is not needed?

Does anyone know if the Bangkok embassy is still scheduling visa interviews during this latest outbreak? Lots of places are work-from-home only but since embassy staff are all vaccinated I'm not sure what they're doing. We're still anxiously waiting for our IR1 interview.

My wife, who is a permanent resident, wants to bring her adult son with wife and new grandson to visit us in the USA. Her son already has a 10 year Visa and used it about 4 years ago to visit us in the USA before he was married. His wife has no Visa. I sent a letter of sponsorship for him at the time, but have no way of knowing if it had any influence on the decision to issue his Visa.

My question is, what is the best way I can help his wife and infant son get a Visa also, so they can all come to visit? Should I write another sponsorship letter for her?

B2 Extension, with CR1 dq’d

Hi,

Currently, I have been in the states for almost 5 months now using B2 visa. My stay is supposed to end on September 4, 2021. I am also already dq d by NVC for my CR-1 visa but won t get to be interviewed until around December/ January.

Right now I m thinking about extending my stay for 2-3 more months due to many reasons but mainly the new wave of covid in my home country, Thailand.

I heard that it s gonna be a long wait and I d likely have to overstay while the case is pending and then go home after overstaying for 2-3 months.

But I m just not 100% sure if it s ok that way and what I should do before I leave. Just confused with all the details. And just curious how long you can actually stay with i-539 pending because people say different things.

Please kindly advise.
