Background Check (Romania)

Hi all, I've been unable to find this anywhere but I am wondering a few things:

1. Does the birth certificate have to be apostilled?

2. My fiance is from Romania but has lived in Spain since the age of 16. I am assuming he will need to show a background check from both countries. My question is does anyone know the specific name of the background check he needs to request? I ask because he had to present a Romanian background check here in Spain and he had gotten one type but was denied and had to request a different type which was then approved. I'm unsure if there are two different types of background checks in the country or how that works but any insight would be great!!

3. Can these documents be requested in advance? We are about 5 months in on our process and the last time he asked for the birth certificate and background check + apostille it took about 3 months to arrive... so figured maybe we should go ahead and request them?

Wife wants to change last name after my i751

When we got married, my wife (usa citizen) could not take the last name she wanted. I have two last names but she only wanted the first one. We have been delaying it (we just need to go to court) but now we need to do it soon because her passport and other documents are expiring soon, and it makes more sense to change it first.

I need to send my 751 before april, would interfere if my wife changes her last name in the middle of the proccess? Should her put her ''new name'' in the 751i?

Visiting on an ESTA/Proving ties

Hello

If everything goes well, I'm planning on visiting my boyfriend in March/April, and stay for like a month, max two (we're still deciding). I know that I need to prove ties so they will let me in, but I can't show a lease or a job contract because I moved in with my dad knowing that I would be out of a job by then, and it's the reason why I can go and visit my boyfriend since having that time off would allow me to spend a few weeks out of the country ,and luckily I also have some savings, although I don't own a house or a car.

I'm not planning on staying, I'm actually continuing my university degree in September after a few years off, but I don't know if showing my university's paperwork will be enough. I'm also travelling in June to see my sister who's looking to get pregnant and I have my plane tickets for this. Would it help? Anything else I could do? I'm desperate to see him, it's been a year, and having to spend 14 days in a non-banned country makes it very difficult to visit while having a job.

I know that no one can tell me for sure if they will let me in, of course, but I'd love some feedback and ideas.

Thank you.

Case still in the US Embassy in Spain with no appointment for interview

Hello everyone! Wishing a happy 2021.

I am from Spain and my future husband from the USA. My case has been ready to schedule an appointment for the interview since last February. However, the US Embassy in Spain claims that there is still a travel ban, according to the presidential proclamation 9993 and they can not process k-1 visas yet. I have been waiting for a year, no moving forward with the process and it seems like it does not get to the end of these restrictions.

Is someone here in the same situation? Does someone know when the travel ban will be lifted? As far as I have been checking, Trump signed a proclamation for lifting it on January 26th but Biden intends to revoke it... The whole situation is so frustrating. We do not know what to do...

Options? Is it possible to actually move to the states through a non-europeans (Schengen area country) and apply for spousal visa? I appreciate any kind of help and ideas...

Thanks in advance!
