Hi Everyone
I'm kinda in Panic for what just happened yesterday and still can't understand exactly why my case is supposedly getting denied .
So to start i'm an immigrant from Portugal that came to the US in 2006 with a VISA Waiver and overstayed until now and got married back in 2018 and to which my wife requested me to apply for adjustment of status a few months after our marriage. My wife's a legal resident (Green Card Holder), everything it's was going well on my petition first I130 got approved after our interview, then after approval i sent the approved I-130 together with I-485 package including I944 and all other Forms, so a few months later got my Work permit and social security so far so good, less than 2 months later i received a letter stating my scheduled interview date (yesterday) and to bring every document that's been sent since the beginning plus some extra ones ''which it's okay if the Agent would bother at least to look at them in the interview'' anyways we got to the appointment on time and got seated for 1 minute or so when an Agent pass by us and told us to follow him and to raised our right hand and right after that asked my Wife if she was US citizen yet or no and she said not yet because of her English and in cold words he turns to me and said so your case will be denied.
And me in chocked asked, might i know the reason why my petition is being denied and he said because i Overstayed my Visa waiver and that i been working without documents i Explained that in my taxes returns that was sent with the packaged he can see i being paying my taxes all this years and that's the only way i can provide to our family since my wife hasn't been working since she has 2 minors from the previews relationship and they been home for Virtual schooling. And he didn't care no justification why i had to work, he just said that he will be sending a letter for me to appeal my case but didn't give much details.
SO at this moment i'm wondering if any of you knows any similar Case like mine or knows how to justify my "Verbal" Denial to my petition and what to do next before and or after the letter comes?
And if my case couldn't be considered as an adjustment of status why USCIS waited until the last interviewed to say it's not possible instead of them sending a letter in the beginning rejecting the application ?

Thank you in Advance
PS: i didn't get a Lawyer to help me before because of Covid, lawyers in my city weren't opened or taking cases"

Hi all,

When trying to register my interview appointment at the Embassy, I keep getting the following error:

333249782_ScreenShot2021-02-08at7_45_39PM.thumb.png.2165a8009785ee056c744b46f437c6ad.png

I did receive an appointment letter from NCV and I am typing in the correct IV case number.

Did this happen to anyone or is there anything I am doing wrong?

TIA

Hi all.

While I was waiting to receive an interview date for my CR1 visa, I had to renew my passport and therefore the passport number changed.

I just received the IL with my interview date and I am trying to register the appointment with the embassy. At some point of the registration, it is asking for my passport number and that it should match with the DS 260 Form I had submitted before. My question is: should I put my new passport number or the one that I put on DS 260 form? I guess it would make sense to put the new passport number cause that's where the visa will be printed, but Im a lil confused with the " should match your DS 260 form". Thanks!

Question about SSN, ITIN, and expired passport

Hi all,
Hope this is the right place to post this.
My wife and I'm looking for a new apartment due to mold in our current place.
However, my wife doesn't have a SSN - she applied last year and they denied her request due to a name error in her i94 (it's been fixed now - but it was too late because her i-94 is expired) We sent our AOS package a while ago and they sent us a RFE but that's another story. But as a result, the process is delayed and my wife can't get her new SSN anytime soon.
The apartment we've been looking for said they won't accept my wife if she doesn't have a SSN or a ITIN. I don't completely understand what an ITIN is - but it has something to do with taxes? My wife doesn't work, so I'm not sure why an ITIN is necessary. The apartment is also asking for her passport as a form of identification. But her passport's been expired for a couple of months.
Are we completely screwed here?

Hi everyone,

I am an American/Portuguese citizen. I lived in the US for 8 years and moved back to Portugal 2 years ago due to family health issues. I am thinking about moving back to the US again soon, however I have a girlfriend who I d like to sponsor to come with me. I understand we have to be married so I can sponsor her and I would rather get married in Portugal first when the time is right. I also have a daughter (who is American/Portuguese).

I m not 100% sure of how the process goes so here are my questions:

- I have to file for Cr1 (I-130 petition) whilst in Portugal? Is this the only petition we have to file?
- what kind of income proof do I have to gather? I am confused about this. I have a job in Portugal (so does she) and even though I don t work in the US I still file for my taxes over there (the way it s supposed to be done). I don t own anything in the US.
Will I need a joint sponsor?
- if I don t make enough money to sponsor her on my own and don t want to use a joint sponsor, would it be a good idea that I move to the US by myself first, get a job and a house and go from there with the petition and affidavit of support?
- if all this goes smoothly and works out the way it s supposed to, will my girlfriend have permission to work immediately?
- can all this be file electronically?

thank you in advance!
