Hello all. I want to petition for my father. I am looking at petition I-130 to do that but that one says for parents that live outside the US. My father is, has been in the US for many years without inspection. Is this still the correct petition form? Long story short: He migrated to US around 1994. He had altercation with mom and police was involved. He pled guilty to spousal battery, misdemeanor. While in county jail, he was picked up by ICE and deported without going in front of judge. He remembers signing something with ICE, probably deportation agreement, but he did not know exactly what it was. He came back without inspection again. 25 years or so later, here we are. We have consulted with attorney/s. The plan has been for me to petition for him and submit waivers of inadmissibility. My grandfather, his dad, is 90 years old and here in the US, along with all his family. Any ideas, suggestions, comments appreciated. Just cannot afford attorney fees. Thanks!

Hi! So I am getting worried because based on countless research I had done, I had the belief that once my fiance got here on a K1 visa, we had 90 days to get married and then we could apply for her adjustment at our earliest convivence. However, upon more research, it does not look like this is the case at all. We got married the same week she arrived in the U.S. but I have not filed her AOS yet. Due to Covid and her pregnancy, its been a bit of a struggle to get the $1225 for the filing and biometrics fee. However, her I-94 expired 12 Dec 2021. I know I can save up enough to file her AOS in Feb, but I just don't want any possibility of her having to return home, especially since she is due within 2 months. Will there be any problem when filing her I-485?

Ok if someone enters the U.S illegally like in 1995 and then his Boss in 1999 applies for work permit in 2000 he goes to Mex and it gets approved does that automatically cancel the first illegal entry Will immigration not look before the work permit his daughter is applying for him she is 25yrs

I have been engaged to my fianc e for about 6 months. She lives in Mexico City. we had planned for her to visit me last year, but Covid-19 had other plans. Her B-1 visitor visa was originally scheduled for March 18, 2020 but the embassies were closed on March 17th. I have travelled to Mexico 6 times in the past 2 years to be with her and I have been with her roughly 45 over the course of those trips. I just found this site a couple days ago and it seems to have a lot of good information. I have several questions about how we should proceed from here. From what I've read, the CR-1 visa looks like the best option for us. I don't mind waiting the 12-15 months for her to immigrate to the US, but there are a couple issues. She has a daughter whose father is listed on the birth certificate (not me), so my fianc e with need to obtain full custody of her daughter in order to take her out of the country. Since the courts have been closed for some time in Mexico City, I was wondering if anyone could recommend things that I can do in the meantime. Should we begin the paperwork for the CR-1 visa now or wait until she has full custody of her daughter? Are there documents that I can begin compiling right now so that I am better prepared for when we file? Is the CR-1 visa the best option for our circumstance? I am more than willing to fly to Mexico in order to be legally married to my fianc e, but would it help situation? Any help or advice would be greatly appreciated. Thank you!
