I-130 Approved, but confused about instructions

Hello,

I have filed form I-130 to get my step son to the United States.

We received an approval letter and the instructions seem odd to me.

The letter states that the petition has been approved, however, I indicated on the petition that the beneficiary intends to apply for an immigrant visa abroad at a U.S. Embassy or a U.S. Consulate and will also apply for adjustment of status in the United States. Since I indicated both options, USCIS has retained the petition.

What do I do now? Do I have to file form i-485 before he can even come here?

We have waited 10 months for this petition and now we will have to wait who knows how long for the next one?

I thought this petition would allow him to get a visa and come here then we will do the adjustment of status after he was here.

Hello. I submitted Advance parole along with AOS.

I recently moved to mainland from Hawaii and changed address USCIS online.

When I checked my USCIS today, it says upload evidence is required.

Does anyone know what should I upload for the ' Copy of the identity document submitted for the beneficiary with the original Form I-131. ?

Important reminder if you need to update a beneficiary s physical address or phone number

If you are requesting parole on behalf of a beneficiary, you may update their physical address or phone number.

To update their information, upload a letter that includes the following:

  • Beneficiary s first and last name
  • Receipt number of Form I-131 you filed for the beneficiary
  • Reason for change in address and/or phone number
  • New address and/or phone number
  • Copy of the identity document submitted for the beneficiary with the original Form I-131

CR1 case was rejected due to failed payment

If there s anyone who went through the same issues please help!

my husband and I applied CR1 online later September 2022.
He paid via bank account because there s two options for payment which were: credit card OR through your bank account. We picked bank account and he did put his bank info such as routing # etc. We have received our receipt number but apparently they did not take money out and now our case tracker said case was rejected because your payment failed.
If there s anyone who paid through bank account, let me know how does the process usually go? Also after the case was rejected I noticed that if you pay via credit card you have to submit G-1450, correct? But I didn t know that so we just chose payment via bank account and never submitted any documents regarding to payment. Do you think that s the issue here?

Please help me out if you know any info regarding this. Thank you!!

Sooo my husband and I applied I-130 online on September 29th 2022, and we received the receipt number the same day.


The USCIS case tracker says case was received and a receipt notice was sent . However, we still haven t received any actual mail from USCIS or we haven t find out which NVC our application goes. When I researched online a lot of people mentioned that they got NOA 1 a day after or couple days after applying for this CR-1 visa. I was honestly confused about what NOA1 is. Does NOA1 include of knowing which NVC your visa application go through? I really want to know because we haven t received any type of further info but our status says case was received and a receipt notice was sent .

Hi Friends! Long time reader, first-time posting. Hopefully this can help others and provide my wife and I with some answers as well.

Question: While applying for a CR-1 Visa, can my wife come visit me in the US?

I ve read conflicting information.

  1. Some people say if she is on ESTA, then she can come visit as long as she has a round-trip ticket.
  2. I ve read places where it says she could be denied entry because she will have an existing immigration visa application processing (I-130)

We just want to be together, so if that involves going back and forth between the US and Japan, that s fine.

I want her to stay with me for 60 days, we go back to Japan for a month, and then come back for another 60 days. We will do this until her visa is ready to live in the US.

Basic Facts about us:

Wife: Japanese Citizen living in Japan

Myself: American Citizen living in New Jersey, USA

Living Situation: I am currently in Japan, visiting my wife as we just got married. I leave in December. Hopefully she can come visit me in January or February.

Status: Married (within the last 30 days)

Desire: CR-1 Visa

Visa Decision:

  • We were deciding between the K-1 (fianc e) visa or getting married and filing out the I-130/I-129 to go for the CR-1 visa.
  • From many stories and suggestions on this site, we figured what would be best for us is to get married in Japan, and apply for the CR-1 visa.
  • We decided to get married in Japan this year instead of waiting until next year, so we can start the visa process.
    • The process to get a Japanese spousal visa seems to be a bit easier and less time. So we figured we should start the US process earlier than later.

EDIT: I think I posted this in the wrong section .. sigh ..
