Need advice on IR1 visa Section 221(g) letter regarding financial evidence

Hello VJ folks,

I am desperate now for your knowledgeable advice...

I just had my IR1 interview at Tokyo embassy and the officer issued me a 221g letter requesting additional evidence for my US husband's financial stability.

Our background:

  • we have lived together in Japan from 2021 until February 2025.
  • My husband resumed earning US income in August 2024, but he had no US income for the previous in 2021, 2022, or 2023.
  • On the I-864, we submitted only his 2024 tax transcripts, which shows about $14,000 so lower than the poverty guideline.

At the interview, his last year's income was my only concern. However, he is currently employed in US with stable income for 2025, so I was hoping that the officer would approve my visa considering the total circumstance.

We also submitted a letter explaining why his 2024 income is below the poverty guideline: he did not work for the full year, but he has returned to the same company where he was employed for nearly 10 years.

We understand that having a joint sponsor is usually the most straightforward solution, but unfortunately, we do not have one at this time and we also lack assets sufficient to meet the guideline.

My questions are:

  • Would his earlier tax transcripts (2018, 2019, 2020), when he had stable income, help establish financial stability?
  • Alternatively, could we wait until the next tax season and submit his 2025 tax transcript as additional evidence?

We have already waited a very long time to reach this stage, and we are very worried about having to start over. I know that finding a joint sponsor would be the simplest option, and we will continue to try, but I would also like advice on what evidence we can provide in the meantime.

Any guidance would be greatly appreciated. I have attached a copy of the 221(g) letter for reference.

Thank you sincerely for your help.

I have attached the 221g letter.

RFE for I-864 for K2visa

If anyone knows, please let me know!
I and my daughter entered the country on a K1 and K2 visa and applied for AOS, but only my daughter's (K2) I-864 received an RFE. I was unsure whether to send a copy of my I-864, but I created and submitted the original for my daughter, and then it resulted in an RFE. I believe there were no errors in the documents, but I am unsure why it resulted in an RFE. I regret not following USCIS instructions and sending my copy instead.
Should I send a copy of mine this time when submitting the RFE? My husband has applied for an extension of his 2024 tax return Form 1040. When I submitted the initial AOS application, I submitted a copy of the extension approval letter, but this time I want to be cautious, so I asked my husband to submit the 2024 Form 1040 immediately. In that case, I will need to update the I-864 (K1) I submitted previously. Will there be any issues if I submit it?

I plan to submit the following documents (Content of the cover letter for Form I-864)

1. Copy of RFE

2. Form I-864 Affidavit of Support, Under Section 213 of the INA

*The USCIS website I-864, Affidavit of Support Under Section 213A of the INA states that if I am sponsoring multiple immigrants, I can submit a copy of the original affidavit of support as an additional I-864 for the immigrant applicant listed on the affidavit. Therefore, I will submit a copy of I-864 for my wife (K1 holder) as an I-864 for my wife's daughter (K2 holder).

3. Copies of Application for Automatic Extension of Time to File U.S. Individual Income Tax Return (2024)

4. Copies of Federal Income Tax Return Form 1040 (most recent 3 years- 2023, 2022. 2021) + 2024

5. Copies of W2 s (most recent 3 years- 2023, 2022. 2021)

6. His company's compensation Cycle Annual Statement

7. Copy of Bank Statement: present balance

8. Copy of Stock Statement: present balance

9. Proof of Sponsor s US Citizenship Copy of passport Biographic Page

10. Proof of Sponsor s US Citizenship Copy of Birth Certificate

11. Copy of Applicant s Passport (K2) *Just in case

12. Copy of Applicant s Birth Certificate from Japan (K2)*Just in case

13. Copy of Applicant s K2 Visa Passport Page with Stamp of admission issued by a U.S. immigration officer (K2)*Just in case

As the title says I would like to see were we are in the list for 129 visa application but I can't see our exact account in the list and my timeline is somewhat barren. I am new and have no idea how the sight works if someone could give me a quick rundown that would be fantastic. Thank you in advance.

I recently received email from US embassy in Tokyo that notified my interview month and not exact date.

From my knowledge (by reading people s blogs and watching YouTube) I thought NVC would send you the exact date of interview, then US embassy would email you as follow-up. However I haven t received anything from NVC.

Should I send inquiry to NVC?

I attached the screenshot of email.

if anyone know what to do please advise!

Visa refused in Tokyo

Hello,

Unfortunately my spouse's visa was refused based on lack of proof of domicile according to this letter.

I submitted my proof of domicile via nvc showing my bank account, federal tax returns (but we used a joint sponsor), and my renewed driver's license.

They asked my spouse during the interview if I had any work lined up back in the states, but told them that I was still searching.

They took her passport and it seems like they would be awaiting mail from us.

How would I respond and proceed with this? Would it be better to just take our kids back to the US and try to apply for school? Any other evidence I can provide them?
