US Immigration from India

Hi Everyone,

Seeking guidance from the folks on this forum on my situation.

Background

I am a US Citizen...previously a green card holder.

Wife Green Card application approved (Have a letter form US Consulate) - But Visa not stamped yet as we opted to wait until we get the visa for my 2 kids.

2 Kids (Minor) - Waiting for their green card interview (i130 approved - Waiting for their Documents to Qualify (DQ) for the interview)

3rd New Born last month

All this while I was under the impression I can easily get the US Passport for the new born child until I realized that I need 5 years physical presence in US to be eligible for getting the CRBA approved. My physical presence in US is approximately 4 years 8 months. Although I am outside United States now but i am working in US Company remotely (Private Company) currently until i can take my wife and kids along with me.

I have tax returns since 2017 and i have w2's for 2022.

What options do i have other than filing i-130 again?

- Can I file for CBP Transportation Letter (NA - 3 Baby)? As my wife's green card application is approved she can get the visa stamped if she mails her passport to US Consulate.

- Can the officer consider exception to approve the CRBA given my situation?

- Can i apply for a Visit Visa for my new born kid?

The concern is even if i file i-130 for my new born kid my wife will have to get the visa stamped in the next 6 months otherwise we'll have to start the process all over again for her (which is not possible) and we cannot leave behind the new born child.

We filed N400 for my mother. It is most likely to be at Greer,SC.

https://egov.uscis.gov/processing-times/ shows it as 16.5 months. Does it really take 16 months for interviews.

Hi, I have interview for my parents in January 2023 for IR5 visa and due to some circumstances we would like to check how we can reschedule and what will be the approx wait time for rescheduled interview ??

Also, we have just received email from the Consulate for the interview so I would like to check the next steps and how the documentation process works for the interview ??

So my wife received her green card - I mean the 10 year green card - this year by August or so. Basically her I-751 was approved (without an interview).

Now we decided to apply for the N400 (she's been here for exactly 4 years now). So we are applying using the 3-year rule. Plus we also have a son together (who's born in the US).

My question is what do we have to bring as proof (documents) this time? Does my wife have to go to this N400 interview like it's a I-751 interview?

I heard people say since we're applying under the 3-year rule there's more proof required for this one compared to the 5 year rule?

(And interestingly enough, we applied in October of this year, and my wife got the interview scheduled for end of December. That's FAST)
