US Immigration from India

Hi,

Friend of mine, used an immigration lawyer to file for his son, lawyer filed I 130 and we don't know how he filed online or paper. Now to file I-485 lawyer is asking another 3000 dollars additional.

Son, created the USCIS account where he received status update that I 130 is approved, now to file I-485, we looked but USCIS website doesn't give options to file I-485 online. So does he have to send it through the mail ?

If so, does my friend has to file I 864 ( affidavite of support)?

How can he pay the fees?

Applied for spouse (Home maker) after 9 years on GC (EB-2). Here is the timeline and hers is a simple case with no job and no criminal/citation history. Only took 90 days to get naturalized and exactly 7 weeks to get Interview notice generated.

My GC expired back in Feb 2022. I applied of removal of conditions in last year.

My question is, should I apply for replacement ? Or is it ok to just have the expired one?

I am in need of some advice. I brought my husband (then fianc ) here on I-129f and we were married. We then filed the AOS packet. Well, I got a little crazy and freaked out and sent a letter to the local office saying I wanted to withdraw sponsorship. I immediately regretted it and sent another letter saying I was just scared of the process and was not in a good state, etc. etc. and that I definitely wanted to continue with my sponsorship. Well, a week later we got a denial of our 485 because sponsor withdrew. The back said we can file I-290B within 30 days. I consulted one of the resources that you can pay for on this site and the lawyer said that it was probably a waste of time to file the 290 and just to refile the whole thing from scratch. Now the 290 has a $675 fee and the 485 has a $1225 fee. I guess it doesn't matter in the end. But also wondered about a partial refund on my first 485. I've read people getting that but not sure if that is a real thing.

ALSO, to make matters more confusing (for me), we called USCIS and the woman told me that if we didn't file an I-130 after we got married, the 485 would be denied. I don't think we need to file an I-130 if we filed I-129f and got married within 90 days.

Anyway, we were married in August if that means anything. Any help or suggestions would be appreciated. I'm just not sure what to do. Thank you.

I had submitted my documents for concurrent filing with EAD and AP in April 2022.My center was national benefit center for i130 and i485.But when search for the processing time it does not show up as an option to search.Also the i485 processign time is 19.5 months, Do i need a approved i130 and i485 to get the gc or does i130 is good as its processing time is less.Anyone whose i130 and i485 is approved who had applied in 2022 ?
