I sent in our AOS packet yesterday with the I-130 and I-485 concurrently. Since my spouse was already in the US and the USCIS website didn't mention them specifically I didn't complete the I-130A and I-864. Will they outright reject the packet when they get it and send it back, or will they just request those items be submitted online/mail? Also based on the guide on this site it recommends you make a cover letter and certified copies however the instructions provided from USCIS doesn't state either are required. Is it required or just a best practice to make it easier for them and to eliminate doubt?

Hello Everyone, My girlfriend and I got engaged and married while she was visiting due to the current state of things in the world. I submitted our I-130 and I-485 concurrently yesterday and hopefully will hear back soon. She wants to work but I am unsure how that may impact the process, and don't want to file for the Work Permit as it will take half as long as the change of status and we have no guaranteed employment setup for her. Before she came up she was working for three companies Freelance via remote teaching/tutoring Spanish and English to kids. The two of the companies were international (China and Japan) and hired her as a Colombian resident and pay her accordingly to a Colombian PayPal and Bank Account. The third was a US company who hired her under a W-8 non-resident independent contractor living in Colombia, but is now closed so we don't have to worry about that. She is still working for the other two companies but unsure if that is a good idea. She has also had few other tutoring companies have completed interviews due to her resume being out on job sites, but they are all declining once they know she is in processing, and they don't know or I guess can't hire her under a W-8. I don't know if anyone has ever had a similar situation, but my question is simple should she stop working for the other companies, and stop talking to companies who may hire her under a W-8?

I have my I 864 ready to upload with my documentation....but I'm having second thoughts. I sent my tax forms to the IRS along with my wife's W7 to request an ITIN in March....But the W7 had an error since my wife used her married name on the form and only provided her Colombian passport as the Identifying document and since she hadn't included an ID that had her married name on it.....the IRS rejected the W7. We resent the W7 using her maiden name but the IRS still hasn't processed my return.... so it is still impossible for me to get a transcript of my 2019 return which is what the NVC seems to prefer. I can send in a copy of my 2019 tax return along with the W2s to the NVC....But won't it be a problem if the IRS hasn't processed my return by the time the NVC looks at my tax return? Also I made 105 K last year but my current retirement income is only 36000 a year....which is still more than 150% over the poverty line with myself and two dependents..... but really isn't much....so I listed the balance ($ 163K) of my 401K as an asset to help me qualify. I realize that I'm over the line when it comes to qualifying. But I was wondering if it is worth while to have my wife that owns a house in Colombia worth about 150K in USD file an I 864a to help show that we qualify or sending paper work to the NVC showing that my deceased mother has a house in a trust of which I am the sole beneficiary.....but that I haven't taken the house out of the trust and put it in my name as of yet. I don't know if this is all over kill..... or just the fact that I have a qualifying income is good enough.

Hello, I would like to inquire regarding the timeline in which we will receive a welcome letter to proceed with the visa process. At the moment, we understand delays could happen during this times but our NOA 2 was received June 1st, 2020 and we wanted to follow up with the next steps needed to resume our application. As of tuesday, September 1st 2020, it has reached the 3 months threshold for a missing welcome letter. My priority date is March 21/2019. Thanks
