Hello!

I live in Brazil and my fiancee is currently in the US. He just sent the papers to the USCIS and is coming to Brazil so we can spend a few months together.

I would like to add him to my health plan as a benefitiary so he could use it in his time in Brazil, but to do that I need to be either legally married or in a stable union.

I won't get married of course, but I was wondering if this stable union thig could mess up our process? I know that US immigration doesn't recognize this kind of process but still, I'm not sure if it's worth a try.

K1 Visa, we got married, what are next steps?

After a long complicated process my fianc e was approved and entered the US on March 5, 2022 & we got married on March 31, 2022 in Colorado. The date written on her visa that we need to be married by is June 2nd, 2022(90 days from entry).What are the next steps for us?, do we file I 485? Or are there other things to do? We have never received anything in the mail or email related to the K 1. Also to make the situation more complex, I am in the process of selling my house, closing on May 12, we are not sure what our next address will be, may stay with my parents in other state or in Airbnb for short time, will have a PO box. The community here on visa journey has been great, thank you in advance for your help!

HI All,

Saw a few people were able to expedite a the EAD process based on job offers. My spouse is processing an AOS here, could she pursue jobs, get an offer, and then request her application to be expedited?

TSC approved I140s not going to NVC

Hello everyone

Our I-140 was approved in March 2nd at TSC. We haven't heard yet from NVC and case status at USCIS shows only "My case was approved". I 797 arrived on March 11. We heard that it is normal for cases to take 6-8 weeks, however it looks like there is something happening specifically at TSC. I checked a sample of cases from both TSC and Nebraska and while Nebraska cases are being forwarded to the NVC usually in two weeks, most TSC cases since December are not moving. Are there other people in the same situation? Any suggestions that can be done to expedite it or information about what is happening ?

So far I have sent an Inquiry to the DS after 30 days of the case approved (still queued) and an email to NVCResearch@state.gov which as answered stating that case hasn't been received by the DS. USCIS inquiries only go through after 60 days of last action and are the next step I plan.

FE review note for evidence of income

Hi everyone,

I submitted my initial documents on 01/28 and got an RFE on 04/15 with two messages:

1. "Please submit evidence of income"

2. "This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p."

I am the petitioner sponsoring my wife who lives in Brazil. I am trying to qualify on assets (Fidelity stock portfolio > 100k) since my current income is below the poverty threshold. Apparently, in those cases you have to submit a document under the PROOF OF CURRENT OR SELF-EMPLOYMENT category and that seems to be why we got the RFE.

Since I m in the process of moving to the US, my current income comes solely from a rental property in Brazil (around USD$24000/year). I'm planning to submit my lease contract and a statement from the management company showing the rents I receive as proof of income.

I m also trying to avoid the complication of adding a joint sponsor since all my other documents have already been accepted.

I have the following questions for anyone who has gone through this process:

1) What would be good evidence to upload for rental income? Is a lease contract (translated) and an english statement on official letterhead from the real estate management company confirming my rental income enough to at least get a DQ?

2) Can the NVC actually require a joint sponsor or will that only potentially come up at the consulate interview? All my documents have already been accepted so I would prefer to add the joint sponsor information only after the DQ

3) If you had a similar RFE, how long did it take them to review the evidence of income and get a DQ?
