Hello all!

I am USC. My spouse and I live in Australia. I have lived here for the past 4 years. Our petition has advanced to NVC. I am a performer, and my primary income in Australia comes from performing. NVC websites says the following: "If you completed Form I-864, I-864A, or I-864EZ and the income reported on this form or your tax transcript reflects income below the poverty guidelines for the year the form was submitted, submit evidence of your income. If you are currently self-employed in any of the following ways, you do not need to obtain submit evidence of income:
Babysitter, elderly caretaker, construction worker, handyperson, housekeeper, landlord, musician, nanny, seamstress, tailor, artist, or writer."

So obviously because I don't have employment in the US, my income will appear insufficient, but according to this wording, I don't need to show evidence of income. Can someone explain to me how this makes sense? The one person we can approach about being a joint sponsor is a bit of a stretch, so if we don't need to have one, then that's ideal.

OTHER QUESTION

My spouse is previously married. His "Licence and Certificate of Marriage" from the State of California has "CUSTOMER COPY" watermarked on it, and does not have a State File Number nor a Local Registration Number, and it has not been signed by the Local Registrar. However, it does have the original signatures from all of the parties involved. Will this be suitable for NVC or should I order an authorised copy through VitalChek?

Hello,

I submitted my GC application (marriage based to US citizen) on 23rd September (they received it 29th by FedEx and we got notifications 2 weeks ago from USCIS). I didn't include the form I-944 since it wasn't required until 22nd September and I had no idea that changed on the 22nd.

Does anyone have any recommendation of what to do? Will they just send me an RFI for this eventually? Or should I just fill it out now and submit it? If so, how do I attach it to my application, there doesn't seem to be a field for the Alien Number?

Travelling within 6 Months

So my spouses IR1 interview is tomorrow in Hong Kong, we only had about 3-4 weeks from the notice and kind of rushed with the medical so we'd make it in time.

Our plan is for our kids to finish school here... We don't mind making a trip early next year for a week or two to activate her visa, she could then come back to HK until late June, early July (I'm assuming that is fine as well). However at the moment any incoming travelers from USA need to spend 2 weeks in a hotel here to self quarantine (regardless of a negative covid test on arrival)... Obviously not ideal and hard to say if it will change next year...

Anyone else have any experience with this? If she doesn't travel before 6 months, would we need new medical check? New interview and fees, etc? Any other ideas? I have also gotten in touch with consulate here. Thanks!!

I-864a notarized?

I can see that the form i-864a needs to be notarized from May 2020 onwards for the immigration visas.

It states on the website the Affidavit of support needs to be notarized by a immigration officer or U.S Consular.

So my problem is my partner currently lives in Australia with me. How on earth are we meant to do this?

Can i wait until the interview date to have the consular sign the form for us? Or do i have to go and find and pay an immigration lawyer to sign this as well. Is this the same with my partners mum who will be joint sponsoring us? She currently lives in America.

Ugh seems like such an annoying step to make!

Is there any aussies or others out there living with their fiance already while applying for the K1 visa?

My partner is on a student visa and we live together in Sydney Australia. She is applying for a post grad visa to work here for next year.

I would just like to hear your story on the process with your affidavits and submitting evidence of a relationship and what difficulties or handy info you'd like to share!

I know many people are going to tell me to apply for the CR-1 visa and i've looked into this process extensively and my partner and i have come to terms that this doesn't fit well with us considering her family cannot attend the wedding here in Australia and this would cause quite a bit of tense which is something we'd rather avoid. I am fully aware of being unemployed for nearly up to a year and we will be financially capable of supporting this. I have also looked into the states driving policy as well and loads more!

Please share any other info that could be handy rather than the CR1 visa route.
