Question on I-864 and self-employment

Hi There,

My husband is self-employed - it is a sole proprietor LLC so he only employs himself. We are over the limit for the poverty guidelines, and have his three most recent tax returns, however he does not have any form W-2s or 1099s (apparently he's not obligated to make them for himself).

Do we just attach a letter to the I-864 to that effect? We have his Schedule C from his tax returns. What will USCIS do without the W-2s?

I own my own business. I photo copied the business licence wrote a letter explaining all my business deals IE what kind what I do blah blah and sent in all the taxes schedule C's and so forth. I also went a stpe further and got a couple of letters of confirmation from people I do business with mainly because I was a fairly new business ( with in a year).

When I sent in my I864 there were no RFE's no questions and no problems

Also I sent in the few months before financial income records and a current profit and loss statement and what I thought the future projections would be. ( sorry forgot about that stuff)

The form instructions are an excellent source of information. They should be read completely.

From page 7 of the I-864 instructions:

If you checked box 22( B ) (self-employed), you should have completed one of the following forms with your Federal income tax return: Schedule C (Profit or Loss from Business), Schedule D (Capital Gains), Schedule E (Supplemental Income or Loss) or Schedule F (Profit or Loss from Farming).You must include each and every Form 1040 Schedule, if any, that you filed with your Federal tax return.
