Hello everyone! We sent our k1 petition last July 07 and we're expecting an RFE because my fiance didn't include my Birth Certificate and or Passport copies. He thought that they only need his BC and Passport. :( So what do you think? Is it possible or am i worrying 2 much?

Pls. tell us if we're right or wrong?

hi, it doesnt matter if your fiance did not sent your BC and pasport copies because it did not ask at the application form, just dont worry much just wait if u have FRE then thats the time u send it at uscis, BC and pasport will be needed on the interview, just be patience your noa2 will be there soon....goodluck.....

I only sent mine for proof of citizenship. Take a look at the K-1 guide here on VJ and specifically at what should be sent with the i-129, maybe that will ease your mind. Good luck :thumbs:

Agreed. I've also seen a couple of people received RFE for not inluding the BC for the beneficiary. It's one of those hits and misses depending on who's the adjudicator for the case. I truly hope that you will not get an RFE for this. Good Luck with the process and for a speedy approval. :thumbs:

You won't get an RFE if he didn't send your items. You will present them at the interview.

This isn't necessarily true. In fact, there was a poster here last week who got an RFE for NOT including a copy of the beneficiaries birth certificate. It can happen.

Well, you know, if you do get an RFE, just send it back asap. It shouldn't put your petition behind too much, maybe a few weeks or more.

Do you have your Birth certificate, the long form? If so, make a copy and send it to your sweetie now, just in case, that way he can just pop it in the mail.

The only thing I sent with my petition (I'm the petitioner for my Canadian fiance) was MY birth certificate, 2 photos of he and I together, a passport-style photo of myself and him, the G-325A biographical info form, and boarding pass stubs from his trip here and mine there (with itineraries). We got an RFE because the photos I sent weren't dated, but I was never asked for any passport information or HIS birth certificate. I think you'll be okay :thumbs:
