Timeline

Hello, I have a friend that may marry a gal that is currently visiting the U.S. without a Visa. She is from a country that participates in the Visa Waiver program. She did come to the U.S. with the intention of seeing more of America. They met, and it was love at first sight :) My question is, what would be the process if they decided to marry while she is in the U.S.? Can they marry and have her stay in the U.S.? What forms are required to get the ball rolling?

Any input would be greatly appreciated.

I would also recommend your friend has a chat with a immigration lawyer to go over their case and make sure there are no issues that could cause them problems when doing AOS...

But the Answer is Yes they can get married and file for AOS and I-130, and she can remain here while it is being processed.... infact she should not leave the US until she has her greencard in hand...

12/18/2014-I-797C NOA received in mail; sent in old version of N-400

01/02/2014-USCIS Lewisville Received Package

01/06/2014-Checked Cashed

01/12/2014-Email from USCIS Receipt of Package

02/03/15-Biometrics Completed

02/04/15-USCIS notice of scheduling Interview

02/24/15-Interview scheduled for 03/31/2015

03/31/2015-Interview>Went Very well!

She came here without a visa, on the Visa Waiver Program. OP says that in their first post.

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!
