Hi.im just new here.my annulment is already over but the decision of the judge and the finality hasnt released yet, also,i have just filed a petition for my change of name, there is a one letter error on my surname and i still have to wait for 45working days before they can change it.

My question is,can my fiance file for a K1 and K2(i have an 11yr old kid) petition even though i dont have these(finality of my annulment and birth certificate) papers yet?

Please enlighten me.

Thanks in advance.

The important thing at the time of filing is that you need to be free to marry. If you could not walk into the courthouse tomorrow and get married, then you need to wait for those papers.

You both must be legally able to marry. If your annulment isn't completed yet you are not legally able to marry.
