Hi there!

I have read quite a few posts today and got a lot out of this. I can't imagine how people did this before the internet. Ouch!

Now that things are very serious with my fiancee and I, I am researching our options.

Could someone give me a general overview of what happens after marriage on a K1?

For example:

Let's assume she arrives on a K1 and we are married in 10 Days.

Does she have to return back to her country or can she stay here with me?

Is it indefinitley or only for the remainder of the 90 days?

If she can stay here past the 90 days, when can she work and register for school, legally?

Can she come and go to her home country without problems?

I know this may be putting the cart before the horse, but we want to start the paperwork in the next couple of weeks and we are still deciding which Visa works best for our situation.

AOS Timeline

08-14-06: Mailed I-485 to Chicago

08-24-06: NOA for I-485

09-08-06: Biometrics Appointment

09-25-06: I-485 transferred to CSC

09-28-06: I-485 received at CSC

10-18-06: AOS Approved

10-21-06: Approval notice mailed

10-23-06: Received "Welcome Letter"

10-27-06: Received 2 yr Green Card

I-751 Timeline

07-21-08: Mailed I-751 to VSC

07-25-08: NOA for I-751

08-27-08: Biometrics Appointment

02-25-09: I-751 transferred to CSC

04-17-09: I-751 Approved

06-22-09: Received 10 yr Green Card

N-400 Timeline

07-20-09: Mailed N-400 to Lewisville, TX

07-23-09: NOA for N-400

08-14-09: Biometrics Appointment

09-08-09: Interview Date Oct 07

10-30-09: Oath Ceremony

11-20-09: Received Passport!!!

She does not have to return back to her country, once she is here on the K-1, you can apply for the AOS from the comfort of your own home. :luv:

If she arrives at a port of entry where they give her a work authorization (EAD Stamp), she can work almost right away. However, the EAD stamp only lasts 90 days.. So.. after your marriage, when you file for AOS, you also have to apply for EAD.. however.. there may be a gap in time between the first EAD stamp and the EAD that is sent with the AOS. If there is a gap in time between the two, she has to leave work, and begin again when she gets the other one.

If she wants to go to her home country and come back, she has to apply for Advance Parole.
