Approved April/May/June Filers waiting for NVC

You won't need G-325As again until you adjust status. I134 is the Affidavit of support form for K3 (I864 is for immigrant visas and for adjusting status). Copy of I129F and I130 would be for your wife's reference only. Embassy does not need it from you (the approved I129F is what is delivered from NVC via DHL).

You will need to fill out DS 156. You might need additional DS forms depending on your consulate/embassy. Check the consulate website for additional forms needed (possibilities inclued DS 157, DS 158, additional questionnaires).

You will need to obtain employment letter, bank statements (if you are using assets to meet requirements), recent pay stubs, last years tax return (or tax transcripts) as part of the I134.

I have been in contact with the embassy for over a year... long story. They sent me all of the documents as well but I think they sent me some that were for an immigrant visa not for a non-immigrant visa (K-3).

Could you please tell me which forms they sent you and do we need to send? I am guessing a new batch of G-325A's , a copy of the original 129F, I-864, copy of police record, passport, copy of I-130?

Also, I downloaded the DS 156 from the internet got the cover sheet with the "barcode" so I am planning on sending four copies of everything to my wife (two to submit prior and two to take with her).

Got approved for I29f on 10-25-07. Call the NVC every two days.they said they still do not have it. :blink: it seems that a lot of other people are having better luck than i am.does anybody have a clue as to what the hold up is? :help: good luck to everybody

Human error is my hypothesis. NVC refuses to check for typos and loves to repeat the words it takes three to four weeks.

To be specific, I called USCIS and convinced the nice lady to start a request to resend our petition just two days short of the 28 day or one month timeline. :innocent:

Then to add insult to injury, I hope the two week average to receive visas after approval at USEM is returned to the normal two to three day average by the time our spouses get their interviews next year. :P

i134 form has expire date: 04-30-07. is it ok to still use that form?

If you got the form off of the USCIS website, you're fine. The expiration date is just a in-house reminder to review the form, but if no changes are needed or the review isn't finished they allow the form. Sometimes they update a form but still allow the last two or three revisions before the latest one to be valid....the last revision from what I've seen for the I-134 is the one that "expired" in April. It's this year's form, so go ahead and use it.

So is mine. You want the current gross salary. What you are current making now. It is your current income that is the basis of your support for your spouse.

For example, if you made over the required support amount last year when you filed your taxes, but do not now, then you would need a joint sponsor. Likewise, if you did not make enough last year, but your current salary puts you 125% above the poverty line for your household size, you should be okay without a joint sponsor. That is why they are interested in what you are making now.

my gross income from last years tax return is different then my current income(current is more). my employment letter has my current salary.

Thanks for the info.This is making me worried.She is now 2 months pregnant. With the health insurance that i have she needs to be here be feb.I hired a person to do all the paper work everything checks out fine.I am going back to manila when she gets to go for the interview.i have been over there three times this year.I am just ready for her to be here.we are all tax payers it seems that they would do something to speed this up for us. good everybodyluck

Congrats on having the baby on the way! Try calling USCIS and see what they have to say. The regular line will be that you have to wait as much as 90 days to get to NVC. You filed K1 right? That should get to NVC fairly quick. The big holdup on getting to NVC was with the K3s because of their whole process of getting the 2 petitions together and one ready to ship to NVC and one to NRC.

Also, I don't understand the part about your insurance. She is your fiancee right? So, you can't add her (even during your open enrollment period), but regardless of when she gets here, you can add her immediately after getting married (and must do so within 30 days usually) since that is a life event that triggers your right to add her to your benefits. So why would she have to be here by Feb.? I am only asking as related to the insurance. I understand that your fiancee is pregnant and you want to be with her and you want her here in the US yesterday.

my company told me that she needs at least three months on the insurance so that they will cover the cost of all of it.After that it goes down on how much the will pay.

Raquel,

You should be getting to NVC about two weeks after you approval date of October 31. You should call NVC on Monday and I hope you will hear that not only have they received your petition, but perhaps have even forwarded it on the embassy already. The average time for getting to NVC recently for K3 (the most recent batch of approvals) has around two weeks. The average time to get it forwarded to the embassy is around 2 days.

The delay I was referring was from about a month and a half ago when it was taking 4-5 weeks just to get to NVC from USCIS. But that appears to be resolved now for the most part.

I am tracking the progress of K3ers to and through NVC in this thread. The chart is in a post five above this one here. Just post that date NVC received it when you find out that you have made it to NVC!
