Questions on the DS-156

Hello VJ,

Please help me tell my husband what to put for some of the answers on the DS-156 as I am not sure. We are married and have a K3 visa interview on Oct. 31st and don't want to make any mistakes.

On #31. Have you ever been refused a U.S. Visa? Yes or No-When?-Where?-What type of visa?

Well I am not sure what to put when we got married my husband applied for a tourist visa to come visit I told him they would deny it but he said he had to know for sure he paid the visa fee and of course he was denied. He is saying he was not denied only advised that his wife had to go back to the US and file the necessary paperwork like the I-130. So what do ya'll think should we answer the question yes or no?

On #36 Has anyone ever filed an Immigrant Visa Petition on your Behalf? Yes or No If yes Who?

Since it is a K3 interview do we mark yes that his wife has filed the I-130 as well or say no.

Noone has ever filed for him before except me. THe questions are a bit tricky.

I answered yes to both.

I was denied entry to the US- I added a separate piece of paper to explain both my denials. I was also asked about it at the interview- I said I had lack of ties to Canada. He just nodded and said it happens often.

I answered yes to the other question because we did have an I 130 filed. When it asked the name of who had petitioned for me, I wrote my husband. I was never asked about this at the interview.

According to me you have to answer with Yes to both questions. Wish you luck :thumbs:

To add to what the others have said, it's yes to both questions. They already have the information in their system, so if you say no they will bring it up to your husband and it will be considered lying under oath.

Why would a tourist visa be denied? Did you already apply for the K-3?

No, I had not applied for anything at that time I was still in Nigeria and we were just married. Tourist visas are almost impssible to get if you cannot show strong ties to your country especially in Africa. The CO told my husband he has greater ties to US than to Nigeria because his wife was a US citizen and he was denied.
