Hello,

My Scottish girlfriend and I came to the USA for a holiday (I'm an American but we were both living in England), and we are loving it back in America so much we both decided to get married and stay here.

This means however that we will be applying for an AOS without a K visa. I've noticed that the AOS guides (as well as the EAD guides so she can work before the green card) are specific for K visa holders. My future wife only has a tourist visa, which expires in 2 months.

From reading the guides and most of the posts on this board, I have a pretty good idea of the process of getting a AOS and a green card for K visa holders. But how different is it to apply for an AOS without a K visa? And can we apply for an EAD? How long can we expect before my wife will be able to work, and how long until she gets a green card? What are the major differences when applying for an AOS from a tourist visa than for applying from a K visa?

Any help you guys can give me would be great! Thank you, this board has been a savior for us!

You can also apply for EAD at the same time.

Hi,

I also sent AOS from other visa then K, you can do the same. You need to file : I-130, I-864, I-485, G325A for you and your wife, and I-693, and I-765 for Employment, I-131 traveling document which is optional.

You need to pay just for I-130 $355 and for I-485 $1010

We are doing the same thing, but my understanding is there are more fees. I was told $1710.00 for everything, the work permit and advanced parole.

He and his staff seemed very knowledgeable in two free consultations. He has done alot of these AOS and says he has never had one been denied. He offers intrest free finacing on the retainer. Just a few things to think about.

My husband was a 4 year overstay on a tourist visa, we filed I-130 with I-485 and I-765 (before the fee was a combined rate for I-485, I-765, and I-131), and we were approved with no issues. The only hurdle you may have to overcome is proving there was no intent to immigrate upon entry, but many times, this isn't even brought up - so just be prepared.

WE did it without a lawyer.... what we did was went and had a 1 hour appointment just to go over our case and make sure we had nothing that was going to cause us big issues later... we did all the paperwork ourselves and we did not have any problems.... having a lawyer do your paperwork is not going to stop you being denied if that is what USCIS think should happen... infact do a search on VJ for lawyer errors and delays.... there has been many many reports from people who have ended up getting rid of their lawyer half way through the process....

We spoke with many attorneys. so far I would recommend him. like I said he and his staff seem to be very knowledgable. He has done many of the AOS's. His fees quoted to us were $2500. which is the same price as most of the attorneys we have spoken with. Though it seems like alot of money. I am not willing to be the reason we get denied, because I filed something incorrect or didn't understand a question. To us it is worth it. He says it is possible for my husband to be working in around 3 to 4 monthes, and traveling out side the country with an advance parole in about the same amount of time. I have already spoken with 5 different people in their office. They were all very friendly. The first consultation is done by an "immigration specialist" they knew most of the answers to my question, but where able to come up with the answers for the ones they didn't know right off. The second call was free as well that one was with the attorney himself. He was very friendly, very personable. He is out of Las Vegas but has offices in Reno and Phoenix as well.

We looked at local or semi local attorneys but in Wyoming they don't do just the immigration or they weren't in the AILA.

I had one tell me he would research if we could even do it for $200 and hour. We had many that didn't know the answers or would contradict things. I even had one tell me to tweak some things because someone might think something. Of all the ones We talked to in three days, I got the best impression from John.

The guides here on VJ will enable you to file without the use of a lawyer.... most of the people here who have done AOS from a tourist visa or VWP did it on there own and had no issues.... I agree that an initial consult with a lawyer is a good idea but why pay all that money for someone to fill in the forms for you... they are not difficult to do...
